【摘要】:近年來(lái),我國(guó)大力推進(jìn)保障性住房建設(shè),地方政府為減少公共財(cái)政壓力,開(kāi)始在住房保障中引入市場(chǎng)機(jī)制,應(yīng)用配建模式,即要求開(kāi)發(fā)商在商品房項(xiàng)目中配建一定比例的保障性住房。在核心要求和做法上與配建模式相似的美國(guó)包容性住房常被國(guó)內(nèi)研究引用,做為學(xué)習(xí)對(duì)象,但關(guān)于包容性住房的具體實(shí)踐和其在美國(guó)背景下受到的保障機(jī)制的研究尚有深入空間,針對(duì)這些內(nèi)容進(jìn)行研究有利于理解包容性住房在美國(guó)成功的原因,進(jìn)一步思考其中哪些內(nèi)容可以學(xué)習(xí)借鑒。本文以解析包容性住房的實(shí)踐案例及運(yùn)作中的保障機(jī)制作為研究目的。本文主要研究?jī)?nèi)容界定為包容性住房自身內(nèi)容與外在的保障機(jī)制,通過(guò)文獻(xiàn)和案例的分析歸納法進(jìn)行研究。其內(nèi)容包括:首先整體梳理美國(guó)包容性住房的相關(guān)概念、產(chǎn)生背景和發(fā)展歷程,探討其法律制度基礎(chǔ)與執(zhí)行機(jī)構(gòu),作為基礎(chǔ)研究。然后根據(jù)包容性住房的強(qiáng)制性或自愿性的管制性質(zhì)、基于區(qū)劃或基于條例的管制形式劃分其類型,選取有代表性的案例詳細(xì)分析,包括對(duì)包容性住房的規(guī)劃項(xiàng)目或條例、相關(guān)法律及政策、實(shí)施環(huán)節(jié)的措施的深入剖析,對(duì)比總結(jié)出包容性住房涵蓋的六項(xiàng)主要內(nèi)容。最后在此基礎(chǔ)上分析包容性住房涉及的規(guī)劃、實(shí)施和法制的關(guān)系及三者對(duì)各項(xiàng)內(nèi)容的支持和保障,構(gòu)成包容性住房的完整保障機(jī)制,在分析該保障機(jī)制如何使包容性住房順應(yīng)市場(chǎng)規(guī)則,充分利用自由市場(chǎng)經(jīng)濟(jì)中的市場(chǎng)動(dòng)力時(shí),本研究發(fā)現(xiàn)了該機(jī)制內(nèi)含的兩條線索,即在美國(guó)法制背景下由法律授權(quán)的公權(quán)和受法律保障的私權(quán)分別影響包容性住房的規(guī)劃編制和實(shí)施策略,最終達(dá)成平衡一致的目標(biāo),使包容性住房生效。本文研究結(jié)果較為清晰地總結(jié)出了包容性住房的保障機(jī)制,并明確了該機(jī)制在規(guī)劃、實(shí)施和法制三個(gè)層面對(duì)包容性住房六項(xiàng)主要內(nèi)容的保障方式,分析了該機(jī)制使包容性住房立足美國(guó)的自由市場(chǎng)經(jīng)濟(jì)制度和法制背景中不斷發(fā)展并取得成效的原因。該結(jié)果亦可對(duì)國(guó)內(nèi)“學(xué)習(xí)國(guó)外經(jīng)驗(yàn)完善配建模式”的相關(guān)研究做出一定支持,間接為我國(guó)保障性住房建設(shè)做出貢獻(xiàn)。
[Abstract]:In recent years, our country has vigorously promoted the construction of affordable housing. In order to reduce the pressure of public finance, local governments began to introduce market mechanisms into housing security and apply the construction model. That is, developers in commercial housing projects to build a certain proportion of affordable housing. Inclusive housing in the United States, which is similar to the building model in core requirements and practices, is often cited in domestic research as a learning object. But there is still room for further research on the specific practices of inclusive housing and the safeguards it receives in the context of the United States, and research on these elements will help to understand the reasons for the success of inclusive housing in the United States. Further thinking about what can be learned from the content. The purpose of this paper is to analyze the practical cases of inclusive housing and the security mechanism in operation. The main content of this paper is defined as inclusive housing content and external security mechanism, through literature and case analysis induction method to study. The contents include: firstly, the related concepts of inclusive housing in the United States, the background and development process, and the legal system foundation and enforcement agency are discussed as the basic research. Then, according to the mandatory or voluntary regulatory nature of inclusive housing, the type of regulation is based on zoning or regulation-based forms of regulation, and representative case studies are selected, including planning projects or regulations for inclusive housing, Related laws and policies, the implementation of measures in-depth analysis, summed up the inclusive housing covers six main contents. Finally, based on the analysis of the relationship between planning, implementation and legal system of inclusive housing, and the support and security of the three elements, it constitutes a complete security mechanism of inclusive housing. In analyzing how the mechanism can make inclusive housing conform to the market rules and make full use of the market dynamics in the free market economy, this study finds two clues in the mechanism. That is, under the background of American legal system, the public right authorized by law and the private right protected by law respectively affect the planning and implementation strategy of inclusive housing, and finally reach the goal of balance and consensus, and make inclusive housing effective. The research results of this paper clearly sum up the security mechanism of inclusive housing, and clarify how the mechanism guarantees the six main contents of inclusive housing at the three levels of planning, implementation and legal system. This paper analyzes the reasons why the mechanism makes inclusive housing based on the free market economic system and legal system of the United States. The results can also provide some support for the study of "learning from foreign experiences and perfecting the construction model", and contribute indirectly to the construction of affordable housing in China.
