【摘要】：招標(biāo)投標(biāo)制度是我國(guó)建設(shè)領(lǐng)域的一項(xiàng)基本制度,對(duì)提高建設(shè)項(xiàng)目投資效益、規(guī)范建設(shè)項(xiàng)目交易行為具有重要作用。然而,在我國(guó)建設(shè)工程招標(biāo)投標(biāo)實(shí)踐中仍然存在諸多問題,如圍標(biāo)、串標(biāo)、暗箱操作、不能選擇到滿意的中標(biāo)人等等,這些問題使得行業(yè)里很多專業(yè)人士對(duì)招投標(biāo)制度的必要性及價(jià)值產(chǎn)生負(fù)面認(rèn)知。招投標(biāo)制度在中國(guó)為何會(huì)出現(xiàn)這些問題?伴隨著我國(guó)不斷推進(jìn)的社會(huì)經(jīng)濟(jì)體制改革,招投標(biāo)制度應(yīng)當(dāng)如何改革?對(duì)這些問題的研究具有理論和實(shí)踐意義。本文通過文獻(xiàn)研究梳理了目前我國(guó)建設(shè)領(lǐng)域招標(biāo)投標(biāo)活動(dòng)中存在的主要問題,通過對(duì)招標(biāo)投標(biāo)制度本質(zhì)的研究,提出了存在這些問題的原因之一是招投標(biāo)“控權(quán)”職能與“擇優(yōu)”職能沖突和矛盾。當(dāng)前我國(guó)基于反腐的需要強(qiáng)調(diào)招投標(biāo)中的“控權(quán)”職能,但卻一定程度上弱化了招投標(biāo)的“擇優(yōu)”職能。針對(duì)問題產(chǎn)生的原因,結(jié)合目前我國(guó)的整體市場(chǎng)環(huán)境,可以認(rèn)為招標(biāo)投標(biāo)制度的改革勢(shì)在必行,同時(shí)提出了招標(biāo)投標(biāo)制度改革的總體思路:“控權(quán)”與“擇優(yōu)”的平衡。對(duì)于“控權(quán)”過度的現(xiàn)狀,提出了取消邀請(qǐng)招標(biāo)限制條件、取消投標(biāo)人踏勘現(xiàn)場(chǎng)限制條件、取消招標(biāo)人確定中標(biāo)候選人相關(guān)規(guī)定以及取消招標(biāo)人對(duì)于評(píng)標(biāo)委員會(huì)成員選取方式的規(guī)定,歸還業(yè)主部分權(quán)利。對(duì)于“擇優(yōu)”不足的現(xiàn)狀,在權(quán)利回歸的基礎(chǔ)上,還提出科學(xué)使用分類標(biāo)準(zhǔn)文本、進(jìn)行評(píng)標(biāo)委員會(huì)及評(píng)標(biāo)專家的深層次改革以及科學(xué)使用評(píng)標(biāo)方法等建議。在對(duì)招標(biāo)投標(biāo)制度本身進(jìn)行改革之外,要使建設(shè)工程招標(biāo)投標(biāo)制度改革順利進(jìn)行,還需要對(duì)其相關(guān)配套制度進(jìn)行改進(jìn),主要包括完善立法與監(jiān)督機(jī)制、改善建筑行業(yè)產(chǎn)業(yè)結(jié)構(gòu)以及對(duì)于招標(biāo)代理制度的改革。所以建設(shè)工程招標(biāo)投標(biāo)制度的改革,需要招標(biāo)投標(biāo)制度改革以及相關(guān)配套制度改進(jìn)共同進(jìn)行、相輔相成。本文的研究成果對(duì)建設(shè)工程招標(biāo)投標(biāo)制度未來的發(fā)展方向具有重要的參考價(jià)值。
[Abstract]:Bidding system is a basic system in the field of construction in our country. It plays an important role in improving the investment benefit of construction project and standardizing the transaction behavior of construction project.However, there are still many problems in the practice of bidding for construction projects in our country, such as the surrounding bid, the string bidding, the dark box operation, the inability to select a satisfactory successful bidder, and so on.These problems make many professionals in the industry have a negative understanding of the necessity and value of bidding system.Why are these problems in the bidding system in China?With the social and economic system reform, how should the bidding system be reformed?The study of these problems has theoretical and practical significance.This paper combs the main problems existing in the bidding and bidding activities in the construction field of our country through the literature research, through the research on the essence of the bidding system,One of the reasons for these problems is the conflict and contradiction between the function of controlling the right to bid and the function of selecting the best.At present, our country emphasizes the function of "controlling right" in bidding based on the need of anti-corruption, but to some extent weakens the function of "selecting the best" in bidding.In view of the causes of the problems, combined with the overall market environment in our country at present, it can be considered that the reform of the bidding system is imperative. At the same time, the general idea of the reform of the tendering and bidding system is put forward: the balance between "controlling the right" and "choosing the best".With regard to the present situation of excessive "control of the right", it is proposed to cancel the restriction on inviting tenders and cancel the restrictions on the site of the bidders' inspection.Cancel the relevant provisions of the tenderer to determine the successful bid candidate and cancel the provisions of the tenderer on the selection of the members of the bid evaluation committee and return part of the owner's rights.On the basis of the return of the right, the author puts forward some suggestions such as the scientific use of the standard text of classification, the deep reform of the bid evaluation committee and the evaluation experts, and the scientific use of the bid evaluation method.In addition to the reform of the tendering and bidding system itself, in order to make the reform of the tendering and bidding system of construction projects go on smoothly, it is also necessary to improve the relevant supporting systems, mainly including perfecting the legislation and supervision mechanism.To improve the industrial structure of the construction industry and the reform of the bidding agency system.Therefore, the reform of tendering and bidding system of construction project needs the reform of bidding system and the improvement of relevant supporting system, which is complementary to each other.The research results of this paper have important reference value for the future development direction of construction project bidding system.
