【摘要】：多年以來(lái),我國(guó)在實(shí)行征地區(qū)片綜合地價(jià)過(guò)程中,征地補(bǔ)償標(biāo)準(zhǔn)有了一定的提高,這在一定程度上緩解了我國(guó)征地中存在的一些問(wèn)題,但現(xiàn)實(shí)生活中,某些地區(qū)依然存在征地補(bǔ)償標(biāo)準(zhǔn)不合理的問(wèn)題,因此對(duì)征地區(qū)片綜合地價(jià)進(jìn)行研究具有重要的現(xiàn)實(shí)意義。本研究擬解決以下幾個(gè)主要問(wèn)題:①確定合理的征地補(bǔ)償標(biāo)準(zhǔn),提高征地補(bǔ)償標(biāo)準(zhǔn)的科學(xué)性;②建立保障農(nóng)民的合法權(quán)益、保證失地農(nóng)民生活水平有提高、生活質(zhì)量不降低的征地區(qū)片綜合地價(jià)體系;③實(shí)現(xiàn)征地政務(wù)工作公開(kāi)公正、公眾參與和監(jiān)督,做到征地過(guò)程中同地同價(jià)和征地補(bǔ)償標(biāo)準(zhǔn)的公平性;④建立和諧穩(wěn)定社會(huì)和促進(jìn)經(jīng)濟(jì)的快速發(fā)展,以及保證城鄉(xiāng)協(xié)調(diào)發(fā)展的征地體制與機(jī)制;⑤實(shí)現(xiàn)地價(jià)間平衡,同時(shí)為以后平衡研究提供思路,避免相鄰地區(qū)地價(jià)懸殊情況的發(fā)生。在闡述國(guó)內(nèi)外征地補(bǔ)償標(biāo)準(zhǔn)研究現(xiàn)狀,評(píng)述包括既得權(quán)利說(shuō)、特別犧牲論、人本說(shuō)等征地補(bǔ)償理論,以及討論包括地租理論、地價(jià)理論、土地生產(chǎn)力理論等征地補(bǔ)償標(biāo)準(zhǔn)制定理論的基礎(chǔ)上,解析了征地區(qū)片綜合地價(jià)的相關(guān)概念,闡明征地區(qū)片劃分原則、方法及制定征地區(qū)片綜合地價(jià)的原則;并以此為出發(fā)點(diǎn),對(duì)商州區(qū)的征地區(qū)片進(jìn)行了劃分,并采用案例比較法及年產(chǎn)值倍數(shù)法測(cè)算商州區(qū)征地區(qū)片綜合地價(jià);最后,對(duì)測(cè)算結(jié)果進(jìn)行內(nèi)外部驗(yàn)證與平衡。通過(guò)以上研究,本文證實(shí)了商州區(qū)征地區(qū)片綜合地價(jià)測(cè)算結(jié)果內(nèi)部合理性;并將測(cè)算結(jié)果與征地區(qū)片范圍外統(tǒng)一年產(chǎn)值補(bǔ)償標(biāo)準(zhǔn)進(jìn)行平衡分析,發(fā)現(xiàn)征地區(qū)綜合地價(jià)與統(tǒng)一年產(chǎn)值補(bǔ)償標(biāo)準(zhǔn)過(guò)渡和銜接較平穩(wěn),從而為下一輪商州區(qū)征地區(qū)片綜合地價(jià)的更新提供參考依據(jù),使其更具科學(xué)性、合理性。
[Abstract]:Over the years, the compensation standard for land requisition has been improved in the course of the comprehensive land price collection in China, which to a certain extent alleviates some problems existing in the land requisition in China, but in real life, In some areas, the compensation standard of land expropriation is still unreasonable, so it is of great practical significance to study the comprehensive land price in some areas. This study intends to solve the following main problems: 1. To determine reasonable compensation standards for land requisition, to improve the scientific standard of compensation for land requisition. 2 to establish and protect the legitimate rights and interests of farmers and to ensure that the living standards of landless farmers are improved. The comprehensive land price system of land expropriation, which does not reduce the quality of life, realizes the openness and justice of land expropriation, public participation and supervision, and the fairness of the same price and compensation standard in the process of land requisition. (4) to establish a harmonious and stable society and to promote the rapid development of economy, and to ensure the balance of land price between the land expropriation system and the mechanism of coordinated development of urban and rural areas. Avoid the occurrence of disparity of land price in adjacent areas. This paper expounds the present situation of the research on the standard of compensation for land expropriation at home and abroad, including the theory of acquired rights, the theory of special sacrifice, the theory of compensation for land expropriation, and the theory of compensation for land expropriation, including the theory of land rent and the theory of land price. On the basis of the theory of compensation standard for land expropriation such as the theory of land productivity, this paper analyzes the related concepts of integrated land price, expounds the principle, method and principle of drawing up the comprehensive land price of land expropriation area, and takes this as the starting point. In this paper, the area of Shangzhou district is divided, and the comprehensive land price is calculated by case comparison method and annual output value multiple method. Finally, the internal and external verification and balance of the calculation results are carried out. Through the above research, this paper confirms the internal rationality of the result of comprehensive land price calculation in Shangzhou District, and analyzes the balance between the calculation result and the unified annual output value compensation standard outside the area. It is found that the transition and connection between the comprehensive land price in the levy area and the unified annual output value compensation standard are relatively stable, thus providing a reference basis for the renewal of the comprehensive land price in the next round of Shangzhou district, making it more scientific and reasonable.
