小產(chǎn)權(quán)房的治理機(jī)制研究

【摘要】:在我國(guó)城市化和住房商品化進(jìn)程中,小產(chǎn)權(quán)房蔓延現(xiàn)象一直未得到有效地治理,引起了社會(huì)各界的廣泛關(guān)注。治理效果不理想的主要原因在于治理機(jī)制不健全。本文基于治理理論和公眾參與理論研究小產(chǎn)權(quán)房的治理機(jī)制,為解決我國(guó)小產(chǎn)權(quán)房問(wèn)題提供一個(gè)根本途徑。 通過(guò)調(diào)查分析小產(chǎn)權(quán)房的市場(chǎng)現(xiàn)狀和整治現(xiàn)狀,發(fā)現(xiàn)在小產(chǎn)權(quán)房的整治過(guò)程中存在幾個(gè)值得關(guān)注的問(wèn)題,具體表現(xiàn)在:由政府主導(dǎo)的管制,忽視了村民、購(gòu)房者等相關(guān)方的利益訴求;政府與民間利益相關(guān)方之間缺乏有效的溝通與協(xié)商;村民和購(gòu)房者等利益相關(guān)者處于被動(dòng)、弱勢(shì)地位,參與意識(shí)淡薄,且參與程度低。而產(chǎn)生這些問(wèn)題的原因是:未從法律上規(guī)定小產(chǎn)權(quán)房治理應(yīng)遵循的具體操作標(biāo)準(zhǔn)和程序,使村民、購(gòu)房者等相關(guān)群體的利益表達(dá)機(jī)制缺失;小產(chǎn)權(quán)房治理理念缺失,信息公開(kāi)、意見(jiàn)反饋、溝通和協(xié)商等機(jī)制不健全;缺乏為實(shí)現(xiàn)有效治理提供保障的組織系統(tǒng)。 針對(duì)小產(chǎn)權(quán)房治理中存在的主要問(wèn)題,運(yùn)用治理理論和公眾參與理論,提出了小產(chǎn)權(quán)房的治理機(jī)制,包括法律制度、組織體系、信息公開(kāi)、溝通、協(xié)商和意見(jiàn)反饋機(jī)制等。指出建立和完善小產(chǎn)權(quán)房治理的法律制度、第三方監(jiān)督與協(xié)調(diào)、信息公開(kāi)、意見(jiàn)反饋、溝通和協(xié)商等治理機(jī)制,是實(shí)現(xiàn)小產(chǎn)權(quán)房有效治理的基本保障。闡述了小產(chǎn)權(quán)房治理機(jī)制的運(yùn)行模式及過(guò)程,從治理草案的準(zhǔn)備、治理方案的制定與實(shí)施、治理效果評(píng)價(jià)和總結(jié)等階段分別描述了運(yùn)行過(guò)程中各階段的主要工作。 通過(guò)文本分析和問(wèn)卷調(diào)查,識(shí)別出阻礙小產(chǎn)權(quán)房治理機(jī)制形成與發(fā)展的18個(gè)一般因素。運(yùn)用主成分分析法從中提取出5個(gè)關(guān)鍵障礙因素,其中政府與民間利益相關(guān)者之間缺乏溝通與反饋機(jī)制且治理責(zé)任不明確是目前阻礙小產(chǎn)權(quán)房治理機(jī)制形成與發(fā)展的首要因素。此外,政府對(duì)待小產(chǎn)權(quán)房治理的態(tài)度不清晰、相關(guān)法律與政策制度不完善、缺少增進(jìn)政府與民間利益相關(guān)者相互溝通和協(xié)商的中間組織以及缺乏行之有效的方法和公開(kāi)透明、制度化的程序等,也是阻礙小產(chǎn)權(quán)房治理機(jī)制形成與發(fā)展的主要因素。針對(duì)這些主要障礙因素,提出了完善與治理機(jī)制相關(guān)的法律和制度、提高公眾參與治理的意識(shí)和能力、重視治理組織系統(tǒng)的建設(shè)、完善治理程序和環(huán)節(jié)等對(duì)策和具體建議。 研究成果的應(yīng)用有助于促進(jìn)小產(chǎn)權(quán)房治理理論與實(shí)踐的發(fā)展,明確我國(guó)小產(chǎn)權(quán)房治理機(jī)制形成與發(fā)展的方向,,為實(shí)現(xiàn)小產(chǎn)權(quán)房的有效治理提供了一個(gè)基本的途徑。
[Abstract]:In the process of urbanization and commercialization of housing in China, the phenomenon of the spread of small property houses has not been effectively managed, which has caused widespread concern from all walks of life. The main reason why the governance effect is not ideal is that the governance mechanism is not perfect. Based on the governance theory and the public participation theory, this paper studies the governance mechanism of the small property house, which provides a fundamental way to solve the problem of the small property house in our country. Through the investigation and analysis of the market situation and the regulation situation of the small property house, it is found that there are several problems worthy of attention in the process of the renovation of the small property house, which is manifested in: the government dominates the control, neglecting the villagers, Housing buyers and other stakeholders' interest demands; the lack of effective communication and consultation between the government and non-governmental stakeholders; villagers and buyers and other stakeholders in a passive, vulnerable position, weak sense of participation, and low level of participation. The reasons for these problems are that the specific operating standards and procedures that should be followed in the governance of small property houses are not stipulated in the law, so that the interest expression mechanism of the villagers, buyers and other related groups is missing, the concept of small property housing governance is missing, and the information is open to the public. Feedback, communication, consultation and other mechanisms are not perfect; lack of effective governance for the implementation of the organizational system. In view of the main problems existing in the governance of the small property right house, this paper applies the governance theory and the theory of public participation, and puts forward the governance mechanism of the small property right house, including the legal system, the organization system, the information disclosure, the communication, the consultation and the opinion feedback mechanism and so on. It is pointed out that establishing and perfecting the legal system, third party supervision and coordination, information publicity, opinion feedback, communication and consultation are the basic guarantee to realize the effective governance of the small property house. This paper expounds the operation mode and process of the governance mechanism of the small property right house, and describes the main work of each stage in the operation process from the preparation of the governance draft, the formulation and implementation of the governance scheme, the evaluation and summary of the governance effect, etc. Through text analysis and questionnaire survey, the paper identifies 18 general factors that hinder the formation and development of small property right housing governance mechanism. Five key obstacle factors were extracted by principal component analysis, among which the lack of communication and feedback mechanism between government and non-governmental stakeholders and unclear governance responsibility are the primary factors hindering the formation and development of small property rights housing governance mechanism. In addition, the government's attitude towards the governance of small property houses is not clear, the relevant legal and policy systems are not perfect, there is a lack of intermediate organizations to promote communication and consultation between the government and private stakeholders, and there is a lack of effective methods and transparency. The institutionalized procedure is also the main factor that hinders the formation and development of the management mechanism of the small property right house. Aiming at these main obstacle factors, this paper puts forward some countermeasures and concrete suggestions, such as perfecting the law and system related to governance mechanism, improving the consciousness and ability of public participation in governance, paying attention to the construction of governance organization system, perfecting the procedure and link of governance, and so on. The application of the research results is helpful to promote the development of the theory and practice of the management of the small property house, to make clear the direction of the formation and development of the governance mechanism of the small property house in our country, and to provide a basic way to realize the effective management of the small property house.
