【摘要】：跨境數(shù)據(jù)流動的國際規(guī)制已逐漸成為新一輪雙邊、區(qū)域貿易談判的新議題。美國極力倡導貿易數(shù)據(jù)的跨境自由流動,推動TPP成為第一個在"電子商務"章中納入具有約束力的規(guī)制跨境數(shù)據(jù)流動的自由貿易協(xié)定,為未來貿易談判提供了參考。而跨境數(shù)據(jù)流動國際規(guī)制面臨各國數(shù)據(jù)本地化要求的障礙,主要表現(xiàn)為通過國內措施要求數(shù)據(jù)本地化存儲并限制數(shù)據(jù)跨境流動。WTO規(guī)則和TPP協(xié)定在識別數(shù)據(jù)本地化要求中的合法公共政策目標和不合理貿易限制時,存在著適用上的不確定性及適用困難。文章認為,全球治理背景下跨境數(shù)據(jù)流動國際規(guī)制的未來路徑,可以設計為在對數(shù)據(jù)進行分類的前提下,由各國通過談判對分類數(shù)據(jù)加以承諾。中國則應當關注跨境數(shù)據(jù)流動國際規(guī)制的新發(fā)展,完善國內規(guī)制,并積極爭取跨境數(shù)據(jù)流動國際規(guī)制的話語權。
[Abstract]:International regulation of cross-border data flow has gradually become a new issue in bilateral and regional trade negotiations. The United States strongly advocates the free flow of trade data across borders and promotes TPP to become the first free trade agreement to include binding regulation of cross-border data flows in the chapter of "Electronic Commerce", which provides a reference for future trade negotiations. However, the international regulation of cross-border data flow faces the obstacle of countries' data localization requirements. The main manifestation is that domestic measures require local storage of data and restrict the cross-border flow of data. WTO rules and TPP agreements identify legitimate public policy objectives and unreasonable trade restrictions in data localization requirements. There is uncertainty and difficulty in application. The paper holds that the future path of international regulation of cross-border data flow under the background of global governance can be designed as a commitment to the classified data through negotiation by countries on the premise of classifying the data. China should pay attention to the new development of the international regulation of cross-border data flow, perfect the domestic regulation, and actively strive for the voice of the international regulation of cross-border data flow.
