【摘要】:勞動(dòng)關(guān)系是最基本的社會(huì)生產(chǎn)關(guān)系,勞動(dòng)關(guān)系的存在與發(fā)展情況,既關(guān)系著個(gè)體勞動(dòng)者與用人單位的直接利益,同時(shí)更關(guān)系著勞動(dòng)者的家庭發(fā)展,關(guān)系到社會(huì)經(jīng)濟(jì)發(fā)展,因此和諧勞動(dòng)關(guān)系既是建設(shè)社會(huì)主義和諧社會(huì)的重要組成部分,也是實(shí)現(xiàn)社會(huì)和諧穩(wěn)定的必要條件。在我國(guó)經(jīng)濟(jì)體制改革過(guò)程中,用人單位形式、用工形式、用人單位與勞動(dòng)者之間的關(guān)系發(fā)生了巨大改變,勞動(dòng)關(guān)系也呈現(xiàn)出新的特點(diǎn),同時(shí)不可忽視的是,我國(guó)現(xiàn)有的勞動(dòng)關(guān)系面臨著就業(yè)形勢(shì)嚴(yán)峻、資強(qiáng)勞弱、勞動(dòng)者工資收入分配不公平、收入差距不斷擴(kuò)大、勞動(dòng)者合法權(quán)益保護(hù)不充分等諸多問(wèn)題,逐漸進(jìn)入了矛盾的易發(fā)期和多發(fā)期,直接影響了社會(huì)公平正義的實(shí)現(xiàn),影響了社會(huì)的發(fā)展與和諧穩(wěn)定。究其原因包括了法律制度體系、價(jià)值導(dǎo)向、利益分配、協(xié)調(diào)機(jī)制、監(jiān)察監(jiān)管、爭(zhēng)議處理等多方面的原因。要解決勞動(dòng)關(guān)系中的現(xiàn)實(shí)問(wèn)題,構(gòu)建我國(guó)和諧勞動(dòng)關(guān)系,需要包括各類(lèi)用人單位、勞動(dòng)者、各種社會(huì)團(tuán)體、組織甚至是每一名公民的共同努力,這一過(guò)程中更離不開(kāi)政府職能的正確有效發(fā)揮。從不同層面劃分,勞動(dòng)關(guān)系有著不同的含義,本文重點(diǎn)在于探討最狹義的勞動(dòng)關(guān)系,即勞動(dòng)者與用人單位因生產(chǎn)、勞動(dòng)而產(chǎn)生的權(quán)利義務(wù)關(guān)系,以及在狹義勞動(dòng)關(guān)系中,政府為實(shí)現(xiàn)“和諧”而應(yīng)當(dāng)承擔(dān)的職責(zé)。作為勞動(dòng)關(guān)系中的第三方主體,政府應(yīng)當(dāng)明確和諧勞動(dòng)關(guān)系的標(biāo)準(zhǔn),充分認(rèn)識(shí)構(gòu)建和諧勞動(dòng)關(guān)系的現(xiàn)實(shí)意義,并在準(zhǔn)確定位、轉(zhuǎn)變職能、自我完善的基礎(chǔ)上,用好“看不見(jiàn)的手”和“看得見(jiàn)的手”,處理好企業(yè)、市場(chǎng)與政府的關(guān)系,充分發(fā)揮自身在和諧勞動(dòng)關(guān)系構(gòu)建過(guò)程中的培育作用和規(guī)制職能,既遵循勞動(dòng)市場(chǎng)規(guī)律,尊重用人單位生產(chǎn)經(jīng)營(yíng)與內(nèi)部管理的自主權(quán),又能夠?qū)趧?dòng)關(guān)系給予必要而適度的干預(yù)和調(diào)整,有效協(xié)調(diào)利益關(guān)系、保護(hù)作為弱勢(shì)方的勞動(dòng)者的合法權(quán)益。這一方面,需要政府營(yíng)造勞動(dòng)至上的社會(huì)氛圍,樹(shù)立公平正義的價(jià)值取向,不斷提高勞動(dòng)者的社會(huì)地位,培育平等的勞資市場(chǎng),促進(jìn)就業(yè)穩(wěn)定和供需平衡,充分發(fā)揮三方協(xié)調(diào)機(jī)制、工會(huì)以及其他社會(huì)組織在勞動(dòng)關(guān)系中的積極作用,有效調(diào)整、平衡用人單位與勞動(dòng)者之間的利益關(guān)系,促成集體談判,實(shí)現(xiàn)勞資兩利、合作共贏,為構(gòu)建和諧勞動(dòng)關(guān)系培育良好的社會(huì)氛圍和發(fā)展環(huán)境;另一方面,政府應(yīng)當(dāng)運(yùn)用好手中的公權(quán)力,不斷健全勞動(dòng)法律法規(guī),完善勞動(dòng)關(guān)系和諧運(yùn)行的制度環(huán)境,合理分配社會(huì)資源,縮小收入差距,使勞動(dòng)者充分享受社會(huì)發(fā)展的成果,嚴(yán)格監(jiān)察執(zhí)法,保障勞動(dòng)者安全、健康、體面勞動(dòng),快速化解勞動(dòng)爭(zhēng)議糾紛,維護(hù)勞動(dòng)者和用人單位雙方的合法權(quán)益,保障、促進(jìn)勞動(dòng)關(guān)系和諧穩(wěn)定發(fā)展。
[Abstract]:Labor relation is the most basic social relations of production, existence and development of labor relations, not only affects the individual worker with the direct interests of the employer, at the same time it affects workers family development, related to the social and economic development, the harmonious labor relations is not only an important part of building a socialist harmonious society, but also a necessary the conditions of social harmony and stability. In the process of economic reform in our country, employers, employment forms, the relationship between the employer and the employee has undergone tremendous change, labor relations have also shown new features, but can not be ignored is that the current labor relations in China are facing severe employment situation strong capital, weak labor and wages of workers, unfair distribution of income, the income gap continues to expand, do not fully protect the legitimate rights and interests of workers and many other issues, has