【摘要】：在市場經(jīng)濟條件下,巨災保險制度才是應對巨災風險的最佳方案。項目試點、域外立法、理論研究、金融創(chuàng)新等均為我國巨災保險立法提供了可行性基礎。對有普遍分布性的巨災風險,可分別制定專項巨災保險條例;對地區(qū)分布特征明顯的巨災風險,各地可根據(jù)本區(qū)域風險情況制定地區(qū)性專項風險巨災保險法規(guī)和規(guī)章。巨災保險應結合使用多種運行方式,商業(yè)性全國專項巨災保險宜以自愿保險方式推行,高風險地區(qū)的專項巨災保險,應實施政策性保險,地方立法強制投保,或以半強制方式推行。針對不同風險和不同地區(qū)的實際情況,設置保險損失分擔機制。
[Abstract]:Under the condition of market economy, catastrophe insurance system is the best scheme to deal with catastrophe risk. Financial innovation and so on have provided the feasibility foundation for our country catastrophe insurance legislation. For the catastrophe risk which has the universal distribution, may separately formulate the special catastrophe insurance regulation; for the region distribution characteristic obvious catastrophe risk, All localities may formulate laws and regulations for regional special risk catastrophe insurance according to the risk situation in the region. Catastrophe insurance shall be operated in combination with various modes of operation, and commercial nationwide special catastrophe insurance should be carried out on a voluntary basis. The special catastrophe insurance in high risk areas should be insured by policy, compulsory insurance by local legislation, or by semi-compulsory way. According to the actual situation of different risks and different regions, the mechanism of insurance loss sharing should be set up.
