【摘要】：當(dāng)前,房地產(chǎn)項(xiàng)目聯(lián)建是房地產(chǎn)市場(chǎng)中常見的一種形式,在現(xiàn)實(shí)中聯(lián)建的參加主體范圍并未有具體限制,造成了各種不規(guī)范現(xiàn)象的產(chǎn)生,在項(xiàng)目實(shí)施過程中問題頻繁出現(xiàn),因此在對(duì)聯(lián)建合同的審查中,需要對(duì)聯(lián)合開發(fā)合同的法律問題等進(jìn)行分析,將聯(lián)建名義下的非法土地轉(zhuǎn)讓權(quán)、聯(lián)建形勢(shì)下的非法融資等行為進(jìn)行區(qū)分。
[Abstract]:At present, the joint construction of real estate projects is a common form in the real estate market. In reality, there are no specific restrictions on the scope of participation in the joint construction, which results in the emergence of various non-standard phenomena and the frequent occurrence of problems in the process of project implementation. Therefore, in the review of the joint construction contract, it is necessary to analyze the legal problems of the joint development contract and distinguish the illegal land transfer right under the name of the joint construction and the illegal financing under the joint construction situation.
