論虛擬財產(chǎn)責任保險開發(fā)

【摘要】:據(jù)中國互聯(lián)網(wǎng)信息中心統(tǒng)計,截止到2012年12月底,中國互聯(lián)網(wǎng)用戶普及率已經(jīng)達到42.1%,中國互聯(lián)網(wǎng)用戶規(guī)模達到5.64億人,其中網(wǎng)絡游戲用戶規(guī)模達到3.36億人,占比達59.57%。而網(wǎng)絡游戲玩家在網(wǎng)絡游戲中面臨多重風險,面對3.36億人的巨大潛在市場,虛擬財產(chǎn)責任保險業(yè)務作為一項新開發(fā)的險種也應運而生。 本文采取案例分析的形式,主要分為以下五個部分: 第一部分為緒論,簡要介紹本文的研究背景、研究目的及意義、相關研究情況、研究內容與方法、創(chuàng)新與不足之處。 第二部分為案例描述,介紹2003年由北京市朝陽區(qū)法院受理的我國首例網(wǎng)絡游戲虛擬財產(chǎn)糾紛案的基本情況,并說明法院判決結果及判決依據(jù)。 第三部分為案例分析,首先對本文中所涉及的虛擬財產(chǎn)做出定義。然后主要分析了網(wǎng)絡游戲中面臨的主要風險、網(wǎng)絡游戲運營商責任是否具有可保利益,并在此基礎上引出本文的主要分析對象——網(wǎng)絡游戲運營商用戶損失責任險。其中,網(wǎng)絡游戲中面臨的主要風險有網(wǎng)絡游戲中止運營的風險、網(wǎng)絡游戲中貨幣通貨膨脹的風險、網(wǎng)絡游戲賬戶被盜被騙的風險、網(wǎng)絡游戲玩家電腦中病毒的風險以及相關的民事?lián)p害責任風險。網(wǎng)絡游戲運營商責任的可保利益分析依據(jù)是可保利益的定義及條件,即通過分析網(wǎng)絡游戲運營商責任的相關利益是否是合法的利益、是否是確定的利益、是否是經(jīng)濟上的利益這三點來說明網(wǎng)絡游戲運營商責任具有可保利益。 第四部分為虛擬財產(chǎn)責任保險的發(fā)展前景及對策,,介紹我國網(wǎng)絡游戲產(chǎn)業(yè)發(fā)展史,簡要介紹了韓國、香港以及臺灣地區(qū)對虛擬財產(chǎn)的保護,最后提出我國虛擬財產(chǎn)保護的最大障礙在于虛擬財產(chǎn)沒有明確的法律定位,提出了一些針對網(wǎng)絡虛擬財產(chǎn)立法方面的建議。 第五部分為結束語。 隨著我國網(wǎng)絡游戲產(chǎn)業(yè)的不斷發(fā)展,虛擬財產(chǎn)責任保險將成為保險業(yè)的一個新增長點,值得期待。
[Abstract]:According to the China Internet Information Center, by the end of December 2012, the penetration rate of Internet users in China had reached 42.1 percent, with the number of Internet users in China reaching 564 million, including 336 million users of online games, accounting for 59.57 percent. The online game players face multiple risks in the online games, facing the huge potential market of 336 million people, virtual property liability insurance business as a newly developed insurance also came into being. This paper takes the form of case analysis, mainly divided into the following five parts: the first part is the introduction, briefly introduces the research background, research purpose and significance, related research situation, research content and methods, Innovation and inadequacies. The second part is the case description, which introduces the basic situation of the first online game virtual property dispute case accepted by the court of Chaoyang District of Beijing in 2003, and explains the judgment result and judgment basis of the court. The third part is a case study, first of all, the definition of virtual property involved in this paper. Then it mainly analyzes the main risks in the online game, whether the liability of the online game operator has insurable interest, and then leads to the main analysis object of this article-the user loss liability insurance of the online game operator. Among them, the main risks faced by online games include the risk of suspending the operation of online games, the risk of currency inflation in online games, and the risk of online game accounts being stolen and cheated. The risk of virus and related civil liability risk in the computer of online game player. The analysis of insurable interests of online game operators is based on the definition and conditions of insurable interests, that is, whether the related interests of online game operators are legal or not, whether they are determined interests. Whether is the economic benefit this three points to explain the network game operator responsibility has the insurable interest. The fourth part is the development prospect and countermeasures of virtual property liability insurance, introduces the history of online game industry in China, and briefly introduces the protection of virtual property in Korea, Hong Kong and Taiwan. Finally, the author points out that the biggest obstacle to the protection of virtual property in our country lies in the lack of clear legal orientation of virtual property, and puts forward some suggestions on the legislation of virtual property on the network. The fifth part is the conclusion. With the continuous development of online game industry in China, virtual property liability insurance will become a new growth point of the insurance industry, which is worth looking forward to.
