【摘要】：改革開放三十年以來(lái)，我國(guó)的經(jīng)濟(jì)結(jié)構(gòu)和社會(huì)結(jié)構(gòu)已經(jīng)發(fā)生了重大的變化，隨著我國(guó)經(jīng)濟(jì)實(shí)力的不斷增強(qiáng)，人民生活水平的日益提高，國(guó)家及人民群眾對(duì)產(chǎn)品質(zhì)量的關(guān)注已經(jīng)到了新的高度，而質(zhì)監(jiān)部門作為產(chǎn)品質(zhì)量監(jiān)管的主要職能部門之一，對(duì)產(chǎn)品質(zhì)量監(jiān)管的主要措施有實(shí)行行政許可市場(chǎng)準(zhǔn)入和證后監(jiān)督、實(shí)施產(chǎn)品質(zhì)量監(jiān)督抽查、打擊假冒偽劣活動(dòng)、提升質(zhì)量管理水平、推進(jìn)標(biāo)準(zhǔn)化戰(zhàn)略實(shí)施等等，其中行政許可作為產(chǎn)品質(zhì)量監(jiān)管的重要手段之一，在工業(yè)產(chǎn)品安全監(jiān)管、食品安全監(jiān)管、特種設(shè)備安全監(jiān)管、計(jì)量器具質(zhì)量監(jiān)管許可等方面都占有主要地位。但是從近年廣東省食品安全狀況、產(chǎn)品質(zhì)量監(jiān)督抽查狀況、特種設(shè)備安全形勢(shì)狀況的數(shù)據(jù)來(lái)看，產(chǎn)品質(zhì)量仍存在著不可回避的問(wèn)題，例如食品中添加非法原料，部分企業(yè)質(zhì)量意識(shí)不高、偷工減料，特種設(shè)備維保單位違規(guī)操作等，這為產(chǎn)品質(zhì)量監(jiān)管帶來(lái)沉重的壓力，因此有必要再次審視當(dāng)前行政許可制度是否存在監(jiān)管漏洞，該從哪些方面進(jìn)行改進(jìn)。 全文分為五個(gè)部分，第一部分為緒論，簡(jiǎn)述了問(wèn)題提出的背景、意義，對(duì)國(guó)內(nèi)外研究人員對(duì)產(chǎn)品質(zhì)量監(jiān)管的理論觀點(diǎn)進(jìn)行梳理，為后文的分析提供理論依據(jù)；第二部分是介紹行政許可的主要概念以及廣東省質(zhì)監(jiān)局行政許可的分類及特點(diǎn)。第三部分對(duì)廣東省質(zhì)監(jiān)局行政許可工作的現(xiàn)狀分析，按照行政許可工作的特點(diǎn)，進(jìn)行兩段式的研究，首先通過(guò)對(duì)行政許可前，，即行政許可審查進(jìn)行分析，發(fā)掘出影響審查合格率的產(chǎn)業(yè)集群?jiǎn)栴}、審查過(guò)于細(xì)節(jié)化問(wèn)題；然后對(duì)行政許可后，即對(duì)證后監(jiān)管進(jìn)行分析，指出證后監(jiān)督中年檢形同虛設(shè)、監(jiān)督抽查效率低問(wèn)題；第四部分通過(guò)文獻(xiàn)研究，對(duì)國(guó)內(nèi)外質(zhì)量管理部門的經(jīng)驗(yàn)采取借鑒；第五部分結(jié)合國(guó)內(nèi)外經(jīng)驗(yàn)，融合國(guó)內(nèi)的實(shí)際情況，提出完善廣東省質(zhì)監(jiān)局行政許可工作、提高行政許可工作有效性的對(duì)策，一是從審查條件、審查程序、責(zé)任追究三方面進(jìn)行制度設(shè)計(jì)來(lái)實(shí)現(xiàn)提高審查合格率，二是提出年檢制度改革和“生產(chǎn)者——銷售者——消費(fèi)者”共同體管理模式的設(shè)計(jì)來(lái)實(shí)現(xiàn)證后監(jiān)管的目標(biāo)。第六部分對(duì)本文作出總結(jié)，并提出下一步待解決的問(wèn)題。
[Abstract]:Since the reform and opening up three decades ago, great changes have taken place in the economic and social structure of our country. With the increasing economic strength of our country, the living standards of the people are improving day by day. The state and the people have reached a new level of concern for product quality. As one of the main functional departments of product quality supervision, the quality supervision departments have carried out administrative licensing, market access and post-certification supervision as the main measures for product quality supervision. Implement product quality supervision and spot check, crack down on fake and shoddy activities, improve the quality management level, promote the implementation of the standardized strategy, etc. Among these, administrative licenses, as one of the important means of product quality supervision, are used in industrial product safety supervision. Food safety supervision, special equipment safety supervision, measuring instruments quality regulatory permission are the main position. However, judging from the data on the food safety situation in Guangdong Province in recent years, the situation of product quality supervision and spot check, and the safety situation of special equipment, there are still unavoidable problems in product quality, such as the addition of illegal raw materials to food. Some enterprises have low quality consciousness, jerry-building, illegal operation of special equipment maintenance and protection units, and so on, which bring heavy pressure to product quality supervision. Therefore, it is necessary to re-examine whether the current administrative license system has any regulatory loopholes. Where to improve? The paper is divided into five parts. The first part is the introduction, briefly introduces the background and significance of the question, combs the theoretical views of domestic and foreign researchers on product quality supervision, and provides the theoretical basis for the following analysis; The second part introduces the main concepts of the administrative license and the classification and characteristics of the administrative license of Guangdong quality Supervision Bureau. The third part analyzes the current situation of the administrative license work of Guangdong Provincial quality Supervision Bureau. According to the characteristics of the administrative license work, it carries out a two-paragraph study. First of all, it analyzes the administrative license before, that is, the administrative license examination. Find out the problem of industrial cluster which affects the qualified rate of examination, examine the problem of too detailed, and then analyze the administrative license, that is, the supervision after the certificate, point out that the annual inspection in the post-certificate supervision is empty, and the efficiency of the supervision spot check is low; The fourth part through the literature research, takes the domestic and foreign quality management department experience to use for reference; the fifth part unifies the domestic and foreign experience, the fusion domestic actual situation, proposed consummates the Guangdong quality supervision bureau administrative license work, The countermeasures to improve the effectiveness of administrative licensing work are: first, to design the system from three aspects of examination condition, review procedure and accountability to improve the qualification rate of examination, The second is to put forward the reform of annual inspection system and the design of "producer-seller-consumer" community management model to achieve the goal of post-certificate supervision. The sixth part summarizes this paper and puts forward the problems to be solved next.
