錫林浩特市房屋征收中的國有土地使用權(quán)補(bǔ)償問題研究

【摘要】:隨著我國城市化、工業(yè)化進(jìn)程不斷加快與深化,舊城改造已成為城市化、工業(yè)化進(jìn)程中的一個(gè)重要表現(xiàn),城市房屋征收活動(dòng)成為城市化進(jìn)程中不可逾越的部分。大規(guī)模的舊城改造,項(xiàng)目集中,數(shù)量之多,使房屋征收問題成為關(guān)系社會(huì)穩(wěn)定與發(fā)展的焦點(diǎn)問題,其核心問題體現(xiàn)在補(bǔ)償方面。但由于我國現(xiàn)行的房屋征收補(bǔ)償制度存在著諸多問題,使得被征收人未能得到充分的補(bǔ)償。筆者認(rèn)為,要想妥善解決好房屋征收補(bǔ)償問題,就要明確房屋征收補(bǔ)償?shù)幕驹瓌t、具體范圍、確定標(biāo)準(zhǔn)等內(nèi)容,對(duì)城市房屋征收中土地增值利益進(jìn)行科學(xué)合理的分配,這對(duì)于建立一種合理有效的房屋征收補(bǔ)償制度起著基礎(chǔ)性作用。 首先,本文從闡述征收、房屋征收、公共利益、國有土地使用權(quán)的含義著手,分析了城市國有土地上房屋征收與補(bǔ)償?shù)膶?shí)質(zhì)即國有土地使用權(quán)的收回問題。通過實(shí)地考察,選取具體案例,分析了錫林浩特市房屋征收管理體制和制度實(shí)施的現(xiàn)狀,在此基礎(chǔ)上進(jìn)行案例分析,針對(duì)城市房屋征收補(bǔ)償中存在的問題探究房屋征收補(bǔ)償制度建設(shè)中的不足與缺位現(xiàn)象。其次,通過查閱大量文件文獻(xiàn)資料,結(jié)合《國有土地上房屋征收與補(bǔ)償條例》在錫林浩特地區(qū)的實(shí)施效果,提出房屋征收過程中國有土地使用權(quán)補(bǔ)償?shù)睦碚撘罁?jù)、事實(shí)依據(jù)等依據(jù)。從房屋征收補(bǔ)償原則、補(bǔ)償范圍、補(bǔ)償標(biāo)準(zhǔn)等方面入手,,分析征收補(bǔ)償活動(dòng)實(shí)施與執(zhí)行過程中存在的問題,厘清征收補(bǔ)償中房屋與土地的關(guān)系,尋求解決房屋征收補(bǔ)償活動(dòng)中合理補(bǔ)償、科學(xué)分配城市土地增值利益的途徑,探討緩解房屋征收補(bǔ)償中利益沖突的措施,提出構(gòu)建國有土地上房屋征收補(bǔ)償制度的設(shè)想與對(duì)策,進(jìn)而推進(jìn)城市建設(shè)健康發(fā)展,優(yōu)化城市土地利用結(jié)構(gòu),為城市房屋征收活動(dòng)提出改進(jìn)思路。
[Abstract]:With the urbanization of China, the process of industrialization has been accelerated and deepened, the transformation of the old city has become an important manifestation of urbanization, and the collection of urban housing has become an insurmountable part of the process of urbanization. The large-scale old city reconstruction, the project concentration, the quantity many, causes the housing collection question to become the social stability and the development focal point question, its core question manifests in the compensation aspect. However, there are many problems in the current housing expropriation compensation system in China, which makes the expropriated person unable to get adequate compensation. The author believes that in order to properly solve the problem of housing expropriation and compensation, it is necessary to clarify the basic principles, specific scope, determination of standards, and so on, so as to scientifically and reasonably distribute the land value-added benefits in urban housing expropriation. This plays a fundamental role in the establishment of a reasonable and effective housing collection and compensation system. First of all, this paper begins with the meaning of expropriation, housing expropriation, public interest and the right to use state-owned land, and analyzes the essence of the expropriation and compensation of houses on urban state-owned land, that is, the recovery of the right to use state-owned land. Through the field investigation, selected specific cases, analyzed the current situation of the housing collection management system and system implementation in Xilinhaote, on the basis of this case analysis, In view of the problems existing in the collection and compensation of urban housing, this paper probes into the deficiency and absence in the construction of the compensation system for the collection and compensation of housing. Secondly, through consulting a large number of documents and materials, combining with the implementation effect of the regulations on Housing expropriation and compensation on State-owned Land in Xilinhot area, the paper puts forward the theoretical basis for the compensation of the right to use state-owned land in the course of house expropriation. A factual basis, etc. From the aspects of the principle, scope and standard of compensation, this paper analyzes the problems existing in the implementation and implementation of the expropriation and compensation activities, and clarifies the relationship between housing and land in the process of expropriation and compensation. In order to solve the problem of reasonable compensation in housing expropriation and compensation activities, to scientifically distribute the value-added benefits of urban land, to explore the measures to alleviate the conflicts of interest in housing expropriation and compensation, and to put forward some tentative ideas and countermeasures to construct the compensation system for housing expropriation on state-owned land. Furthermore, it promotes the healthy development of urban construction, optimizes the structure of urban land use, and puts forward some improvement ideas for the collection of urban houses.
