【摘要】：近年來(lái),全球環(huán)境污染問(wèn)題日益嚴(yán)峻,霧霾等惡劣天氣已逐漸給人們的身心造成嚴(yán)重傷害。隨著法制的不斷完善,人們對(duì)環(huán)境污染侵權(quán)責(zé)任的認(rèn)識(shí)也不斷加深,環(huán)境污染責(zé)任保險(xiǎn)受到了廣泛關(guān)注。2008年,我國(guó)開始在江蘇、湖南、湖北、河南、重慶、深圳、寧波和沈陽(yáng)等地開展環(huán)境污染責(zé)任保險(xiǎn)試點(diǎn)工作,但該工作一直未取得有效進(jìn)展。廣西作為我國(guó)西部省區(qū),經(jīng)濟(jì)發(fā)展相對(duì)落后,使得環(huán)責(zé)險(xiǎn)的開展工作備受艱難。為此,研究廣西環(huán)境污染責(zé)任強(qiáng)制險(xiǎn)時(shí)不我待、意義重大。 本文首先收集了國(guó)內(nèi)外關(guān)于強(qiáng)制險(xiǎn)和環(huán)責(zé)險(xiǎn)的大量研究報(bào)告,并對(duì)環(huán)境污染責(zé)任保險(xiǎn)的內(nèi)涵和功能等進(jìn)行了分析描述。其次,研究了美國(guó)、瑞典、德國(guó)、英法等西方發(fā)達(dá)國(guó)家經(jīng)營(yíng)環(huán)責(zé)險(xiǎn)的實(shí)踐過(guò)程及經(jīng)驗(yàn),分析了我國(guó)首次試點(diǎn)環(huán)責(zé)險(xiǎn)的省市——廣東、湖南、湖北、河北和江蘇的經(jīng)營(yíng)狀況。在此基礎(chǔ)上,本文對(duì)國(guó)內(nèi)外環(huán)境污染責(zé)任保險(xiǎn)的經(jīng)營(yíng)狀況進(jìn)行了對(duì)比研究,分析了造成兩者差距的主要原因,并指出了值得學(xué)習(xí)的相關(guān)經(jīng)驗(yàn)。本文還指出廣西環(huán)境污染風(fēng)險(xiǎn)敞口主要來(lái)自于重金屬污染、海洋污染和生活垃圾污染等風(fēng)險(xiǎn),并分析了這些風(fēng)險(xiǎn)在廣西的地域分布情況。最后,借鑒國(guó)內(nèi)外優(yōu)秀理論和經(jīng)驗(yàn),結(jié)合廣西自身的環(huán)境風(fēng)險(xiǎn)敞口、高危企業(yè)的經(jīng)營(yíng)狀況及地域分布等特點(diǎn),提出了設(shè)計(jì)符合廣西自身需求的環(huán)境污染責(zé)任強(qiáng)制保險(xiǎn),并對(duì)保險(xiǎn)主體(政府、保險(xiǎn)人、被保險(xiǎn)人)各自扮演的角色、作用和要求；保險(xiǎn)內(nèi)容(承保范圍、責(zé)任限額和免賠額、索賠時(shí)效、保費(fèi)厘定)的設(shè)計(jì)原則與注意事項(xiàng)；保險(xiǎn)種類及各種配套機(jī)制等進(jìn)行了深入剖析。
[Abstract]:In recent years, the problem of global environmental pollution is becoming more and more serious, and severe weather such as haze has caused serious damage to people's body and mind. With the continuous improvement of legal system, people's understanding of tort liability for environmental pollution has been deepened. In 2008, China began to carry out the pilot work of environmental pollution liability insurance in Jiangsu, Hunan, Hubei, Henan, Chongqing, Shenzhen, Ningbo and Shenyang. However, this work has not made any effective progress. Guangxi, as a western province of China, is relatively backward in economic development, which makes the development of environmental liability insurance very difficult. Therefore, it is of great significance to study the compulsory insurance of environmental pollution liability in Guangxi. This paper first collected a large number of research reports on compulsory insurance and environmental liability insurance at home and abroad, and analyzed and described the connotation and function of environmental pollution liability insurance. Secondly, it studied the United States, Sweden, Germany, etc. The practical process and experience of the management of environmental liability insurance in western developed countries, such as Britain and France, are analyzed. Based on this, the operating situation of Guangdong, Hunan, Hubei, Hebei and Jiangsu provinces and cities of China's first pilot environmental liability insurance is analyzed. This paper makes a comparative study on the operating conditions of liability insurance for environmental pollution at home and abroad, and analyzes the main reasons for the gap between the two. The paper also points out that the exposure to environmental pollution in Guangxi mainly comes from the risks of heavy metal pollution, marine pollution and domestic refuse pollution, and analyzes the regional distribution of these risks in Guangxi. Based on the excellent theory and experience at home and abroad, combined with the characteristics of Guangxi's own environmental risk exposure, the management status and regional distribution of high-risk enterprises, the design of compulsory liability insurance for environmental pollution in accordance with Guangxi's own needs is put forward. And the main body (government, insurer, insured) of the role, role and requirements, insurance content (coverage, liability limit and deductible amount, limitation of claims, premium determination) design principles and matters needing attention; The types of insurance and various supporting mechanisms are deeply analyzed.
