【摘要】：公共建設(shè)項(xiàng)目合同策略的制定往往忽視了關(guān)系治理對(duì)承包人機(jī)會(huì)主義行為的抑制作用,造成合同策略側(cè)重于單一的控制功能,不利于合同的事后履約。根據(jù)項(xiàng)目治理理論,項(xiàng)目締約全過程中契約治理與關(guān)系治理存在交互作用,因而,合同策略必然包含兩者間的互動(dòng)關(guān)系。首先通過扎根分析,明確了公共建設(shè)項(xiàng)目合同策略是一個(gè)組合型構(gòu)念,包括承包人選擇、合同策略重點(diǎn)及防范問題方式3個(gè)維度;然后,利用關(guān)系行為量表,對(duì)合同策略中3個(gè)維度對(duì)應(yīng)的關(guān)系行為進(jìn)行測量,明確各參與方在合同締約各階段采取的具體關(guān)系行為;最后,結(jié)合訪談數(shù)據(jù)對(duì)關(guān)系行為測量結(jié)果進(jìn)行分析。結(jié)果發(fā)現(xiàn):在締約全過程中,承包人對(duì)待關(guān)系行為始終處于積極狀態(tài),業(yè)主方采取關(guān)系行為則存在一定的障礙。研究結(jié)果為公共建設(shè)項(xiàng)目關(guān)系治理的使用提供了依據(jù),同時(shí)也為各參與方采取合理的關(guān)系行為提供指導(dǎo)。
[Abstract]:The formulation of contract strategy for public construction projects often neglects the restraining effect of relationship governance on the opportunistic behavior of the contractor, resulting in the contract strategy focusing on a single control function. According to the theory of project governance, there is interaction between contract governance and relationship governance in the whole process of project contracting. The contract strategy must include the interactive relationship between the two. Firstly, through the rooted analysis, it is clear that the contract strategy of public construction project is a combinatorial structure, including contractor selection. Contract strategy focus and prevention of problems in three dimensions; Then, the relationship behavior of the three dimensions in the contract strategy is measured by using the relationship behavior scale, and the specific relationship behavior adopted by each participant in each stage of contract signing is clarified. Finally, combining the interview data to analyze the results of the relationship behavior measurement. The results show that: in the whole process of contracting, the contractor has always been in a positive state for the relationship behavior. The research results provide the basis for the use of the relationship governance of public construction projects, and also provide guidance for the participants to take reasonable relationship behavior.
