中外大數(shù)據(jù)企業(yè)網(wǎng)站隱私政策比較研究

【摘要】:自被媒體稱為“大數(shù)據(jù)元年”的2013年起,隨著人類存儲(chǔ)信息量和計(jì)算機(jī)數(shù)據(jù)處理能力的成倍增長(zhǎng),“大數(shù)據(jù)”一詞越來(lái)越多地被提及,這個(gè)出現(xiàn)在當(dāng)前信息時(shí)代的新概念詞匯開(kāi)始被廣泛的應(yīng)用到形容和定義與之相關(guān)的行業(yè)和產(chǎn)業(yè)技術(shù)革新。在這樣的背景條件下,隨之顯現(xiàn)出具備收集與發(fā)掘大數(shù)據(jù)潛在價(jià)值的企業(yè),被稱之為大數(shù)據(jù)企業(yè)。特別是在“信息就是金錢(qián)”的這個(gè)時(shí)代,個(gè)人數(shù)據(jù)不斷升值,被大數(shù)據(jù)企業(yè)不斷開(kāi)發(fā)與發(fā)掘。然而,很少有人注意到隱私已成為網(wǎng)絡(luò)個(gè)人數(shù)據(jù)的一部分。筆者認(rèn)為,在線個(gè)人隱私,一部分是完全不希望他人了解掌握的個(gè)人數(shù)據(jù),另一部分是半公開(kāi)的、信息控制權(quán)轉(zhuǎn)移到網(wǎng)路服務(wù)供應(yīng)商身上的個(gè)人數(shù)據(jù);隨著歷史發(fā)展進(jìn)入信息時(shí)代,由現(xiàn)實(shí)隱私保護(hù)延伸至在線隱私保護(hù);當(dāng)個(gè)人數(shù)據(jù)的潛在價(jià)值不斷被挖掘時(shí),隱私泄露被網(wǎng)絡(luò)用戶慢慢開(kāi)始關(guān)注為焦點(diǎn)問(wèn)題,這將影響信息網(wǎng)絡(luò)的健康運(yùn)作。隱私政策,扎根于本土法律法規(guī),以法律聲明的形式在企業(yè)網(wǎng)站中呈現(xiàn),既是一種具象化的法律保護(hù)手段,又是一種行之有效的行業(yè)自律手段,同時(shí)規(guī)定了整個(gè)行業(yè)應(yīng)當(dāng)承擔(dān)維護(hù)個(gè)人信息合法權(quán)益的責(zé)任和義務(wù)。從網(wǎng)站隱私政策的顯示位置、信息收集方式與內(nèi)容、共享性、用戶權(quán)利、兒童隱私、信息安全、保存期限等七個(gè)方面對(duì)國(guó)內(nèi)外大數(shù)據(jù)企業(yè)網(wǎng)站的隱私政策聲明進(jìn)行對(duì)比研究。研究表明,從框架內(nèi)容上看,中外大數(shù)據(jù)企業(yè)網(wǎng)站的隱私政策涵蓋內(nèi)容十分廣泛,但就內(nèi)容深度上看,我國(guó)仍與國(guó)外有較大不同之處。通過(guò)比較分析法,探明形成有較大不同之處的原因,據(jù)此給出合理建議,維護(hù)網(wǎng)絡(luò)用戶合法權(quán)益,督促大數(shù)據(jù)行業(yè)長(zhǎng)足進(jìn)步。
[Abstract]:Since 2013, when the media called big data the first year, as the amount of information stored and the ability of computer data processing have multiplied, the word "" has been increasingly mentioned. This new concept vocabulary, which appeared in the information age, has been widely used to describe and define the related industries and industrial technological innovation. Under such background conditions, the enterprises which have the potential value of collecting and discovering big data are called big data enterprises. Especially in the era of "information is money", personal data is constantly appreciated and constantly developed and excavated by big data enterprises. However, few people notice that privacy has become a part of personal data on the Internet. The author thinks that online personal privacy is part of the personal data that people do not want others to understand the other part is semi-open the control of information transferred to the network service providers of personal data; With the historical development into the information age, the privacy protection extends from the real privacy protection to the online privacy protection. When the potential value of personal data is constantly being excavated, privacy disclosure has gradually begun to be the focus of attention of the network users. This will affect the healthy operation of the information network. The privacy policy, rooted in local laws and regulations and presented in the form of legal statements on the corporate website, is not only a concrete legal means of protection, but also an effective means of self-discipline in the industry. At the same time, the whole industry should assume the responsibility and obligation to protect the legitimate rights and interests of personal information. This paper makes a comparative study on the privacy policy statements of big data enterprise websites at home and abroad from seven aspects: the display position of the privacy policy, the way and content of information collection, the sharing of information, the rights of users, the privacy of children, the security of information and the duration of preservation. The study shows that the privacy policy of big data enterprise website covers a wide range of contents in terms of frame content, but in terms of content depth, there are still some differences between China and foreign countries. By means of comparative analysis, we can find out the reasons why there are great differences, and then give some reasonable suggestions, safeguard the legitimate rights and interests of network users, and urge big data to make great progress in the industry.
