河北省工傷保險一次性補助制度研究

【摘要】:工傷保險是社會保險中較早誕生的險種,是社會保險制度的重要組成部分,而工傷一次性補助制度是我國工傷保險的重要方面之一。隨著我國工傷保險制度不斷完善,河北省工傷保險政策和標(biāo)準(zhǔn)體系也更加完備。工傷保險一次性補助制度最早被提出是在1996年出臺的《企業(yè)職工工傷保險試行辦法》,經(jīng)過二十余年的發(fā)展,一次性補助制度在特定的歷史條件下,在保障工傷職工權(quán)益和執(zhí)行國家工傷保險政策方面發(fā)揮了較大作用。近年來經(jīng)濟不斷發(fā)展,工傷一次性補助制度不斷調(diào)整完善,河北省工傷保險領(lǐng)域繼續(xù)全面深化改革,改善服務(wù)質(zhì)量、提升服務(wù)水平。目前在保障水平、治理冒領(lǐng)騙保現(xiàn)象和減少部分資金支付不到位現(xiàn)象等方面存在較大問題,同人民群眾對工傷保險更加公平以及可持續(xù)發(fā)展的實際需求對比,河北省工傷保險制度的現(xiàn)行體系提供的服務(wù)還有一定差距。經(jīng)過調(diào)查分析,從嚴(yán)密制度設(shè)計、利用新技術(shù)等方面提出了相應(yīng)的對策建議。圍繞工傷一次性補助制度存在的問題,本文參考了河北省的實踐情況,首先梳理了相關(guān)文獻(xiàn),通過國內(nèi)外有關(guān)研究、官方的數(shù)據(jù)和一些學(xué)術(shù)資料,對當(dāng)前一次性補助制度的發(fā)展歷程和學(xué)者們研究的方向進行了較為充分的研究。其次,針對工傷職工,設(shè)計了調(diào)查問卷,從直觀上獲取關(guān)于一次性補助制度的現(xiàn)狀和存在的問題,同時做了針對制度的滿意度調(diào)查,通過對滿意度的分析哪里是工傷職工不滿意的地方,進而在分析問題和解決問題上做到有的放矢。第三,設(shè)計了針對工傷職工、經(jīng)辦機構(gòu)人員和工傷康復(fù)醫(yī)務(wù)人員的訪談。通過訪談,從三個角度觀察了一次性補助制度存在的問題、原因和解決方法。再有引入了現(xiàn)實案例,直觀生動的分析,同時增強說服力,通過這些資料推動研究進一步深入。通過對問卷、訪談和案例的分析發(fā)現(xiàn),在社會經(jīng)濟迅速發(fā)展、信息技術(shù)不斷普及的背景下,當(dāng)前河北省工傷一次性補助制度運行的確存在一些較為突出的問題。主要有一次性補助的金額難以滿足工傷職工需求,尤其是多次復(fù)發(fā)的舊傷治療需求;部分企業(yè)和職工為了牟利騙取一次性補助金;經(jīng)辦部門方面,對工傷職工的傷情追蹤機制建設(shè)相對滯后等。通過實踐調(diào)查和相關(guān)文獻(xiàn),分析了問題產(chǎn)生的原因,發(fā)現(xiàn)工傷職工舊傷復(fù)發(fā)后目前的一次性補助標(biāo)準(zhǔn)是難以滿足治療需要的,因此根本的解決辦法是探索新機制,使工傷職工舊傷復(fù)發(fā)后依然受到工傷保險基金保障。在病情監(jiān)控方面,重視信息化建設(shè),依托社會保障卡系統(tǒng)建立追蹤治療系統(tǒng)。針對部分不同程度的騙保行為,應(yīng)當(dāng)嚴(yán)密制度設(shè)計,使補助金的發(fā)放和領(lǐng)取都在嚴(yán)密的制度中運行。對于企業(yè)應(yīng)當(dāng)支付的一次性傷殘就業(yè)補助金的拖欠問題,政府應(yīng)當(dāng)使用“看得見的手”,用法律和政策等規(guī)制手段,鼓勵和引導(dǎo)企業(yè)按時足額支付。
[Abstract]:Industrial injury insurance is the early birth of the social insurance, is an important part of the social insurance system, and the one-off injury compensation system is one of the important aspects of industrial injury insurance in China. With the continuous improvement of industrial injury insurance system in China, Hebei Province industrial injury insurance policy and standard system is more complete. The system of one-off compensation for industrial injury insurance was first put forward in 1996, "measures for trial implementation of Industrial injury Insurance for Enterprise employees". After more than 20 years of development, the one-off subsidy system is under specific historical conditions. In the protection of the rights and interests of industrial injury workers and the implementation of national industrial injury insurance policy has played a greater role. In recent years, the economy has been developing and the system of one-off compensation for work-related injuries has been continuously adjusted and perfected. In Hebei Province, the field of industrial injury insurance continues to deepen overall reform, improve the quality of service and raise the level of service. At present, there are major problems in terms of the level of security, the prevention of fraud and the reduction of inadequate payment of some funds, comparing with the actual demand of the masses for more equitable and sustainable development of industrial injury insurance. Hebei Province the current system of industrial injury insurance system to provide services there is a certain gap. Through investigation and analysis, this paper puts forward corresponding countermeasures and suggestions from the aspects of strict system design and utilization of new technology. Based on the problems existing in the system of one-off compensation for work-related injuries, this paper refers to the practice in Hebei Province, and firstly combs the relevant literature, through relevant studies at home and abroad, official data and some academic materials. The development course of the current one-time subsidy system and the research direction of scholars are fully studied. Secondly, the questionnaire is designed to obtain the current situation and existing problems of the one-off subsidy system, and at the same time, the satisfaction survey of the system is done. Through the analysis of satisfaction where the injured workers are not satisfied, and then in the analysis of problems and solutions to achieve a targeted. Third, designed for the injured workers, agencies and rehabilitation medical staff interviews. Through interviews, the problems, causes and solutions of one-time subsidy system are observed from three angles. Then it introduces real cases, intuitionistic and vivid analysis, and strengthens the persuasion, through which the research can be further studied. Through questionnaire, interview and case analysis, it is found that under the background of the rapid development of social economy and the constant popularization of information technology, there are some outstanding problems in the operation of the one-off compensation system for work-related injuries in Hebei Province. There are mainly one-off subsidies that are difficult to meet the needs of workers at work injuries, especially the needs for treatment of old injuries that recur many times; some enterprises and workers defraud one-time subsidies for profit; in the administrative departments, To the injury worker's injury tracking mechanism construction relatively lags behind and so on. Through practical investigation and related literature, this paper analyzes the causes of the problem, and finds that the current standard of one-time subsidy after the recurrence of old injury is difficult to meet the need of treatment, so the fundamental solution is to explore new mechanism. Make inductrial injury worker old injury relapse still be protected by inductrial injury insurance fund. In the aspect of disease monitoring, we should pay attention to the information construction and build up the tracking and treatment system based on the social security card system. In view of some different degree of fraud and protection behavior, strict system should be designed to make the payment and receipt of subsidies run in a strict system. The government should use the "visible hand" and other regulatory means to encourage and guide the enterprises to pay in full and on time.
