網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)保護(hù)問題研究

【摘要】:隨著信息技術(shù)突飛猛進(jìn)的發(fā)展,網(wǎng)絡(luò)電子手段不斷普及,互聯(lián)網(wǎng)的應(yīng)用滲透到生活中的方方面面。人們的許多傳統(tǒng)行為模式正在發(fā)生深刻的變化,傳統(tǒng)的購物模式受到來自互聯(lián)網(wǎng)的沖擊。作為時(shí)代的新興產(chǎn)物,便利的網(wǎng)上交易頗受推崇,網(wǎng)絡(luò)購物群體日益龐大,網(wǎng)絡(luò)交易額快速增加。但是,在網(wǎng)上消費(fèi)活動(dòng)蓬勃發(fā)展、人們高度依賴網(wǎng)絡(luò)的背境下,,網(wǎng)絡(luò)消費(fèi)者的權(quán)益尤其是隱私權(quán)保護(hù)問題逐漸突顯出來。 本文以界定網(wǎng)絡(luò)交易與消費(fèi)者隱私權(quán)為切入點(diǎn),分析眼下網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)受到侵害的表現(xiàn),我國對(duì)消費(fèi)者隱私權(quán)保護(hù)的現(xiàn)狀及存在的問題,并結(jié)合國外網(wǎng)絡(luò)交易消費(fèi)者隱私權(quán)相關(guān)制度,提出完善我國網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)保護(hù)制度的建議,分五個(gè)部分對(duì)網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)保護(hù)問題進(jìn)行探討。 第一部分對(duì)網(wǎng)絡(luò)交易與消費(fèi)者隱私權(quán)做了界定,為筆者之后的論述奠定基礎(chǔ)。首先概述網(wǎng)絡(luò)交易的概念、類型,簡要總結(jié)網(wǎng)絡(luò)交易的主要特點(diǎn);其后,通過界定消費(fèi)者隱私權(quán)對(duì)網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)的特點(diǎn)進(jìn)行分析。 第二部分針對(duì)網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)受到侵害的表現(xiàn)進(jìn)行分析。這些表現(xiàn)主要包括三個(gè)方面:消費(fèi)者隱私信息被不當(dāng)收集、消費(fèi)者隱私信息被不法分析利用、消費(fèi)者隱私信息被非法交易。通過這三個(gè)方面的分析,筆者力圖說明消費(fèi)者隱私權(quán)保護(hù)面臨的挑戰(zhàn)并為下文論述完善我國消費(fèi)者隱私權(quán)保護(hù)的建議提供鋪墊。 第三部分主要講述了我國目前對(duì)消費(fèi)者隱私權(quán)的保護(hù)現(xiàn)狀及存在的問題。我國沒有從法律上明確肯定隱私權(quán)的獨(dú)立人格權(quán)地位,法律對(duì)隱私的規(guī)定過于抽象和籠統(tǒng),缺乏可操作性。 第四部分主要列舉了國外網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)保護(hù)方面的相關(guān)制度。目前,美國、歐盟、經(jīng)合組織等發(fā)達(dá)國家和國際組織對(duì)網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)的保護(hù)都制定了相關(guān)法律制度。筆者對(duì)這些國際組織和國家的網(wǎng)絡(luò)交易消費(fèi)者隱私權(quán)方面的相關(guān)法律制度進(jìn)行介紹并總結(jié)他們的先進(jìn)經(jīng)驗(yàn),以期對(duì)完善我國網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)益保護(hù)的法律體系有所幫助。 最后一部分主要提出了完善我國網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)保護(hù)的相關(guān)建議。這些建議包括:完善對(duì)消費(fèi)者隱私權(quán)保護(hù)的法律體系,確立網(wǎng)絡(luò)環(huán)境下消費(fèi)者隱私數(shù)據(jù)保護(hù)的基本原則,明確網(wǎng)站經(jīng)營者保護(hù)消費(fèi)者隱私權(quán)的義務(wù)。同時(shí),應(yīng)加強(qiáng)行業(yè)自律,教育網(wǎng)絡(luò)用戶加強(qiáng)自我保護(hù)意識(shí)。另外,還應(yīng)該發(fā)揮相關(guān)職能部門的作用,加強(qiáng)對(duì)網(wǎng)絡(luò)經(jīng)營商的監(jiān)管,鼓勵(lì)保險(xiǎn)公司開展網(wǎng)絡(luò)黑客保險(xiǎn)業(yè)務(wù)。筆者希望這些建議可以提高網(wǎng)絡(luò)交易中消費(fèi)者隱私權(quán)保護(hù)的水平。
[Abstract]:With the rapid development of information technology and the popularization of network electronic means, the application of Internet permeates every aspect of life. Many of people's traditional behavior patterns are undergoing profound changes, the traditional shopping mode from the impact of the Internet. As a new product of the times, convenient online transactions are highly praised. However, with the vigorous development of online consumer activities and people relying heavily on the Internet, the rights and interests of online consumers, especially the protection of privacy, are gradually highlighted. Based on the definition of online transaction and consumer privacy, this paper analyzes the current situation and problems of consumer privacy protection in online transactions. In this paper, the author puts forward some suggestions on how to improve the system of consumer privacy protection in online transactions in China, and discusses the protection of consumer privacy in online transactions in five parts. The first part defines the online transaction and consumer privacy right, which lays the foundation for the author's later discussion. Firstly, it summarizes the concept, types and main characteristics of online transactions. Then, it analyzes the characteristics of consumer privacy in online transactions by defining consumers' right to privacy. The second part analyzes the behavior of consumer privacy infringement in online transactions. These manifestations mainly include three aspects: the improper collection of consumer privacy information, the illegal analysis and utilization of consumer privacy information, and the illegal trading of consumer privacy information. Through the analysis of these three aspects, the author tries to explain the challenges faced by the protection of consumer privacy and provide the basis for the following discussion on how to improve the protection of consumer privacy in China. The third part mainly describes the current situation and problems of consumer privacy protection in China. Our country does not affirm the independent personality right status of the right of privacy from the law clearly, the rule of privacy of the law is too abstract and general, lack of maneuverability. The fourth part mainly enumerates the related system of consumer privacy protection in foreign internet transactions. At present, the United States, the European Union, OECD and other developed countries and international organizations have formulated relevant legal systems to protect consumer privacy in online transactions. The author introduces the relevant legal system of online transaction consumer privacy in these international organizations and countries and summarizes their advanced experience. In order to perfect the legal system of consumer privacy rights and interests protection in network transactions in China. In the last part, the author puts forward some suggestions on how to improve the protection of consumer's right to privacy in China's online transactions. These suggestions include perfecting the legal system of consumer privacy protection, establishing the basic principles of consumer privacy data protection under the network environment, and clarifying the obligations of website operators to protect consumer privacy. At the same time, we should strengthen industry self-discipline and educate network users to strengthen self-protection consciousness. In addition, we should play the role of relevant functional departments, strengthen the supervision of network operators, encourage insurance companies to carry out network hacker insurance business. I hope these suggestions can improve the level of consumer privacy protection in online transactions.
