【摘要】：在依法治國的大背景下,高校要進(jìn)行法制化改革必然要對高校規(guī)章制度進(jìn)行規(guī)范化建設(shè),但由于高校地位的特殊性,對于高校規(guī)章制度如何進(jìn)行規(guī)范化法制化建設(shè)一直眾說紛紜,隨著理論的不斷發(fā)展,軟法以其區(qū)別于硬法的靈活彈性,比一般契約規(guī)范更具有約束性的特點,使大家看到高校規(guī)章制度進(jìn)行規(guī)范化的可能。因此從軟法層面研究高校規(guī)章制度,建立以章程為核心,全方位多層面的高校規(guī)章制度成為本文研究的重點。文章從高校規(guī)章制度的界定入手,分析高校規(guī)章制度的特殊性,將其納入軟法的范疇,接著梳理改革開放前后我國高校規(guī)章制度發(fā)展的歷史,對我國高校規(guī)章制度的現(xiàn)狀進(jìn)行分析,總結(jié)出高校規(guī)章制度規(guī)范化發(fā)展遇到的問題。通過對高校規(guī)章制度規(guī)范化的軟法理論層面的分析,分析軟法的優(yōu)勢及軟法實施的必要性及可行性,進(jìn)一步確立軟法在高校規(guī)章制度中的地位價值。最后對高校規(guī)章規(guī)范化建設(shè)提供建設(shè)思路,針對問題提出解決方案,對高校規(guī)章制度的規(guī)范化體系的建構(gòu)提供可行性的建議。
[Abstract]:Under the background of governing the country according to law, colleges and universities must carry on the standardization construction to the university rules and regulations in order to carry on the legal system reform, but because of the university status particularity, With the development of the theory, soft law is different from hard law, and it is more binding than the general contract norm, because of its flexibility and flexibility, as to how to carry out the standardization and legalization construction of the rules and regulations of colleges and universities, and with the continuous development of the theory, the soft law is more binding than the general contract norm. So that we can see the possibility of standardizing the rules and regulations of colleges and universities. Therefore, it is the focal point of this paper to study the university rules and regulations from the soft law level, and to establish the university rules and regulations with the rules as the core and the all-round and multi-level rules and regulations as the core. Starting with the definition of university rules and regulations, this paper analyzes the particularity of university rules and regulations, brings them into the category of soft law, and then combs the history of the development of university rules and regulations before and after the reform and opening up. This paper analyzes the present situation of the rules and regulations of colleges and universities in China, and summarizes the problems encountered in the standardization development of the rules and regulations of colleges and universities. This paper analyzes the advantages of soft law and the necessity and feasibility of implementing soft law through analyzing the theoretical level of soft law in the standardization of university rules and regulations, and further establishes the position value of soft law in the rules and regulations of colleges and universities. Finally, it provides the construction idea for the standardization construction of the university regulations, puts forward the solution to the problem, and provides the feasible suggestion for the construction of the standardization system of the university rules and regulations.
