成都市房屋權(quán)屬登記問(wèn)題及對(duì)策研究

【摘要】:在我國(guó),房屋登記登記制度尚在起步和完善階段,保護(hù)權(quán)利人的合法權(quán)益是房屋登記的根本目的和出發(fā)點(diǎn)。房屋登記目的在于將房屋的權(quán)利對(duì)外公開(kāi),保證房屋交易的安全和便捷。因此,房屋登記制度的完善對(duì)維護(hù)當(dāng)事人合法的權(quán)益具有重要的作用。成都作為西部地區(qū)的經(jīng)濟(jì)中心,房地產(chǎn)發(fā)展速度相當(dāng)驚人,隨之而來(lái)成都市房屋登記工作也進(jìn)入了高速發(fā)展階段。作為房屋登記部門(mén)的成都市房屋產(chǎn)權(quán)登記中心,十分重視建立高效、規(guī)范的房屋登記流程,完善房屋登記標(biāo)準(zhǔn),構(gòu)建完整的GIS系統(tǒng),提高登記服務(wù)質(zhì)量,逐漸成為國(guó)內(nèi)房屋登記示范機(jī)構(gòu)。但是,隨著成都市房屋登記工作的逐步推進(jìn)和發(fā)展,一些問(wèn)題仍舊沒(méi)有得到解決,迫切需要不斷改革和完善。本文首先依據(jù)不動(dòng)產(chǎn)登記的相關(guān)理論,對(duì)文獻(xiàn)進(jìn)行梳理,總結(jié)出我國(guó)不動(dòng)產(chǎn)登記中存在的不足。以成都市為研究對(duì)象,從登記機(jī)構(gòu)管理角度出發(fā),結(jié)合目前我國(guó)不動(dòng)產(chǎn)登記中存在的問(wèn)題進(jìn)行對(duì)比分析,找出登記機(jī)構(gòu)不統(tǒng)一、登記審查尺度把握不準(zhǔn)、登記系統(tǒng)建設(shè)滯后、登記人員身份尷尬以及登記賠償制度缺失五個(gè)方面的問(wèn)題,針對(duì)問(wèn)題根源進(jìn)行分析并提出相應(yīng)對(duì)策。 本文主要分成五個(gè)部分:第一部分緒論,包括論文的研究背景、意義、相關(guān)研究綜述以及研究的目的、內(nèi)容、研究思路和方法;第二部分介紹國(guó)內(nèi)外不動(dòng)產(chǎn)登記的相關(guān)理論及實(shí)踐;第三部分介紹成都市房屋登記的現(xiàn)狀;第四部分是找出成都市房屋登記管理中存在的問(wèn)題;第五部分分析成都市房屋登記問(wèn)題產(chǎn)生的根源;第六部分提出問(wèn)題的解決對(duì)策。
[Abstract]:In China, the housing registration system is still in its infancy and perfection stage, and protecting the legitimate rights and interests of the right holder is the fundamental purpose and starting point of housing registration. The purpose of housing registration is to make the right of house open to the public and to ensure the safety and convenience of housing transactions. Therefore, the improvement of housing registration system plays an important role in safeguarding the legitimate rights and interests of the parties. Chengdu as the economic center of the western region, the real estate development rate is quite astonishing, followed by Chengdu housing registration work has entered a rapid development stage. As the housing property registration center in Chengdu, the housing registration center attaches great importance to establishing an efficient and standardized housing registration process, perfecting the housing registration standard, building a complete GIS system, and improving the quality of registration services. Gradually become the domestic housing registration model organization. However, with the gradual advancement and development of housing registration in Chengdu, some problems still remain unresolved and urgent need for continuous reform and improvement. Firstly, according to the theory of real estate registration, this paper combs the literature and summarizes the shortcomings of real estate registration in our country. Taking Chengdu as the research object, from the point of view of registration organization management and combining with the problems existing in the registration of real estate in our country at present, this paper makes a comparative analysis, and finds out that the registration institution is not unified, the scale of registration examination is uncertain, and the construction of registration system is lagging behind. There are five problems in the embarrassing status of registration personnel and the lack of registration compensation system. The author analyzes the root causes of the problems and puts forward corresponding countermeasures. This paper is divided into five parts: the first part of the introduction, including the research background, significance, related research review and research purposes, content, research ideas and methods; The second part introduces the theory and practice of real estate registration at home and abroad; the third part introduces the current situation of housing registration in Chengdu; the fourth part is to find out the problems existing in the housing registration management in Chengdu; The fifth part analyzes the root of the housing registration problem in Chengdu, and the sixth part puts forward the solution to the problem.
