論我國(guó)快遞服務(wù)中消費(fèi)者權(quán)益法律保護(hù)

【摘要】:隨著電子商務(wù)的高速發(fā)展和“互聯(lián)網(wǎng)+”概念的興起,快遞行業(yè)空前快速增長(zhǎng)。我國(guó)快遞業(yè)已經(jīng)連續(xù)三年保持了超過(guò)兩位數(shù)的增長(zhǎng),且長(zhǎng)期增速超過(guò)50%。進(jìn)入2016年以來(lái),通過(guò)中間平臺(tái)進(jìn)行的非面對(duì)面交易突飛猛進(jìn),推動(dòng)快遞業(yè)進(jìn)一步上升和變革。如今,通過(guò)快遞進(jìn)行貨物運(yùn)輸已經(jīng)成為許多人日常生活一項(xiàng)重要內(nèi)容,如網(wǎng)購(gòu)物品的傳遞,證件、票據(jù)的傳遞等等。然而在消費(fèi)者享受方便、快捷、高效快遞服務(wù)的同時(shí),其消費(fèi)者權(quán)益卻屢遭受到侵害,無(wú)法得到很好的保障。保障快遞服務(wù)中消費(fèi)者的合法權(quán)益,不但具有法理依據(jù),更重要的是具有實(shí)踐意義。本文正是在這樣的背景下,從保護(hù)快遞服務(wù)中消費(fèi)者合法權(quán)益的角度出發(fā),結(jié)合我國(guó)快遞行業(yè)現(xiàn)實(shí)狀況,分析消費(fèi)者權(quán)益受損原因、現(xiàn)行保護(hù)制度不足等的基礎(chǔ)上,試圖提出一些可行的建設(shè)性對(duì)策,以期給予快遞服務(wù)中消費(fèi)者更完善的保護(hù)。文章分為六個(gè)部分論述我國(guó)快遞服務(wù)中消費(fèi)者權(quán)益法律保護(hù)問(wèn)題,主要內(nèi)容如下:第一部分為緒論,是本文提出問(wèn)題部分,此部分主要對(duì)快遞行業(yè)、消費(fèi)者、服務(wù)消費(fèi)以及快遞服務(wù)中消費(fèi)者權(quán)益保護(hù)等概念問(wèn)題進(jìn)行概述,以案例形式提出快遞行業(yè)普遍存在侵犯消費(fèi)者權(quán)益的行為,但由于種種原因?qū)е孪M(fèi)者獲得救濟(jì)難度較大,因此需要保護(hù)其合法權(quán)益。第二部分是文章的第二章,主要是對(duì)保護(hù)快遞服務(wù)中消費(fèi)者權(quán)益進(jìn)行概述,其中主要包括保護(hù)快遞服務(wù)中消費(fèi)者權(quán)益的經(jīng)濟(jì)法和民法法理分析,現(xiàn)行的保護(hù)措施以及對(duì)快遞合同法律關(guān)系進(jìn)行分析并指出其不足之處。第三部分是文章的第三章,主要論述快遞服務(wù)消費(fèi)者權(quán)益保護(hù)的現(xiàn)狀。分析快遞服務(wù)侵害消費(fèi)者權(quán)益的主要情形,以及對(duì)快遞服務(wù)中消費(fèi)者合法權(quán)益屢屢受到侵害的原因進(jìn)行分析。第四部分是文章的第四章,主要參考和借鑒國(guó)外對(duì)于快遞服務(wù)中消費(fèi)者權(quán)益保護(hù)立法的和監(jiān)管制度等相關(guān)規(guī)定。本章主要參考美國(guó)和德國(guó)的相關(guān)規(guī)定,并提出可借鑒的經(jīng)驗(yàn)。第五部分是文章的第五章,是本文的解決問(wèn)題部分,主要是提出完善符合我國(guó)國(guó)情的快遞服務(wù)消費(fèi)者權(quán)益保護(hù)制度,其中主要包括健全法律法規(guī)、完善快遞行業(yè)的監(jiān)管體系、減低維權(quán)成本、試行快遞服務(wù)強(qiáng)制小額保險(xiǎn)制度以及保障消費(fèi)者個(gè)人信息等具體的解決方法,以期能為快遞行業(yè)消費(fèi)者權(quán)益保護(hù)提供一定的完善建議。第六部分為結(jié)語(yǔ),基于上述的分析,保護(hù)快遞服務(wù)中消費(fèi)者權(quán)益,既有法理依據(jù)也有現(xiàn)實(shí)意義,而且有外國(guó)經(jīng)驗(yàn)借鑒,應(yīng)該在此基礎(chǔ)上完善符合我國(guó)國(guó)情的快遞服務(wù)中消費(fèi)者權(quán)益保護(hù)制度,切實(shí)保護(hù)處于弱勢(shì)地位的消費(fèi)者的合法權(quán)益。
[Abstract]:With the rapid development of e-commerce and the rise of the concept of Internet, express delivery industry is growing rapidly. China's express delivery industry has maintained more than double-digit growth for three consecutive years, and the long-term growth rate is more than 50. Since 2016, non-face-to-face transactions through intermediate platforms have soared, driving the industry to further rise and transform. Nowadays, express delivery of goods has become an important part of the daily life of many people, such as the transmission of goods purchased online, documents, bills and so on. However, while consumers enjoy convenient, fast and efficient express service, their rights and interests are repeatedly infringed, which can not be well protected. Protecting the legitimate rights and interests of consumers in express delivery service has not only legal basis, but also practical significance. In this context, from the point of view of protecting the legitimate rights and interests of the consumers in express delivery service, this paper analyzes the reasons for the damage of consumers' rights and interests and the insufficiency of the current protection system, combining with the reality of express delivery industry in China. This