【摘要】：構(gòu)建蘊(yùn)含中國(guó)理念的知識(shí)產(chǎn)權(quán)國(guó)際秩序是中國(guó)參與全球治理的主要體現(xiàn),也是中國(guó)智造走出去的重要保障�，F(xiàn)有知識(shí)產(chǎn)權(quán)國(guó)際秩序由于歷史原因造成私權(quán)利益與公共利益間的失衡,加之信息網(wǎng)絡(luò)革命對(duì)傳統(tǒng)知識(shí)產(chǎn)權(quán)秩序提出挑戰(zhàn),對(duì)原有秩序進(jìn)行調(diào)整成為時(shí)代需求。中國(guó)作為世界第二大經(jīng)濟(jì)體,應(yīng)當(dāng)在新一輪知識(shí)產(chǎn)權(quán)國(guó)際秩序構(gòu)建中發(fā)揮影響力,推出中國(guó)理念國(guó)際知識(shí)產(chǎn)權(quán)規(guī)則。本文認(rèn)為,中國(guó)理念的知識(shí)產(chǎn)權(quán)國(guó)際秩序應(yīng)當(dāng)具有發(fā)展觀、均衡觀和融通觀,它應(yīng)當(dāng)能夠促進(jìn)人類(lèi)整體的可持續(xù)發(fā)展,實(shí)現(xiàn)私權(quán)利益與公共利益均衡,在不同國(guó)際領(lǐng)域內(nèi)確立融通一致的知識(shí)產(chǎn)權(quán)規(guī)則。構(gòu)建蘊(yùn)含中國(guó)理念的知識(shí)產(chǎn)權(quán)國(guó)際秩序可以通過(guò)借助多元化國(guó)際組織平臺(tái)、締結(jié)體現(xiàn)中國(guó)理念的地區(qū)合作協(xié)定以及發(fā)揮WTO爭(zhēng)端解決機(jī)制解釋功能等路徑得以實(shí)現(xiàn)。
[Abstract]:The construction of an international order of intellectual property rights, which contains Chinese ideas, is the main embodiment of China's participation in global governance. The existing international order of intellectual property rights has caused the imbalance between private rights interests and public interests due to historical reasons, and the information network revolution has challenged the traditional intellectual property rights order. As the second largest economy in the world, China, as the second largest economy in the world, should exert its influence in the construction of a new international order of intellectual property rights and introduce the rules of international intellectual property rights of Chinese ideas. The international order of intellectual property of Chinese concept should have the view of development, balance and integration, and it should promote the sustainable development of human being as a whole and realize the balance between private rights and public interests. Establishing consistent rules on intellectual property rights in different international fields. Building an international order of intellectual property rights with Chinese ideas can be achieved through the help of a diversified international organization platform. Conclusion of regional cooperation agreement embodying China's concept and exerting the interpretation function of WTO dispute settlement mechanism can be realized.
