房地產(chǎn)行政審批制度法律問(wèn)題研究

【摘要】:房地產(chǎn)行業(yè)是關(guān)系國(guó)計(jì)民生發(fā)展的關(guān)鍵行業(yè),房地產(chǎn)行政審批制度輻射房地產(chǎn)行業(yè)包括房地產(chǎn)企業(yè)和房地產(chǎn)項(xiàng)目等的方方面面,并貫穿房地產(chǎn)行業(yè)從立項(xiàng),到開發(fā),到使用的全過(guò)程。因此,房地產(chǎn)行政審批制度的優(yōu)劣直接影響房地產(chǎn)行業(yè)的發(fā)展,甚而影響國(guó)計(jì)民生的發(fā)展。我國(guó)的房地產(chǎn)行政審批制度形成較晚,體系尚不健全,特別是行政審批管理機(jī)構(gòu)眾多,機(jī)構(gòu)設(shè)置不合理,管理權(quán)限和職能互有交叉,行政報(bào)批手續(xù)繁雜,審批隨意性大,腐敗現(xiàn)象滋生,立法缺位嚴(yán)重。這些情況勢(shì)必阻礙房地產(chǎn)行業(yè)健康、有序、穩(wěn)定地發(fā)展,損及社會(huì)利益、公眾利益及房地產(chǎn)開發(fā)企業(yè)的利益。本文首先以房地產(chǎn)行政審批事項(xiàng)為切入點(diǎn),以筆者所在城市為例深入調(diào)查房地產(chǎn)行政審批操作實(shí)務(wù);其次通過(guò)與國(guó)外房地產(chǎn)行政審批制度對(duì)比,全面剖析我國(guó)房地產(chǎn)行政審批制度存在的問(wèn)題,探尋這些問(wèn)題存在的癥結(jié),尤其對(duì)房地產(chǎn)行政審批專門立法缺位,行政審批效率不高,違法審批責(zé)任追究不足,行政審批監(jiān)督薄弱的問(wèn)題進(jìn)行深入的分析;最后筆者運(yùn)用行政法學(xué)理論從頒行專門行政審批立法、提高行政審批效率、強(qiáng)化違法審批法律責(zé)任、加強(qiáng)行政審批監(jiān)督幾個(gè)方面提出建議,以期房地產(chǎn)行政審批管理制度在我國(guó)房地產(chǎn)行業(yè)發(fā)展過(guò)程中真正發(fā)揮指引、規(guī)范、推動(dòng)作用。
[Abstract]:The real estate industry is a key industry related to the development of the national economy and the people's livelihood. The real estate administrative examination and approval system radiates all aspects of the real estate industry, including real estate enterprises and real estate projects, and runs through the real estate industry from project establishment to development. The whole process to use. Therefore, the merits and demerits of the real estate administrative examination and approval system directly affect the development of the real estate industry, and even the development of the national economy and people's livelihood. The administrative examination and approval system of real estate in our country has been formed late, and the system is not perfect. Especially, the administrative examination and approval system is numerous, the organization is not set up reasonably, the management authority and function are intersected, the administrative reporting procedure is complicated, and the examination and approval is arbitrary. Corruption is breeding and legislation is lacking seriously. These conditions are bound to hinder the healthy, orderly and stable development of the real estate industry, and harm the interests of the society, the public and the real estate development enterprises. Firstly, this paper takes the administrative examination and approval of real estate as the starting point, taking the author's city as an example to investigate the practice of administrative examination and approval of real estate; secondly, by comparing with the administrative examination and approval system of real estate abroad, This paper comprehensively analyzes the problems existing in China's real estate administrative examination and approval system, and explores the crux of these problems, especially for the absence of special legislation for real estate administrative examination and approval, the low efficiency of administrative examination and approval, and the lack of accountability for illegal examination and approval. Finally, the author applies the theory of administrative law to enact special administrative examination and approval legislation, to improve the efficiency of administrative examination and approval, and to strengthen the legal responsibility of illegal examination and approval. This paper puts forward some suggestions on strengthening the supervision of administrative examination and approval in order to bring the real estate administrative examination and approval management system into play in the course of the development of real estate industry in our country.
