【摘要】：轉(zhuǎn)軌經(jīng)濟國家的法制環(huán)境存在顯著的地區(qū)差異,這造成部分地區(qū)法律層面的強制性糾偏機制無法有效發(fā)揮約束上市公司盈余管理的作用,此時市場會派生出替代性糾偏機制來彌補法律保護不足的缺陷。以2009-2013年滬深兩市6266個觀察樣本為研究對象,實證研究了媒體監(jiān)督和法治水平對上市公司盈余管理的治理作用,檢驗了媒體監(jiān)督在薄弱的法治環(huán)境中發(fā)揮的替代效應(yīng),揭示了這種替代效應(yīng)在不同產(chǎn)權(quán)性質(zhì)情況下存在的差異。研究發(fā)現(xiàn):媒體監(jiān)督可以有效的制約上市公司盈余管理行為;法治水平的提高可以降低上市公司的盈余管理程度;媒體監(jiān)督是約束上市公司盈余管理有效的法律外替代機制,較強的媒體監(jiān)督可以有效的降低由于法治薄弱而誘發(fā)的盈余管理;基于產(chǎn)權(quán)性質(zhì)的探索性研究表明,相對于法治水平較高的地區(qū)而言,在法治水平較低的地區(qū)媒體監(jiān)督對國有企業(yè)盈余管理的約束力大于非國有企業(yè)。
[Abstract]:There are significant regional differences in the legal environment of countries in transition economy, which makes the mandatory correction mechanism in some areas unable to play an effective role in restraining earnings management of listed companies. At this time, the market will derive an alternative correction mechanism to remedy the shortcomings of inadequate legal protection. Take 6266 observation samples of Shanghai and Shenzhen stock markets from 2009-2013 as the research object. This paper empirically studies the governance effect of media supervision and the level of rule of law on earnings management of listed companies, and tests the substitution effect of media supervision in the weak legal environment. This paper reveals the differences of the substitution effect in different property rights. The results show that media supervision can effectively restrict the earnings management behavior of listed companies; The improvement of the level of rule of law can reduce the degree of earnings management of listed companies; Media supervision is an effective alternative mechanism to restrain earnings management of listed companies. Strong media supervision can effectively reduce earnings management induced by weak rule of law. The exploratory research based on the nature of property rights shows that the binding force of media supervision on earnings management of state-owned enterprises is greater than that of non-state-owned enterprises in areas where the level of rule of law is higher than that in areas where the level of rule of law is relatively high.
