【摘要】：PPP是公共部門和私營(yíng)部門為基礎(chǔ)設(shè)施和公用事業(yè)而達(dá)成的長(zhǎng)期合作關(guān)系,本質(zhì)是公共服務(wù)供給與公共治理新方式。各國(guó)均是結(jié)合自身實(shí)際開展PPP立法和實(shí)踐,并不存在靜態(tài)的最佳實(shí)踐。本文著重分析了PPP的基本概念、與特許經(jīng)營(yíng)關(guān)系、適用范圍、法律屬性及實(shí)踐操作中的部分熱點(diǎn)問題,以揭示PPP在立法進(jìn)程中的困惑、爭(zhēng)論及其未解之題。
[Abstract]:PPP is a long-term cooperative relationship between the public sector and the private sector for infrastructure and public utilities, which is essentially a new mode of public service supply and public governance. All countries carry out PPP legislation and practice in combination with their own practice, and there is no static best practice. This paper analyzes the basic concept of PPP, the relationship with franchise, the scope of application, the legal attributes and some hot issues in practice, in order to reveal the confusion, controversy and unsolved problems of PPP in the legislative process.
