【摘要】：人民防空工程是一項重要的人防戰(zhàn)備設(shè)施,對提升人民防空襲斗爭的能力具有十分重要的作用。隨著市場化改革的深入推進(jìn),我國人民防空工程建設(shè)政策體系已經(jīng)不適應(yīng)需求,在新的形勢下,充分發(fā)揮市場在人防工程資源配置中的作用、引導(dǎo)和規(guī)范社會資金投資人防工程、更好地發(fā)揮人防工程整體效益等都對人防工程產(chǎn)權(quán)制度改革提出了現(xiàn)實要求。為此,理論和實踐中都對人防工程產(chǎn)權(quán)制度改革進(jìn)行了深入探索。改革的實施提高了人防工程的總體建設(shè)水平,產(chǎn)生了良好效益,但也存在諸多不足,有深化改革的必要。同時,全國人防工程產(chǎn)權(quán)制度改革缺少系統(tǒng)性和規(guī)范性,尚未形成標(biāo)準(zhǔn)改革模型和實現(xiàn)途徑。本文通過對Y市人防工程產(chǎn)權(quán)制度改革的實證研究,形成了人防工程產(chǎn)權(quán)制度改革經(jīng)驗,探索了適用于全國人防工程體系的產(chǎn)權(quán)制度改革模型,明確了政策制定和執(zhí)行中的重要內(nèi)容并形成了措施方法,對深化Y市人防工程產(chǎn)權(quán)制度改革提出了自己的見解,對開展全國性的人防工程產(chǎn)權(quán)制度改革提出了建議。另外,本文有力檢驗和豐富現(xiàn)有人防工程產(chǎn)權(quán)制度改革理論體系。在研究框架上,首先梳理了Y市人防工程產(chǎn)權(quán)制度改革方案的政策體系,并結(jié)合現(xiàn)有理論進(jìn)行了初步分析。然后,從總體效果和產(chǎn)權(quán)效益兩個方面匯總了產(chǎn)權(quán)制度改革后Y市人防工程建設(shè)的成果,并進(jìn)行了定性分析、定量分析和相關(guān)性分析,形成了土地使用權(quán)獲取等在產(chǎn)權(quán)制度改革中的一些關(guān)鍵性的問題。之后,以關(guān)鍵性問題為切入點,深入研究了Y市人防工程產(chǎn)權(quán)制度改革的經(jīng)驗和不足,并探索了深化改革的措施。最后,在前文分析結(jié)論的基礎(chǔ)上,對深化我國人防工程產(chǎn)權(quán)制度改革提出建議。由于人防建設(shè)的特性,國外相關(guān)可以借鑒的資料也很少,為了深入研究、取得有意義的結(jié)論,本文注重研究創(chuàng)新。在研究方法創(chuàng)新方面：一是研究視角上,從有利于人防工程整體建設(shè)效果的角度出發(fā),先明確人防工程所有權(quán)歸屬,進(jìn)而研究了相關(guān)實現(xiàn)細(xì)節(jié)。二是在研究對象的梳理上,將人防產(chǎn)權(quán)制度改革分解為所有權(quán)歸屬和國有產(chǎn)權(quán)分離兩個相互獨立而又相互聯(lián)系的內(nèi)容,針對改革現(xiàn)狀,將研究對象明確為所有權(quán)歸屬改革。三是定性分析中借助現(xiàn)有工具。為了闡述人防工程民營化的經(jīng)濟(jì)效益,借助了物權(quán)法的概念,通過梳理分析了人防工程產(chǎn)權(quán)制度改革可以增加的物權(quán)內(nèi)容,然后分析了增加物權(quán)的經(jīng)濟(jì)價值,從而使研究更體系化。四是在定量分析上,在反應(yīng)人防工程總體建設(shè)狀況及產(chǎn)權(quán)改革狀況的數(shù)據(jù)選取、數(shù)據(jù)的相關(guān)性分析上、對數(shù)據(jù)內(nèi)容的比較利用上,都進(jìn)行了創(chuàng)新性的探索。在結(jié)論創(chuàng)新方面：一是以是否可經(jīng)營和是否具有經(jīng)營效益劃分人防工程投資范圍,不可經(jīng)營的必須由國家投資建設(shè),可經(jīng)營且具有良好經(jīng)濟(jì)效益的必須由社會投資建設(shè),可經(jīng)營但經(jīng)營效益差的可以由國家或社會投資,社會具有建設(shè)的優(yōu)先權(quán)。二是在產(chǎn)權(quán)歸屬上,產(chǎn)權(quán)歸投資者所有,國有可經(jīng)營人防工程可以通過正常的市場交易實現(xiàn)民營。三是在土地使用權(quán)的獲取上,對不同類型的人防工程設(shè)定了不同的土地使用權(quán)獲取方式和土地使用證辦理方式。四是針對人防工程特性,對人防工程產(chǎn)權(quán)設(shè)定特殊的權(quán)力義務(wù)。五是在體系構(gòu)建上,將人防工程產(chǎn)權(quán)制度改革與人防工程建設(shè)主體責(zé)任的調(diào)整、人防工程易地建設(shè)費的改革結(jié)合在一起。
