【摘要】:不動(dòng)產(chǎn)預(yù)告登記制度是民法體系中關(guān)于物權(quán)變動(dòng)的重要組成部分,它起源于普魯士法,在德國(guó)予以正式確立,并為大陸法系各國(guó)所繼受并發(fā)展,現(xiàn)己成為一項(xiàng)比較成熟的物權(quán)制度。預(yù)告登記制度旨在保全不動(dòng)產(chǎn)物權(quán)變動(dòng)的請(qǐng)求權(quán)在未來(lái)的順利實(shí)現(xiàn),對(duì)不動(dòng)產(chǎn)交易市場(chǎng)的有序運(yùn)作有著十分重要的意義。隨著我國(guó)社會(huì)經(jīng)濟(jì)的蓬勃發(fā)展,房地產(chǎn)市場(chǎng)的急劇繁榮,亟需完善的不動(dòng)產(chǎn)制度來(lái)平衡利益糾紛和保障法治環(huán)境。預(yù)告登記制度在我國(guó)是較新的制度,從2007年《物權(quán)法》頒布才正式予以施行,在實(shí)踐中也已有初步的調(diào)控作用。但由于各方面規(guī)定尚未成熟,實(shí)施效果尚不明顯,未來(lái)還需要進(jìn)一步的修正和完善,以充分發(fā)揮其保障交易安全、促進(jìn)交易發(fā)展的作用。本文將從預(yù)告登記的基本情況簡(jiǎn)介入手,深入分析其應(yīng)具備的效力和在實(shí)踐中的體現(xiàn),同時(shí)具體分析比較幾個(gè)主要國(guó)家和地區(qū)的預(yù)告登記制度的設(shè)計(jì)情況,結(jié)合我國(guó)實(shí)際情況,提出對(duì)我國(guó)預(yù)告登記制度的完善建議。本文分為五個(gè)部分。第一部分簡(jiǎn)要介紹預(yù)告登記的歷史淵源、內(nèi)涵界定和主要特征,為后續(xù)詳盡分析其效力作鋪墊。第二部分將融合主要國(guó)家和地區(qū)的立法實(shí)例,以及法學(xué)理論界的重要觀點(diǎn),詳細(xì)分析預(yù)告登記的保全權(quán)利效力、保全順位效力,破產(chǎn)保護(hù)效力和預(yù)警效力。第三部分具體分析和比較德國(guó)、日本和我國(guó)臺(tái)灣地區(qū)的預(yù)告登記制度設(shè)計(jì),并對(duì)其制度的優(yōu)缺點(diǎn)進(jìn)行分析評(píng)價(jià),從而提煉出對(duì)我國(guó)有借鑒意義的參考點(diǎn)。第四部分通過(guò)綜合整理我國(guó)現(xiàn)階段預(yù)告登記制度的規(guī)定,剖析我國(guó)預(yù)告登記的現(xiàn)狀和制度缺陷。最后一部分結(jié)合他國(guó)立法實(shí)踐和理論經(jīng)驗(yàn),針對(duì)我國(guó)目前預(yù)告登記制度所存在的缺陷,從立法統(tǒng)一、管理整合、適用范圍、效力內(nèi)容、程序設(shè)置等方面提出完善建議。
[Abstract]:The system of immovable property notice registration is an important part of the civil law system concerning the change of real right. It originated from Prussia law and was formally established in Germany and developed and accepted by the countries of civil law system. Now it has become a relatively mature real right system. The notice registration system aims to preserve the right of claim for real property right change in the future. It is of great significance to the orderly operation of the real estate market. With the vigorous development of our country's social economy, the real estate market is booming rapidly. It is urgent to perfect the real estate system to balance the interests dispute and protect the legal environment. The notice registration system is a relatively new system in our country, which has been put into practice since the promulgation of the Real right Law in 2007. In practice, there has also been a preliminary regulatory role. However, since the provisions in various fields are not yet mature and the effect of implementation is not obvious, further amendments and improvements are needed in the future in order to give full play to the security of transactions. The role of promoting the development of transactions. This paper will begin with a brief introduction of the basic conditions of advance registration, and analyze in depth its effectiveness and its embodiment in practice. At the same time, it concretely analyzes and compares the design situation of the advance notice registration system in several major countries and regions, and combines the actual situation of our country. This paper is divided into five parts. The first part briefly introduces the historical origin, connotation definition and main characteristics of advance notice registration. The second part will integrate the legislative examples of the major countries and regions, as well as the important viewpoints of the legal theorists, and analyze in detail the validity of the preservation of rights and the preservation of the order of effect of the advance registration. The third part analyzes and compares the design of advance notice registration system in Germany, Japan and Taiwan, and analyzes and evaluates the advantages and disadvantages of the system. In order to refine the reference points of reference for our country. The fourth part through the comprehensive arrangement of the provisions of China's current advance registration system, The last part combines with the legislative practice and theoretical experience of other countries, aiming at the defects of the present notice registration system of our country, from the legislative unification, the management conformity, the scope of application, the effect content, Some suggestions on how to set up the program are put forward.
