【摘要】：電信業(yè)在現(xiàn)代社會是關乎經(jīng)濟、民生的支柱性產(chǎn)業(yè)。由于電信業(yè)具有獨有性、保密性、自然壟斷性,所以隨著經(jīng)濟的發(fā)展,世界各國開始對電信行業(yè)進行一系列的改革,使其適應市場發(fā)展的需要。然而電信法律法規(guī)的不完善和政府監(jiān)管制度的缺位,導致電信消費者的合法權益屢屢被侵害。多年來,“壟斷”“暴利”“上網(wǎng)費昂貴”“垃圾短信”等字眼總是與電信相關新聞評論如影隨形。其中,不少評論與消費者的不滿直指政府監(jiān)管不力或失當。 由此可見,電信行業(yè)監(jiān)管體制的改革勢在必行。雖然經(jīng)過幾次改革,我國電信行業(yè)監(jiān)管體制在逐漸完善,但是針對我國特有國情,我國監(jiān)管體制面臨的問題也逐漸凸顯。所以在法學視角下,就電信行業(yè)政府監(jiān)管體制進行研究,對于電信業(yè)的良性發(fā)展具有積極的作用和現(xiàn)實的意義。 本文采取規(guī)范分析、實證分析和歷史分析的方法,圍繞著電信監(jiān)管體制的歷史變遷,通過對國內外電信業(yè)政府監(jiān)管體制的比較分析,總結出電信監(jiān)管體制變革的理論與完善途徑,為我國電信行業(yè)政府監(jiān)管體制的完善提出了解決辦法。
[Abstract]:Telecommunications industry is a pillar industry related to economy and people's livelihood in modern society. Due to its unique nature, confidentiality and natural monopoly, with the development of economy, various countries in the world have begun to carry out a series of reforms to the telecommunications industry. To meet the needs of market development. However, the imperfect telecommunications laws and regulations and the absence of a government regulatory system, For many years, words such as "monopoly", "profiteering", "expensive Internet access," "junk messaging" and other words have always accompanied the commentary on telecommunications related news. Many comments and consumer dissatisfaction point to weak or improper government regulation. It can be seen from this that the reform of the regulatory system of the telecommunications industry is imperative. Although after several reforms, the regulatory system of the telecommunications industry in our country has been gradually improved, but in view of the unique national conditions of our country, Therefore, from the perspective of law, the research on the government supervision system of telecommunications industry has positive role and practical significance for the benign development of telecommunications industry. This paper adopts the methods of normative analysis, empirical analysis and historical analysis, focusing on the historical changes of the telecommunication regulatory system, through the comparative analysis of the domestic and foreign telecommunications industry government regulatory system. This paper summarizes the theory and the perfect way of the reform of the telecommunication supervision system, and puts forward the solution for the perfection of the government supervision system of the telecommunication industry in our country.
