【摘要】：在梳理經(jīng)濟(jì)學(xué)、公共管理學(xué)與法學(xué)領(lǐng)域關(guān)于強(qiáng)制性標(biāo)準(zhǔn)的理論研究文獻(xiàn)的基礎(chǔ)上,結(jié)合中國強(qiáng)制性標(biāo)準(zhǔn)體系的現(xiàn)狀和問題,重新界定強(qiáng)制性標(biāo)準(zhǔn)的定義,明確強(qiáng)制性標(biāo)準(zhǔn)的目標(biāo)是維護(hù)公共秩序,保障公共利益;其制定基于科學(xué)、技術(shù)知識和客觀經(jīng)驗(yàn),主要體現(xiàn)為技術(shù)內(nèi)容;具有強(qiáng)制執(zhí)行效力,國家在強(qiáng)制性標(biāo)準(zhǔn)的治理中發(fā)揮主導(dǎo)作用;其愿景在于明確強(qiáng)制性標(biāo)準(zhǔn)應(yīng)有的法律地位與性質(zhì),支撐中國統(tǒng)一市場體系建設(shè)。
[Abstract]:On the basis of combing the theoretical research literature on mandatory standards in the fields of economics, public management and law, and combining the current situation and problems of China's mandatory standards system, we redefine the definition of mandatory standards. It is clear that the objective of mandatory standards is to maintain public order and safeguard the public interest; its formulation is based on scientific, technical knowledge and objective experience, which is mainly embodied in technical content; it has enforcement effect, The state plays a leading role in the governance of mandatory standards, and its vision lies in clarifying the legal status and nature of mandatory standards and supporting the construction of China's unified market system.
