勞動關(guān)系協(xié)調(diào)機制中政府推動工會工作的探討

【摘要】:中國的社會主義制度以及經(jīng)濟制度,決定了政府在社會的政治生活、經(jīng)濟生活中的重要地位,作為群眾團體的工會與政府的關(guān)系從來不是西方國家那樣互相平等和獨立的關(guān)系。與西方國家工會發(fā)展路徑不同,在中華人民共和國建國后,我國工會始終是在政府的支持下壯大與發(fā)展的。社會轉(zhuǎn)型時期勞動關(guān)系的復(fù)雜性、多樣性,勞資沖突的激烈需要更多的協(xié)調(diào)機制。在我國現(xiàn)有勞動立法未能突破個別勞動關(guān)系調(diào)整的局限性、集體勞動關(guān)系調(diào)整模式尚未成熟樣態(tài)下,工會工作仍需要政府的推動,需要國家利用公共權(quán)力與公共資源加強立法,推動工會的組建,推動集體協(xié)商制度,推動工會在協(xié)調(diào)勞動關(guān)系機制中發(fā)揮更重要的作用。
[Abstract]:China's socialist system and economic system determine the important position of the government in the political and economic life of the society. As a mass organization, the relationship between the trade union and the government has never been equal and independent in the western countries. After the founding of the people's Republic of China, China's trade unions have always grown and developed with the support of the government. In the period of social transformation, the complexity and diversity of labor relations and the fierce conflicts between labor and capital need more coordination mechanisms. With the existing labor legislation of our country failing to break through the limitations of the adjustment of individual labor relations and the immature mode of collective labor relations adjustment, the work of trade unions still needs the promotion of the government, and the country needs to use public power and public resources to strengthen the legislation. Promote the formation of trade unions, promote collective consultation system, and promote trade unions to play a more important role in the coordination of labor relations mechanism.