paper tries to put forward some feasible and constructive countermeasures in order to give more perfect protection to consumers in express service. The article is divided into six parts to discuss the legal protection of consumers' rights and interests in express delivery service in China. The main contents are as follows: the first part is the introduction, which is the part of the question, this part is mainly for the express industry, consumers, This paper summarizes the concept of service consumption and the protection of consumers' rights and interests in express service, and puts forward in the form of cases that there is widespread infringement of consumers' rights and interests in express delivery industry. However, due to various reasons, it is more difficult for consumers to obtain relief. It is therefore necessary to protect their legitimate rights and interests. The second part is the second chapter of the article, mainly summarizes the protection of the rights and interests of consumers in express delivery services, which mainly includes the economic law and civil law analysis of the protection of the rights and interests of consumers in express delivery services. The present protection measures and the legal relationship of express delivery contract are analyzed and their shortcomings are pointed out. The third part is the third chapter of the article, mainly discusses the current situation of courier service consumer rights and interests protection. This paper analyzes the main situation of infringing on consumers' rights and interests by express delivery service, and analyzes the reasons why consumers' legitimate rights and interests are frequently infringed in express service. The fourth part is the fourth chapter of the article, the main reference and reference for the express delivery service consumer rights and interests protection legislation and regulatory system and other relevant provisions. This chapter mainly refers to the relevant provisions of the United States and Germany, and puts forward the experience that can be used for reference. The fifth part is the fifth chapter of the article, which is the problem solving part of this paper. It mainly proposes to perfect the system of protecting the rights and interests of express delivery service consumers, which mainly includes perfecting the laws and regulations, perfecting the supervision system of express delivery industry. To reduce the cost of protecting rights, to try out the compulsory micro-insurance system of express service and to protect the personal information of consumers, and so on, in order to provide some perfect suggestions for the protection of consumers' rights and interests in express delivery industry. The sixth part is the conclusion, based on the above analysis, to protect the rights and interests of consumers in express delivery service, both legal basis and practical significance, and foreign experience, On this basis, we should perfect the system of protecting the rights and interests of the consumers in the courier service in accordance with the national conditions of our country, and protect the legitimate rights and interests of the consumers in a weak position.
