【摘要】：早在100多年前恩格斯在《家庭私有制和國家起源》一書中提到：“歷史中的決定因素歸根結(jié)底是直接生活的生產(chǎn)和再生產(chǎn)。但是生產(chǎn)本身又有兩種：一方面是生活資料，即食物、衣服、住房以及為此所必需的工具的生產(chǎn)；另一方面是人類自身的生產(chǎn)，即種的繁衍。生育作為重要的社會要素，在整個人類文明的發(fā)展中起著不可代替的作用。生育不僅起著延續(xù)后代，提高人口素質(zhì)的作用，同時也保證了社會勞動力的再生產(chǎn)。對婦女生育權(quán)益的保護就顯得格外的重要。我國現(xiàn)行的生育保險制度主要保障對象還是城鎮(zhèn)婦女，而占我國婦女人數(shù)比重較大的農(nóng)村婦女的權(quán)益得不到保障，這不僅是一種社會的不公平，同時影響了我國農(nóng)業(yè)勞動力的穩(wěn)定和整個社會的發(fā)展。 本文以農(nóng)村生育保險制度的構(gòu)建為題，對在我國構(gòu)建農(nóng)村生育保險做以下幾個方面的探討。 在第一部分“生育保險法律制度的基本理論”中，首先概述了生育保險制度，在此基礎(chǔ)上闡述了我國生育保險制度的建立和發(fā)展以及農(nóng)村婦女生育保障的現(xiàn)狀，旨在明確我國生育保險制度的不足。 第二部分主要分析了我國構(gòu)建農(nóng)村生育保險制度的可行性和必要性。首先從“農(nóng)村生育保險法律制度的價值”和“我國建立農(nóng)村生育保險制度的原因”兩個方面對必要性進行了分析。其次，從經(jīng)濟基礎(chǔ)和國家政策兩方面對可行性進行了詳細的分析。 第三部分論述了國外與生育保險相關(guān)的法律制度的啟示，筆者對外國與生育保險相關(guān)的法律制度進行了宏觀上的分析，主要從監(jiān)督機制、管理機構(gòu)、覆蓋范圍、基金投資運營四個方面進行了比較分析，并分別揭示了對我國農(nóng)村生育保險制度構(gòu)建的啟示。 第四部分是“我國農(nóng)村生育保險制度的構(gòu)建”，，首先提出了基本思路，然后提出了構(gòu)建我國農(nóng)村生育保險制度時應(yīng)堅持的原則，進而提出在構(gòu)建我國農(nóng)村生育保險制度的具體法律框架：農(nóng)村生育保險的對象、生育保險基金的籌集、基金的保值增值、基金的管理與運營模式、基金的監(jiān)管機制、繳費標準和生育保險待遇。
[Abstract]:As early as more than 100 years ago Engels mentioned in his book Family Private ownership and the Origin of the State: "the determinants of history are, in the final analysis, the production and reproduction of direct life." But there are two kinds of production itself: on the one hand, the production of food, clothing, housing and the necessary tools for this; on the other hand, the production of mankind itself, that is, the reproduction of species. Fertility, as an important social factor, plays an irreplaceable role in the development of human civilization. Fertility not only continues the offspring and improves the quality of the population, but also ensures the reproduction of the social labor force. The protection of women's reproductive rights and interests is particularly important. The current maternity insurance system in China is mainly aimed at urban women, but the rights and interests of rural women, who account for a large proportion of women in our country, are not protected. This is not only a social injustice. At the same time affected the stability of China's agricultural labor force and the development of society as a whole. Based on the construction of rural birth insurance system, this paper probes into the construction of rural birth insurance in China. In the first part, "the basic Theory of the legal system of Maternity Insurance", the author first outlines the maternity insurance system, and on this basis expounds the establishment and development of the maternity insurance system in China and the present situation of the maternity protection for rural women. The purpose is to clarify the deficiency of our country's birth insurance system. The second part mainly analyzes the feasibility and necessity of constructing the rural birth insurance system in China. Firstly, the necessity is analyzed from two aspects: the value of the legal system of rural maternity insurance and the reasons for establishing the rural maternity insurance system in China. Secondly, the feasibility is analyzed in detail from the two aspects of economic base and national policy. The third part discusses the enlightenment of the foreign legal system related to the birth insurance. The author carries on the macroscopic analysis to the foreign legal system related to the birth insurance, mainly from the supervision mechanism, the management organization, the coverage scope, This paper makes a comparative analysis on four aspects of fund investment and operation, and reveals the enlightenment to the construction of rural birth insurance system in China. The fourth part is the construction of the rural birth insurance system in our country. It first puts forward the basic ideas, and then puts forward the principles that should be adhered to when constructing the rural birth insurance system in our country. Then it puts forward the concrete legal framework of constructing the rural maternity insurance system in our country: the object of the rural birth insurance, the raising of the maternity insurance fund, the maintenance and increment of the fund, the management and operation mode of the fund, the supervision mechanism of the fund.
