【摘要】：20世紀(jì)80年代初,國務(wù)院在相關(guān)法律法規(guī)中首次提出了招標(biāo)與投標(biāo)的概念,自此我國的招投標(biāo)事業(yè)得到了迅速發(fā)展。但是,也存在不少問題,如“圍標(biāo)、串標(biāo)”等行為多年來未能得到有效遏制,嚴(yán)重違背了市場誠信原則、嚴(yán)重干擾了招投標(biāo)行業(yè)的公平競爭秩序。為了防治招投標(biāo)中的腐敗問題,減少招投標(biāo)領(lǐng)域人為因素的影響,同時(shí)隨著計(jì)算機(jī)及電子通信技術(shù)的發(fā)展,國家有關(guān)部門、各地招投標(biāo)監(jiān)管等部門正在積極探索并推動(dòng)電子招投標(biāo)的建設(shè)和發(fā)展。在此背景下,對(duì)建設(shè)工程電子招投標(biāo)及圍串標(biāo)行為進(jìn)行研究就具有很強(qiáng)的理論意義與實(shí)踐需求。既是對(duì)政府建設(shè)工程圍串標(biāo)行為的梳理和探討,也能為電子招投標(biāo)的實(shí)踐運(yùn)用提供一定參考價(jià)值。本文擬在分析國內(nèi)外招標(biāo)投標(biāo)理論和方法的基礎(chǔ)上,針對(duì)我國建設(shè)工程領(lǐng)域招投標(biāo)活動(dòng)中存在的圍標(biāo)串標(biāo)行為,以電子招投標(biāo)的角度為基點(diǎn),從電子招投標(biāo)的發(fā)展現(xiàn)狀、內(nèi)涵和實(shí)質(zhì)、圍標(biāo)串標(biāo)行為在招投標(biāo)實(shí)踐中的表現(xiàn)入手,探討電子招投標(biāo)與防治圍標(biāo)串標(biāo)行為的關(guān)系,擬解決運(yùn)用電子招投標(biāo)手段防治圍標(biāo)串標(biāo)行為的具體方式、治理功效以及應(yīng)采取的保障措施等問題,力求客觀分析電子招投標(biāo)在防治圍串標(biāo)活動(dòng)中發(fā)揮的效用和存在的現(xiàn)實(shí)不足。這對(duì)建設(shè)工程及其他領(lǐng)域在防治“圍標(biāo)串標(biāo)”行為方面具有一定的參考價(jià)值。
[Abstract]:In the early 1980s, the State Council put forward the concept of bidding and bidding for the first time in the relevant laws and regulations. Since then, the cause of bidding and bidding in China has developed rapidly. However, there are also many problems, such as the behavior of "girdling, string bidding" has not been effectively contained for many years, which seriously violates the principle of market integrity and seriously interferes with the fair competition order of bidding industry. In order to prevent and control corruption in bidding and to reduce the impact of human factors in the bidding field, and with the development of computer and electronic communication technology, the relevant state departments, Local departments and other departments are actively exploring and promoting the construction and development of electronic bidding. Under this background, it is of great theoretical significance and practical demand to study the behavior of electronic bidding and girdling bidding in construction engineering. It not only combs and discusses the behavior of the government construction project, but also provides some reference value for the practice of electronic bidding. Based on the analysis of the theories and methods of bidding at home and abroad, this paper aims at the behavior of girdling bidding in the field of construction engineering in China, taking the electronic bidding as the basic point of view, and taking the present situation of the development of electronic bidding and bidding as the basis point. The intension and essence, the performance of the girdling bidding behavior in the bidding practice, the relationship between the electronic bidding and the prevention of the girth bidding behavior are discussed, and the concrete ways of using the electronic bidding method to prevent the girth bidding behavior are discussed. This paper tries to analyze objectively the effectiveness of electronic bidding in the prevention and treatment of girth bidding and the practical deficiency of the existing problems such as the effect of governance and the safeguard measures to be taken. It has certain reference value for construction engineering and other fields in preventing and curing the behavior of "surrounding mark string marking".
