【摘要】：高等學(xué)校學(xué)生的合法權(quán)利是公民基本人權(quán)的重要內(nèi)容和重要組成部分。我國(guó)現(xiàn)行法律中確認(rèn)了高等院校學(xué)生享有廣泛的權(quán)利,除了只限定成年公民享有的選舉權(quán)與被選舉權(quán)外,其他所有法律規(guī)定的公民權(quán)利對(duì)學(xué)生都是適用的。目前,我國(guó)高等學(xué)校的學(xué)生權(quán)利無(wú)論是權(quán)利種類、數(shù)量,還是權(quán)利的實(shí)際落實(shí)情況,都有了長(zhǎng)足的進(jìn)步。但就總體而言,依然無(wú)法令人樂觀,從某種意義而言,高校學(xué)生處于弱勢(shì)地位,在我國(guó)侵犯學(xué)生合法權(quán)利的現(xiàn)象時(shí)有發(fā)生。因此,僅由法律規(guī)定的學(xué)生權(quán)利是遠(yuǎn)遠(yuǎn)不夠的,高等學(xué)校學(xué)生享有的法定權(quán)利必須經(jīng)過(guò)相應(yīng)的措施從而轉(zhuǎn)化為現(xiàn)實(shí),才能真實(shí)并完整的實(shí)現(xiàn)學(xué)生權(quán)利保護(hù),才能具有實(shí)際價(jià)值。 本文主要從高等學(xué)校學(xué)生權(quán)利基本內(nèi)容、高等學(xué)校學(xué)生權(quán)利保護(hù)的歷史與現(xiàn)狀以及高等學(xué)校學(xué)生權(quán)利受損的表現(xiàn)、原因、加強(qiáng)保護(hù)的主要對(duì)策等三個(gè)方面展開研究。 在高等學(xué)校學(xué)生權(quán)利基本內(nèi)容方面,闡述了權(quán)利的一般理論,從理論上分析了高等學(xué)校學(xué)生的角色定位以及高等學(xué)校學(xué)生權(quán)利的主要內(nèi)容。 在高等學(xué)校學(xué)生權(quán)利保護(hù)的歷史與現(xiàn)狀方面,回顧了我國(guó)高等學(xué)校學(xué)生權(quán)利保護(hù)的歷史,并剖析了我國(guó)高等學(xué)校學(xué)生權(quán)利保護(hù)的現(xiàn)狀。 在高等學(xué)校學(xué)生權(quán)利受損的表現(xiàn)、原因以及主要對(duì)策方面,首先闡述并概括了高等學(xué)校學(xué)生權(quán)利受損的表現(xiàn)形式,然后分析導(dǎo)致高等學(xué)校學(xué)生權(quán)利受損的原因,最后提出了加強(qiáng)高等學(xué)校學(xué)生權(quán)利保護(hù)的主要對(duì)策。 高等學(xué)校學(xué)生權(quán)利保護(hù)既是一個(gè)系統(tǒng)工程,又是一個(gè)宏大的現(xiàn)實(shí)課題。涉及到眾多的復(fù)雜內(nèi)容以及在理論上和實(shí)踐中都要深入研究的問題,因個(gè)人所學(xué)的專業(yè)知識(shí)有限,研究能力尚有待提高,僅對(duì)該課題的某一方面進(jìn)行了初步的研究,還有諸多問題有待在以后的學(xué)習(xí)中做進(jìn)一步的研究和探索。
[Abstract]:The legal rights of college students are an important part of citizens' basic human rights. In the current law of our country, the students of colleges and universities enjoy a wide range of rights, except for the right to vote and stand for election, except for the right to vote and stand for election, all the other civil rights stipulated by the law are applicable to the students. At present, the students' rights in colleges and universities in our country have made great progress, whether they are the types, the quantity, or the actual implementation of the rights. In a sense, college students are in a weak position, and the phenomenon of infringing on students' legal rights occurs from time to time in our country. Therefore, it is far from enough that the students' rights are prescribed by law only. The legal rights enjoyed by college students must be transformed into reality through corresponding measures, in order to truly and completely realize the protection of students' rights and have practical value. In this paper, the basic contents of students' rights in colleges and universities, the history and present situation of the protection of the rights of students in institutions of higher learning, the manifestations and causes of the damage to the rights of students in institutions of higher learning, and the main countermeasures for strengthening the protection are studied. In terms of the basic content of college students' rights, this paper expounds the general theory of rights, and theoretically analyzes the role orientation of college students and the main contents of students' rights in institutions of higher learning. In terms of the history and present situation of the protection of the rights of college students, this paper reviews the history of the protection of the rights of students in colleges and universities in China, and analyzes the present situation of the protection of the rights of students in colleges and universities in China. In the aspects of the expression, causes and main countermeasures of the damage to the rights of college students, this paper first expounds and summarizes the forms of expression of the damage of the rights of the students in colleges and universities, and then analyzes the reasons leading to the damage of the rights of the students in colleges and universities. Finally, the paper puts forward the main countermeasures to strengthen the protection of college students' rights. The protection of college students' rights is not only a systematic project, but also a great practical subject. Involving a large number of complex contents and problems that need to be studied in theory and in practice. Due to the limited professional knowledge learned by individuals and the need to improve their research capabilities, only a preliminary study has been carried out on one aspect of the subject, There are still many problems to be further studied and explored in the future.