gradually entered the prone period of contradiction And multiple period, directly affects the realization of social fairness and justice, the impact of social development and harmony and stability. The reasons include the legal system, value orientation, distribution of interests, coordination mechanism, supervision supervision, many reasons for dispute processing. To solve practical problems of labor relations in the construction of the relationship between harmonious labor of our country, need to include all types of employers, workers, various social groups, organizations and even the joint efforts of every citizen, this process cannot do without the government functions correctly and effectively play. Divided from the different levels of labor relations have different meanings, this paper focuses on the narrow sense labor relations, workers and employers because of production, labor and produce the relationship of rights and obligations, and in the narrow sense of labor relations, the government for the realization of "harmony" and should bear the responsibilities as labor relations in the article. The three parties, the government should define the harmonious labor relations standards, fully understand the significance of constructing harmonious labor relations, and changes in the functions of accurate positioning, self perfection, based on the use of the "invisible hand" and "visible hand", handle the relationship between government and enterprises, and fully exert the advantage of constructing harmonious labor relationship in the process of cultivating and regulating functions, not only follow the labor market rules, respect for production management and internal management unit autonomy, and can give the necessary and appropriate intervention and adjustment of labor relations, effective coordination of interests, the protection of laborers as the weak party's legitimate rights and interests. On the one hand, the government should construct labor oriented social atmosphere, establish a fair and just value orientation, and constantly improve the social status of the laborer, the labor market to promote the cultivation of equality, stability and employment The balance of supply and demand, give full play to the three party coordination mechanism, trade unions and other social organizations in the labor relations of the positive role, effective regulation, the balance between the employer and the employee's interests, to achieve collective bargaining, labor and capital, win-win cooperation, to cultivate the social atmosphere and a good environment for the development of harmonious labor relations; the other hand, the government should use public power in the hands of, and constantly improve the labor laws and regulations, improve the institutional environment of harmonious labor relationship, reasonable distribution of social resources, to narrow the income gap, the workers to fully enjoy the fruits of social development, and strict supervision of law enforcement, labor safety and health, decent work, quickly resolve labor disputes, safeguard both employers and workers' legitimate rights and interests, safeguard and promote the stable development of the harmonious labor relations.
