【摘要】:在社會(huì)主義市場(chǎng)經(jīng)濟(jì)體系中產(chǎn)權(quán)是商品交易的前提和基礎(chǔ),任何人只有完全擁有商品的產(chǎn)權(quán),此時(shí)才有資格合法的將所屬商品投入市場(chǎng)并進(jìn)行交易,F(xiàn)代市場(chǎng)經(jīng)濟(jì)理論告訴我們,確定產(chǎn)權(quán)的歸屬的一個(gè)重要前提就是產(chǎn)權(quán)的界定,因?yàn)橹挥写_權(quán)后的產(chǎn)權(quán)才具備法律效力。房地產(chǎn)隸屬于不動(dòng)產(chǎn)范疇,房地產(chǎn)的交易事實(shí)上就是一系列產(chǎn)權(quán)關(guān)系的變化,完成相應(yīng)的產(chǎn)權(quán)變更手續(xù)才算合法的完成了交易,才能得到法律的保護(hù),具有法律效力。 事實(shí)上,有關(guān)于房屋產(chǎn)權(quán)面積、識(shí)別機(jī)理及存在的問(wèn)題等方面的文獻(xiàn)不多,但相關(guān)及邊緣理論研究還較為豐富和完備,制度建設(shè)方面也不乏成熟的觀點(diǎn),對(duì)指導(dǎo)我國(guó)房屋產(chǎn)權(quán)面積的識(shí)別和區(qū)分有至關(guān)重要的作用。隨著城市化進(jìn)程的推進(jìn)、房地產(chǎn)業(yè)的高速發(fā)展,現(xiàn)有的房屋產(chǎn)權(quán)面積識(shí)別體系存在的隱患和缺陷逐漸暴露出來(lái),比如:對(duì)房屋產(chǎn)權(quán)面積基本知識(shí)的了解不足、與其他面積概念的混淆不清、房屋產(chǎn)權(quán)面積的識(shí)別機(jī)理相對(duì)模糊等。本文研究重點(diǎn)主要有兩大方面,一是基于產(chǎn)權(quán)理論,厘清容易讓人混淆的各類面積的概念;第二方面是對(duì)當(dāng)前房屋產(chǎn)權(quán)面積識(shí)別過(guò)程中存在的一系列現(xiàn)實(shí)問(wèn)題進(jìn)行探討以及列舉部分實(shí)例進(jìn)行分析研究并論證,從產(chǎn)權(quán)理論出發(fā),分析實(shí)現(xiàn)房產(chǎn)面積的邊界與范圍識(shí)別的方法。 產(chǎn)權(quán)理論是房產(chǎn)面積研究的重要理論依據(jù),詳細(xì)了解產(chǎn)權(quán)的內(nèi)涵、功能、邊界與范圍范圍以及產(chǎn)權(quán)的界定尤為重要。房產(chǎn)面積的產(chǎn)權(quán)屬性主要是解釋房產(chǎn)面積的內(nèi)涵以及房產(chǎn)面積與建筑面積、容積率面積的區(qū)分,并詮釋房產(chǎn)面積產(chǎn)權(quán)屬性的一系列表現(xiàn),通過(guò)對(duì)市場(chǎng)上屢禁不止的“偷面積”的由來(lái)及慣用手法的簡(jiǎn)單介紹來(lái)凸顯明晰產(chǎn)權(quán)范圍與邊界的重要性和迫切性。 房屋產(chǎn)權(quán)面積的邊界與范圍識(shí)別方法。主要是立足于已有研究成果的基礎(chǔ)上對(duì)房屋產(chǎn)權(quán)面積識(shí)別機(jī)理從資產(chǎn)基礎(chǔ)、空間基礎(chǔ)、受益基礎(chǔ)以及特殊基礎(chǔ)入手進(jìn)行總結(jié)和梳理,然后介紹了幾類識(shí)別方法的基本原理和運(yùn)用。專有與共有識(shí)別法是對(duì)專有部分與共有部分的產(chǎn)權(quán)面積進(jìn)行識(shí)別和區(qū)分,劃定邊界與范圍以確定各專有部分和分?jǐn)偣灿胁课坏奶變?nèi)建筑面積的基數(shù),按比例進(jìn)行分?jǐn)傆?jì)算;結(jié)構(gòu)與功能識(shí)別法是對(duì)因?yàn)榉课萁Y(jié)構(gòu)和功能改變而造成的產(chǎn)權(quán)面積邊界與范圍的重新測(cè)算,用以解決因歷史、設(shè)計(jì)變更、分隔變更產(chǎn)生的前后公共建筑面積分?jǐn)偛煌、戶?nèi)建筑面積相等而分?jǐn)偣步ㄖ娣e不對(duì)應(yīng)等問(wèn)題;空間面積識(shí)別法依據(jù)容積率與房屋產(chǎn)權(quán)及土地密不可分的關(guān)系,對(duì)房屋產(chǎn)權(quán)邊界與范圍進(jìn)行識(shí)別;特殊部位識(shí)別法主要是論述比如伸縮縫、穿越房屋的通道、小區(qū)的消防通道、地下停車庫(kù)等一些特殊部位產(chǎn)權(quán)的邊界與范圍進(jìn)行識(shí)別及相應(yīng)的識(shí)別方法。
[Abstract]:In the socialist market economy system, property right is the premise and foundation of commodity transaction. The theory of modern market economy tells us that the definition of property right is an important prerequisite for ascertaining the ownership of property right, because only when the property right is confirmed can it have legal effect. The real estate belongs to the real estate category, the real estate transaction is in fact a series of property right relations change, the completion corresponding property right change formalities only then legally completes the transaction, can obtain the legal protection, has the legal effect. As a matter of fact, there are few documents on the area of house property rights, identifying mechanism and existing problems, but the research on relevant and marginal theories is relatively rich and complete, and there are many mature views on system construction. It plays an important role in guiding the identification and differentiation of housing property area in our country. With the advancement