【摘要】：作為推行公私合作制(PPP)的后發(fā)國家,德國雖只是步英美之后塵,但在PPP的概念界定和實踐發(fā)展方面仍做出了巨大貢獻(xiàn),其針對PPP所做的法理基礎(chǔ)梳理和具體制度構(gòu)造都富有建設(shè)意義。依托擔(dān)保國家的構(gòu)想,創(chuàng)造性地提出國家責(zé)任分擔(dān)和責(zé)任層級的理論,從政治層面解決了PPP發(fā)展的桎梏和障礙。盡管德國引入PPP的最初動機(jī)只是為了緩解財政困境,但其在PPP發(fā)展過程中所呈現(xiàn)出的治理思想的革新與飛躍,尤其是為PPP立法方面進(jìn)行的嘗試和努力,都能夠為我國重新思考政府與民間的合作伙伴關(guān)系提供示范性的參照和借鑒。
[Abstract]:As a latecomer country implementing PPPs, Germany has made great contributions to the definition of PPP and the development of its practice, although it is just following the British and the US. The legal basis and the specific system structure of PPP are of great significance. Based on the conception of the guarantee country, the author creatively puts forward the theory of the sharing of national responsibility and the level of responsibility. Although the original motive of introducing PPP in Germany was only to alleviate the financial difficulties, the innovation and leap of governance thought presented in the development of PPP. Especially, the attempts and efforts made for the legislation of PPP can provide an exemplary reference and reference for our country to rethink the partnership between government and civil society.
