我國道路交通事故社會救助基金制度研究

【摘要】:隨著我國經(jīng)濟(jì)社會持續(xù)快速發(fā)展,機動車開始進(jìn)入普通百姓家,日漸成為人們較為普遍的出行工具。據(jù)公安部交管局統(tǒng)計,截至2016年8月底,全國機動車保有量達(dá)2.82億輛,其中汽車(含三輪汽車和低速載貨汽車)1.86億輛。我國機動車保有量的迅速增長在推動經(jīng)濟(jì)快速發(fā)展和給人們生產(chǎn)生活帶來便利的同時,也進(jìn)一步加大了人、車、路之間的矛盾,為交通事故的發(fā)生埋下極大的安全隱患,我國道路交通事故數(shù)量也呈現(xiàn)逐年增加趨勢。2003年全國交通事故數(shù)量約為6.7萬起,到2014年這個數(shù)據(jù)已迅速攀升到19.6萬。2013年,我國因交通事故死亡58539人,受傷213724人。2014年,我國因交通事故死亡58523人,受傷211882人。交通事故傷亡人數(shù)居高不下,交通事故給人們生命健康造成的危害可見一斑。機動車數(shù)量的大量增加一方面凸顯了我國經(jīng)濟(jì)、社會建設(shè)的巨大成就,但也預(yù)示著在相當(dāng)長的一段時間內(nèi)交通事故多發(fā)現(xiàn)狀不會得到明顯改善。大量交通事故的背后是千千萬萬無法得到及時救治的受害人,這一部分人有著強烈的獲得補償和救助的需求,針對道路交通事故受害人建立一個長期而高效的救助體系已是迫在眉睫。這種情況下,道路交通事故社會救助基金制度應(yīng)運而生。如果僅從表面上看,我國似乎已經(jīng)逐步建立了完善的道路交通事故社會救助基金制度。《道路交通安全法》、《機動車交通事故責(zé)任強制保險條例》、《道路交通事故社會救助基金管理試行辦法》對道路交通事故救助基金的管理機構(gòu)、基金的來源、墊付、追償?shù)软椖窟M(jìn)行了規(guī)定。但筆者看來,道路交通事故救助基金制度在我國還遠(yuǎn)談不上建立。首先,《道路交通事故社會救助基金管理試行辦法》將設(shè)立道路交通事故社會救助基金的具體職責(zé)授權(quán)給各級省政府。由于我國不同省份、地區(qū)之間發(fā)展不平衡,各地很可能在救助基金的制度建設(shè)和實施上有所不同,甚至救助基金在很多省市可能就是一個空殼,不能保證救助基金制度在全國的統(tǒng)一性。其次,《道路交通事故社會救助基金管理試行辦法》只是對基金的管理、籌集、使用、追償?shù)葐栴}進(jìn)行了原則上的規(guī)定,在實際操作過程中可能面臨無法可依的窘境。所以我國離真正建立救助基金制度還有相當(dāng)長的距離。本文將討論我國現(xiàn)行救助基金的制度及其理論基礎(chǔ),發(fā)現(xiàn)我國關(guān)于救助基金制度不足,通過借鑒發(fā)達(dá)國家和地區(qū)的先進(jìn)經(jīng)驗,并結(jié)合我國的實際情況,提出切實可行的改善建議。
[Abstract]:With the sustained and rapid economic and social development of our country, motor vehicles have begun to enter the homes of ordinary people and become more and more popular means of travel. According to statistics from the Traffic Administration of the Ministry of Public Security, by the end of August 2016, the number of motor vehicles in the country had reached 282 million. Of these, 186 million vehicles (including three-wheeled vehicles and low-speed cargo vehicles). The rapid growth in the number of motor vehicles in China has promoted the rapid economic development and brought convenience to people's production and living, and at the same time has further increased the contradictions between people, cars, and roads. For the occurrence of traffic accidents, the number of road traffic accidents in China has been increasing year by year. In 2003, the number of traffic accidents in China was about 67,000. By 2014, the number of traffic accidents had climbed rapidly to 196,000. 2013. 58539 people were killed and 213724 injured in traffic accidents in China. In 2014, 58523 people died and 211882 were injured in traffic accidents. Traffic accidents do harm to people's lives and health. On the one hand, the huge increase in the number of motor vehicles highlights the great achievements in our country's economic and social construction. But it also indicates that the situation of traffic accidents will not be significantly improved for a long time. Behind a large number of traffic accidents are thousands of victims who cannot be treated in time. This part of the population has a strong need for compensation and relief. It is urgent to establish a long-term and efficient relief system for the victims of road traffic accidents. The Social Relief Fund for Road Traffic Accidents came into being. It seems that China has gradually established a perfect social rescue fund system for road traffic accidents. The Law on Road Traffic Safety, the regulations on compulsory Insurance for Motor vehicle Traffic Accidents, and the trial Office for the Administration of Social Relief Fund for Road Traffic Accidents. Law on the Administration of the Road Traffic accident Relief Fund, The source of the fund, advance payment, recovery and other items have been specified. But the author seems, The system of road traffic accident rescue fund is still far from being established in our country. First of all, the measures for the management of social rescue fund for road traffic accident will authorize the specific responsibility of setting up the social rescue fund for road traffic accident to all levels. The provincial government. Because of the different provinces of our country, The development between regions is uneven, and it is very likely that various regions will be different in terms of the system construction and implementation of the rescue fund. Even the rescue fund may be a shell in many provinces and cities. There is no guarantee of the unity of the relief fund system in the whole country. Secondly, the "measures for the Administration of Social Relief Fund for Road Traffic Accidents" only provides in principle for the management, collection, use and recovery of the fund. In the course of practical operation, we may be faced with a dilemma that can not be relied on. So, our country is still a long way from establishing the rescue fund system. This paper will discuss the current system of rescue fund and its theoretical basis in our country. It is found that the system of rescue fund is not enough in our country. By using the advanced experience of developed countries and regions for reference and combining the actual situation of our country, some practical suggestions for improvement are put forward.
