【摘要】：農(nóng)村小額信貸在我國(guó)的發(fā)展僅數(shù)十年，但作為一種新型信貸服務(wù)模式，，對(duì)我國(guó)經(jīng)濟(jì)發(fā)展有著十分重要的作用。但由于其在我國(guó)發(fā)展的時(shí)間較短，我國(guó)還未有相應(yīng)的法律對(duì)其予以規(guī)制，這嚴(yán)重影響了小額信貸在我國(guó)的健康發(fā)展。本文主要以河北易縣小額信貸為例，以在其發(fā)展的過(guò)程中遇到的法律問(wèn)題為探討基礎(chǔ)，從法律角度思考我國(guó)農(nóng)村小額信貸存在的風(fēng)險(xiǎn)和法律困境，并借鑒國(guó)際上的農(nóng)村小額信貸的實(shí)踐經(jīng)驗(yàn)，從法律層面提出了幾點(diǎn)解決當(dāng)前我國(guó)農(nóng)村小額信貸面臨的法律困境和風(fēng)險(xiǎn)難關(guān)的建議。希望能使農(nóng)村小額信貸在我國(guó)的身份合法化，并通過(guò)法律加強(qiáng)對(duì)我國(guó)農(nóng)村小額信貸的監(jiān)管，使得法律能夠?yàn)樾☆~信貸保駕護(hù)航，從而保證我國(guó)農(nóng)村小額信貸的長(zhǎng)期健康的發(fā)展。
[Abstract]:The development of rural micro-credit in China is only decades, but as a new type of credit service mode, it plays a very important role in the economic development of our country. There is no corresponding law to regulate it in our country, which has seriously affected the healthy development of microfinance in our country. This paper mainly takes the microfinance in Yi County, Hebei Province as an example, based on the legal problems encountered in the process of its development. From the point of view of law, the author thinks about the risks and legal difficulties of rural microfinance in China, and draws lessons from the practical experience of rural micro-credit in the world. From the legal level, this paper puts forward several suggestions to solve the legal dilemma and the risk difficulties faced by rural microfinance in our country. We hope to legalize the status of rural micro-credit in our country. And through the law to strengthen the supervision of the rural micro-credit, make the law can protect the micro-credit, so as to ensure the long-term and healthy development of the rural micro-credit in our country.
