我國(guó)幼兒園教師權(quán)益保障法規(guī)研究

【摘要】:隨著近年我國(guó)對(duì)學(xué)前教育事業(yè)的重視,學(xué)前教育的發(fā)展取得了重大的成績(jī)。學(xué)前教育立法方面也在緊跟時(shí)代步伐,往前發(fā)展。教師作為學(xué)前教育事業(yè)中的重要一環(huán),其相關(guān)權(quán)益保障的法規(guī)體系的建立,關(guān)系到幼兒教師的切身利益。本研究著眼于幼兒園中幼兒教師權(quán)益保障的相關(guān)法規(guī)文件,從而發(fā)現(xiàn)其中發(fā)展的特點(diǎn)以及不足之處,為我國(guó)學(xué)前教育法制化發(fā)展提供一定的借鑒之處。 本研究主要分為以下幾個(gè)部分: 第一部分,緒論部分。這部分闡述了本研究的意義、研究文獻(xiàn)綜述以及本研究所采用的研究方法。 第二部分,我國(guó)幼兒教師權(quán)益保障相關(guān)法規(guī)的演變。在本部分之中,本研究以時(shí)間為線索,分別闡述了建國(guó)之前、建國(guó)至2010年、2010年至今這三個(gè)時(shí)期我國(guó)相關(guān)法規(guī)的發(fā)展歷程,并概括了其發(fā)展的特點(diǎn)。 第三部分,我國(guó)幼兒教師權(quán)益保障法規(guī)的內(nèi)容體系分析。通過(guò)整理相關(guān)法規(guī),得出幼兒教師的合法權(quán)益包括合法權(quán)利以及合法利益,并做出相關(guān)解釋與闡述。 第四部分,我國(guó)幼兒教師權(quán)益保障相關(guān)法規(guī)的實(shí)效性分析。本部分著眼于相關(guān)法規(guī)在實(shí)際效用中所發(fā)揮出的作用,并且總結(jié)概括出其進(jìn)步之處與不足。 第五部分,造成我國(guó)幼兒教師合法權(quán)益相關(guān)法規(guī)不完善的原因。時(shí)代在進(jìn)步,相關(guān)法規(guī)在發(fā)展過(guò)程之中,體現(xiàn)出了它的不足之處,通過(guò)文本與現(xiàn)實(shí)分析,得出其不完善的原因。 第六部分,現(xiàn)行幼兒教師權(quán)益保障相關(guān)法規(guī)應(yīng)該改進(jìn)之處。本部分針對(duì)其不足之處,提出一定的改進(jìn)意見,從而完善相關(guān)法規(guī)的發(fā)展。 第七部分,幼兒教師權(quán)益保障相關(guān)法規(guī)的未來(lái)展望。幼兒教師權(quán)益保障相關(guān)法規(guī)的成熟是社會(huì)發(fā)展的必然性的結(jié)果。在該部分通過(guò)展望其未來(lái)發(fā)展,從而為我們幼兒教師權(quán)益相關(guān)法規(guī)的發(fā)展提供一定發(fā)展方向。
[Abstract]:With the importance of preschool education in recent years, the development of preschool education has made great achievements. Pre-school education legislation is also keeping pace with the times, moving forward. Teachers as an important part of preschool education, the establishment of relevant rights and interests protection of the legal system, related to the immediate interests of preschool teachers. This study focuses on the relevant legal documents of the protection of the rights and interests of preschool teachers in kindergartens, and finds out the characteristics and shortcomings of the development, and provides some references for the legalization development of preschool education in China. This study is divided into the following parts: The first part, the introduction part. This part describes the significance of this study, research literature review and research methods used in this study. The second part, the evolution of the relevant laws and regulations on the protection of the rights and interests of preschool teachers in China. In this part, this research takes time as the clue, respectively elaborated the development course of the relevant laws and regulations of our country before the founding of the people's Republic of China, from the founding of the people's Republic of China to 2010, 2010 to the present, and summarized the characteristics of its development. The third part, the content system analysis of the law of protecting the rights and interests of preschool teachers in our country. Through sorting out the relevant laws and regulations, the author draws the conclusion that the legal rights and interests of preschool teachers include the legal rights and interests, and makes the relevant explanation and elaboration. The fourth part, the effectiveness of the relevant laws and regulations on the protection of the rights and interests of preschool teachers in China. This part focuses on the role of relevant laws and regulations in the practical utility, and summarizes its progress and shortcomings. The fifth part, causes our country preschool teacher legal rights and interests related laws and regulations to be imperfect. The times are progressing, and the relevant laws and regulations are in the process of development, reflecting its shortcomings. Through text and reality analysis, the causes of its imperfection are obtained. The sixth part, the current infant teacher rights and interests protection related laws and regulations should be improved. According to its shortcomings, this part puts forward some suggestions to improve the development of relevant laws and regulations. The seventh part, the future outlook of the relevant laws and regulations on the protection of the rights and interests of preschool teachers. The maturity of the relevant laws and regulations on the protection of the rights and interests of preschool teachers is the inevitable result of social development. In this part, by looking forward to its future development, it provides a certain development direction for the development of relevant laws and regulations on the rights and interests of preschool teachers.
