大連市房地產(chǎn)評(píng)估監(jiān)管問題及對(duì)策研究

【摘要】:房地產(chǎn)評(píng)估是房地產(chǎn)中介的組成部分,作為維持房地產(chǎn)市場(chǎng)公平公正的一種重要手段,在西方國(guó)家有著百年的歷史。我國(guó)現(xiàn)代房地產(chǎn)評(píng)估行業(yè)興起于20世紀(jì)80年代,近年來我國(guó)房地產(chǎn)評(píng)估業(yè)發(fā)展迅速,伴隨著法律法規(guī)的不斷完善,業(yè)務(wù)量的增加,評(píng)估標(biāo)準(zhǔn)逐步健全;我國(guó)評(píng)估執(zhí)業(yè)更加規(guī)范,評(píng)估質(zhì)量也明顯提高。經(jīng)過多年的摸索和實(shí)踐,初步探索出政府監(jiān)管為主,結(jié)合行業(yè)自律社會(huì)監(jiān)督的監(jiān)管模式,逐漸形成了開放公正、監(jiān)管有序的市場(chǎng)秩序。因?yàn)槲覈?guó)房地產(chǎn)評(píng)估起步較晚,目前關(guān)于房地產(chǎn)評(píng)估還缺乏較為系統(tǒng)的論述,對(duì)房地產(chǎn)評(píng)估監(jiān)管領(lǐng)域的研究更是一個(gè)較新的領(lǐng)域,目前關(guān)于房地產(chǎn)評(píng)估監(jiān)管方面的研究更多的是對(duì)現(xiàn)實(shí)的闡述,缺少科學(xué)的深刻分析。 伴隨著房地產(chǎn)評(píng)估行業(yè)的發(fā)展,行業(yè)監(jiān)管問題也日益顯現(xiàn)出來。雖然大連房地產(chǎn)評(píng)估行業(yè)在國(guó)內(nèi)屬于較為超前的城市,但是相較于國(guó)內(nèi)外發(fā)達(dá)國(guó)家和地區(qū)的監(jiān)管模式,仍有較大差距,因此在結(jié)合現(xiàn)實(shí)背景的基礎(chǔ)上,國(guó)內(nèi)外發(fā)達(dá)國(guó)家和地區(qū)的先進(jìn)經(jīng)驗(yàn)對(duì)完善大連市房地產(chǎn)評(píng)估監(jiān)管制度有著借鑒意義。 大連現(xiàn)行監(jiān)管模式為政府監(jiān)管行業(yè)自律,但是由于體制等歷史問題,并未完全發(fā)揮此模式的優(yōu)勢(shì);現(xiàn)在大連房地產(chǎn)評(píng)估監(jiān)管主要存在著政府監(jiān)管多元化,行業(yè)獨(dú)立性差,法律法規(guī)不完善等問題,本文通過分析大連房地產(chǎn)評(píng)估監(jiān)管現(xiàn)狀分析,結(jié)合國(guó)內(nèi)外先進(jìn)經(jīng)驗(yàn),論證出大連市仍然適合現(xiàn)行的政府監(jiān)管行業(yè)自律監(jiān)管模式;在此基礎(chǔ)上對(duì)大連市房地產(chǎn)評(píng)估市場(chǎng)從監(jiān)管主體,監(jiān)管客體,監(jiān)管手段標(biāo)準(zhǔn)等幾個(gè)方面提出對(duì)策和意見。
[Abstract]:As an important means to maintain the fairness and fairness of real estate market, real estate evaluation is a component of real estate intermediary, and has a history of one hundred years in western countries. China's modern real estate evaluation industry rose in the 1980s. In recent years, China's real estate evaluation industry has developed rapidly. With the continuous improvement of laws and regulations, the increase of business volume, the evaluation standard is gradually improved. The quality of the evaluation is also significantly improved. After many years of exploration and practice, this paper preliminarily explored the supervision mode of government supervision, and combined with the supervision mode of self-discipline social supervision of the industry, gradually formed the market order of open and fair and orderly supervision. Because of the late start of real estate evaluation in our country, there is still a lack of systematic discussion on real estate evaluation at present, and the research on the field of real estate evaluation supervision is a relatively new field. At present, the research on the supervision of real estate evaluation is more about the elaboration of reality, lacking of scientific and profound analysis. Along with the development of real estate appraisal industry, the problem of industry supervision also appears day by day. Although Dalian Real Estate Appraisal Industry is a leading city in China, there is still a big gap between the domestic and foreign developed countries and regions, so on the basis of combining the realistic background, The advanced experience of developed countries and regions at home and abroad has reference significance for perfecting the supervision system of real estate evaluation in Dalian. The current supervision mode of Dalian is the self-discipline of the government supervision industry, but because of the historical problems such as the system, it does not give full play to the advantages of this model. Through analyzing the current situation of Dalian real estate evaluation and supervision, combining the advanced experience at home and abroad, this paper demonstrates that Dalian is still suitable for the current self-regulatory mode of government supervision industry. On this basis, this paper puts forward some countermeasures and suggestions on Dalian real estate evaluation market from the aspects of supervision subject, supervision object, supervision means standard and so on.
