【摘要】：行政許可后續(xù)監(jiān)管是指行政許可監(jiān)管機(jī)關(guān)對行政被許可人進(jìn)行督促和檢查,確保被許可人履行其法定義務(wù)的行政執(zhí)法行為。我國近年來發(fā)生的包括食品安全在內(nèi)的一系列危及社會公共安全的問題很多都緣于行政許可后續(xù)監(jiān)管的缺失。基于我國行政許可后續(xù)監(jiān)管工作的現(xiàn)狀,通過對其存在的問題進(jìn)行分析,建議從權(quán)力的來源、運(yùn)行及運(yùn)行結(jié)果等環(huán)節(jié)加強(qiáng)對行政許可監(jiān)管權(quán)的監(jiān)督和控制,確保被許可人嚴(yán)格履行其法定義務(wù),真正實(shí)現(xiàn)行政許可制度在社會管理中的重要功能。本文以昆明市工業(yè)產(chǎn)品生產(chǎn)許可后續(xù)監(jiān)管為例,對在全國工業(yè)產(chǎn)品生產(chǎn)許可后續(xù)監(jiān)管中在監(jiān)管機(jī)制與機(jī)構(gòu)設(shè)置、信息均衡、責(zé)任完善等方面存在的問題進(jìn)行分析,旨在提高基層質(zhì)量技術(shù)監(jiān)督部門在全國工業(yè)產(chǎn)品生產(chǎn)許可后續(xù)監(jiān)管工作中的工作效率和工作效果,切實(shí)從源頭把好產(chǎn)品質(zhì)量。本文從五個方面系統(tǒng)闡述了全國工業(yè)產(chǎn)品生產(chǎn)許可證在后續(xù)監(jiān)管中存在的問題,同時針對存在問題提出了合適的解決辦法；一、提出本文研究的意義與背景,并介紹了現(xiàn)階段國內(nèi)外研究情況及本文的寫作思路和研究方法：二、對全國工業(yè)產(chǎn)品生產(chǎn)許可證及后續(xù)監(jiān)管的相關(guān)概念進(jìn)行了說明；三、介紹了日本、美國等國家的產(chǎn)品質(zhì)量監(jiān)管模式,對上述國家產(chǎn)品質(zhì)量監(jiān)管模式進(jìn)行總結(jié),歸納出適合我國借鑒的監(jiān)管經(jīng)驗(yàn)；四、對全國工業(yè)產(chǎn)品生產(chǎn)許可后續(xù)監(jiān)管的現(xiàn)狀及其問題,進(jìn)行了詳細(xì)的論述；五、從監(jiān)管機(jī)制與機(jī)構(gòu)設(shè)置,信息均衡、責(zé)任完善等三個方面完善全國工業(yè)產(chǎn)品生產(chǎn)許可后續(xù)監(jiān)管的對策建議。
[Abstract]:The following supervision of administrative license refers to the supervision and supervision of administrative licensing authority to supervise and inspect the administrative licensee. In recent years, a series of problems, including food safety, endangering social public safety in China are due to the lack of subsequent supervision of administrative licensing. In China, the status quo of administrative licensing follow-up supervision. Through the analysis of the existing problems, it is suggested to strengthen the supervision and control of the administrative license supervision right from the sources of power, operation and operation results, to ensure that the licensee strictly fulfill its legal obligations. The administrative licensing system in the social management of an important function. This paper takes Kunming as an example of the follow-up supervision of industrial product production license. In the national industrial product production license follow-up supervision in the regulatory mechanism and institutional setup, information balance, responsibility improvement and other aspects of the problems are analyzed. The aim is to improve the working efficiency and effect of the quality and technical supervision department in the follow-up supervision of the national industrial product production license. This paper systematically expounds the problems existing in the subsequent supervision of the national industrial product production license from five aspects, and puts forward appropriate solutions to the existing problems. First, this paper puts forward the significance and background of this study, and introduces the current situation of domestic and foreign research and writing ideas and research methods: 2. The related concepts of national industrial product production license and subsequent supervision are explained. Third, introduced the product quality supervision model of Japan, the United States and other countries, summarized the product quality supervision model of the above countries, summed up the regulatory experience suitable for our country; Fourth, the status quo and problems of the follow-up supervision of the national industrial product production license are discussed in detail. Fifth, the countermeasures and suggestions to improve the follow-up supervision of national industrial product production license from three aspects of supervision mechanism and institution setup, information balance and responsibility perfection.
