【摘要】：信托財產的保護是信托制度的一個核心問題,因為信托財產的安全是信托目的能夠順利實現的基礎。而信托財產由受托人占有并經營,所以信托財產的保護必須以受托人正確履行受托義務為前提。而受托人違反信托所承擔的損害賠償責任制度的完善又是受托人能夠正確履行義務的保障。本文以受托人的賠償責任為題,結合各國立法與實踐對信托受托人賠償責任的關鍵問題進行分析與說明。詳細闡述了受托人賠償責任的性質、受托人賠償責任的歸責原則、受托人賠償責任的承擔方式、受托人賠償責任的免責條款。并在此基礎上對我國信托立法進行了簡要分析與說明,除引言與結語外.,本文分為三個部分。論文第一部分主要研究了信托受托人損害賠償責任的來源與法律性質。首先對受托人賠償責任做出嚴格的法律界定；其次詳細介紹了受托人損害賠償責任的法律來源——信賴義務,并對信賴義務的主要內容進行詳細闡述；最后結合各國學者對受托人賠償責任性質的不同見解,提出觀點,即受托人賠償責任是一種獨立的“違信責任”。論文第二部分包括三塊內容：(1)受托人賠償責任歸責原則。這一部分分別介紹了受托人違反注意義務時,過錯責任的判斷問題,以及受托人違反分別管理義務情形下,歸責原則的適用原理；(2)受托人賠償責任的承擔。這一部分對兩個問題進行了闡述：第一、結合損害賠償法律制度的一般原理對受托人賠償責任的賠償范圍進行分析說明；第二、介紹了受托人損害賠償責任的承擔方式及賠償數額計算時應當遵循的原則與方法。(3)受托人賠償責任的免責事由。這一部分結合英美國家立法與實踐的有關經驗,對受托人的三項免責事由進行了詳細的分析與介紹。論文第三部分是論文的結尾。這一部分,結合前述原理,主要就我國信托法律中,受托人賠償責任歸責原則的適用、賠償責任的履行、賠償責任的免責事由三個關鍵問題作出分析并提出建議,希望能為我國信托法律制度的完善做出一點貢獻。
[Abstract]:The protection of the trust property is a core issue of the trust system, because the security of the trust property is the basis for the successful realization of the trust purpose. The trust property is occupied and operated by the trustee, so the protection of the trust property must be based on the trustee's right to perform the trustee obligation. The perfection of the responsibility system is the guarantee of the trustee's ability to fulfill the obligation correctly. This article, based on the liability of the trustee, analyzes and explains the key issues of the liability of the trustee to the trustee, and expounds the nature of the liability of the trustee, the principle of the liability of the trustee, the trustee and the trustee's compensation. In addition to the introduction and conclusion, the article is divided into three parts. The first part of the paper mainly studies the source and legal nature of the liability for the damage of the trustee, and the first part of the paper is responsible for the trustee's compensation. In order to make a strict legal definition, secondly, the legal source of the liability of the trustee's damage compensation is introduced in detail, and the main contents of the trust obligation are elaborated in detail. Finally, the author puts forward the view that the liability of the trustee is an independent "liability", which is based on the different opinions of the scholars of various countries on the liability of the trustee. The second part of the paper includes three pieces of contents: (1) the principle of liability attributable to the trustee. This part introduces the judgment of the liability of the trustee when he violates the duty of attention, and the principle of the appropriate use of the principle of liability under the circumstances of the trustee's violation of the respective management obligations; (2) the liability of the trustee. Part of the two problems are expounded: first, combined with the general principle of the legal system of damages for the compensation liability of the trustee to analyze the scope of compensation; second, introduced the trustee liability for damage liability and the amount of compensation should be followed in the original rules and methods. (3) the liability of the trustee liability exemption This part analyses and introduces the three disclaimers of the trustee in detail. The third part of the paper is the end of the thesis.