of urbanization and the rapid development of real estate industry, the hidden dangers and defects existing in the existing system of identifying the area of housing property rights have been gradually exposed, such as the lack of understanding of the basic knowledge of the area of housing property rights. Confused with other concepts of area, the recognition mechanism of housing property area is relatively fuzzy. This paper focuses on two main aspects: first, based on the theory of property rights, to clarify the concept of various areas that are easy to be confused; The second aspect is to discuss a series of practical problems existing in the process of identifying the area of housing property right, and enumerate some examples to analyze and demonstrate, starting from the theory of property right. The method of realizing the boundary and range identification of real estate area is analyzed. The theory of property right is an important theoretical basis for the study of real estate area. It is particularly important to understand the connotation, function, boundary and scope of property right and the definition of property right in detail. The property right attribute of real estate area mainly explains the connotation of real estate area and the distinction between real estate area and building area, volume ratio area, and interprets a series of performance of property right attribute of real estate area. The importance and urgency of clarifying the scope and boundary of property rights are highlighted by a brief introduction of the origin of the "stolen area" and the usual methods of repeated prohibition in the market. The method of identifying the boundary and range of housing property area. Based on the existing research results, the paper summarizes and combs the identification mechanism of housing property area from the asset basis, the spatial basis, the benefit basis and the special foundation. Then the basic principle and application of several kinds of recognition methods are introduced. The method of exclusive and mutual identification is to identify and distinguish the area of property right between the exclusive part and the common part, to delimit the boundary and scope to determine the cardinal number of the building area in each exclusive part and the shared part, and to share the area according to the proportion. The method of structure and function recognition is a recalculation of the boundary and scope of property right area caused by the change of the structure and function of the house, which is used to solve the problem that the area of public building is divided before and after the change of history, design and separation. The space area identification method identifies the boundary and range of housing property rights according to the inseparable relationship between the volume ratio and the property rights of houses and land. The recognition method of special parts mainly discusses the boundary and scope of property right of some special parts such as expansion joint, passage through house, fire fighting passage of residential area, underground parking garage and so on.
