【摘要】：當(dāng)前我國(guó)一些地區(qū)環(huán)境污染責(zé)任保險(xiǎn)開始出現(xiàn)投保企業(yè)數(shù)量下降情況,同時(shí)保險(xiǎn)賠付率過(guò)低,產(chǎn)品風(fēng)險(xiǎn)保障功能不強(qiáng),風(fēng)險(xiǎn)服務(wù)差異大等問(wèn)題突出,究其原因主要是我國(guó)環(huán)境污染責(zé)任保險(xiǎn)試點(diǎn)缺乏上位法依據(jù),環(huán)境污染責(zé)任保險(xiǎn)投保企業(yè)數(shù)量受地方環(huán)保部門的工作方式、領(lǐng)導(dǎo)人風(fēng)格等影響較大。今后應(yīng)按照中央提出的在環(huán)境高風(fēng)險(xiǎn)領(lǐng)域建立環(huán)境污染強(qiáng)制責(zé)任保險(xiǎn)制度的要求,充分學(xué)習(xí)和借鑒發(fā)達(dá)國(guó)家經(jīng)驗(yàn),加強(qiáng)推動(dòng)環(huán)境污染強(qiáng)制責(zé)任保險(xiǎn)法律法規(guī)制定,明確強(qiáng)制保險(xiǎn)范圍和手段,體現(xiàn)政策的公平性和合法性。
[Abstract]:At present, in some areas of our country, the number of insured enterprises has begun to decline, and the insurance compensation rate is too low, the function of product risk protection is not strong, the risk service is different, and so on. The main reason is that the environmental pollution liability insurance in our country lacks the upper legal basis, and the number of environmental pollution liability insurance enterprises is greatly affected by the working methods of local environmental protection departments and the style of leaders. In the future, in accordance with the request of the central authorities to establish a compulsory liability insurance system for environmental pollution in areas with high environmental risks, we should fully study and learn from the experiences of developed countries, and strengthen the promotion of the enactment of laws and regulations on compulsory liability insurance for environmental pollution. Define the scope and means of compulsory insurance to reflect the fairness and legitimacy of the policy.
