S大學教師參與學校治理的現(xiàn)狀研究

【摘要】:大學教師參與大學治理,是指作為大學治理過程中的重要利益相關者,包括教授和非教授職稱在內(nèi)的全體大學教師,在大學教學、科研、人事、后勤等不同領域的治理事務中,擁有合法合理的參與權利,能維護自身權益,促進大學治理中決策的科學化、民主化,提高大學治理的現(xiàn)代化水平!秶抑虚L期教育改革與發(fā)展規(guī)劃綱要》提出到2020年基本實現(xiàn)教育現(xiàn)代化,2015年國務院《統(tǒng)籌推進世界一流大學和一流學科建設總體方案》表明要統(tǒng)籌推進世界一流大學和一流學科建設,建設高等教育強國。不實現(xiàn)大學教師有效參與大學治理,就無法實現(xiàn)大學治理現(xiàn)代化,也就無法實現(xiàn)上述兩大發(fā)展目標。我國大學在建國之初照搬蘇聯(lián)模式,成為政府機構的附屬機構,政府對于大學實行全方位的管控。隨著時代的發(fā)展進步,雖然政府分權放權和實現(xiàn)大學自主權作為大學和學術發(fā)展的本質(zhì)需求,越來越引起廣泛的重視,目前我國大學基本建立了黨委領導下的校長負責制,大學的法人地位和大學章程建設也在逐步推進。但在大學內(nèi)部,傳統(tǒng)的科層制管理導致的大學“行政化”問題依然十分嚴重,而作為大學治理重要的參與主體——大學教師參與的狀況卻令人擔憂。因此,本文以大學教師參與大學治理為研究的重點,通過對我國政策法規(guī)、S大學章程等文本中對于大學教師的參與權利、內(nèi)容、途徑等進行文本分析和對S大學教師參與學校的治理現(xiàn)狀進行問卷調(diào)查這兩個大的方面,來探究S大學教師參與大學治理中存在的問題。在國家政策法律層面,雖然對于大學教師參與權利有一定的保障,但是總體上來看,未確立大學教師參與大學治理的核心主體地位,對于大學教師參與大學治理賦予的權利范圍較小、內(nèi)容較少,缺乏保障落實的細則和措施;在S大學章程上,照搬國家已有的政策法律文本居多,切實深化和細化的落實措施少,缺乏大學教師有效參與決策和監(jiān)督的機制和組織,也無法有效保障大學教師參與權利的落實。在S大學教師參與學校治理的問卷調(diào)查中發(fā)現(xiàn),S大學教師擁有參與大學治理的內(nèi)在訴求,但是因為制度、途徑、自身參與意識和能力等原因,S大學教師并未有效參與到大學治理當中,且S大學教師對于參與的現(xiàn)狀并不滿意。針對法律政策文本分析以及問卷調(diào)查中發(fā)現(xiàn)的問題,本文提出了相應的建議和對策措施。一方面,在大學治理的外部,需要政府進一步完善法律政策制度,賦予大學教師更多且更明確的參與權利;要合理構建政府與大學之間的關系,政府合理的分權和放權,實現(xiàn)大學獨立法人地位和充分的自主權。這些外部的宏觀政策法律和政校關系是大學教師參與大學治理的外部環(huán)境。另一方面,在大學內(nèi)部治理當中,第一,大學應當深化、細化法律制度文本,構建參與機制和組織,保障大學教師參與權利切實可行;第二,大學內(nèi)部的治理需進一步去“行政化”,提升“學術權利”和“教師權利”,實現(xiàn)治理內(nèi)部各主體的權力均衡、多元互動、合作共贏;此外,大學還需要加強教師參與大學治理的宣傳,形成良好的教師參與文化氛圍。最后,從大學教師自身角度來看,亟需要提高參與大學治理意識、提升自身參與能力。
[Abstract]:The participation of university teachers in university governance means that as an important stakeholder in the process of university governance, all the university teachers, including professors and non professorship titles, have legitimate and reasonable reference and rights in the various fields of university teaching, scientific research, personnel and logistics, which can safeguard their own rights and interests and promote the governance of universities. The policy is scientific, democratic and modernized. The program for reform and development of the middle and long term education of the state has been basically modernized by the year 2020. In 2015, the State Council has promoted the overall plan of the construction of world class universities and first-class disciplines by the State Council in 2015. It is impossible to realize the modernization of the university governance without realizing the effective participation of the university teachers in the university governance. The two major development goals can not be realized. In the early days of the founding of the people's Republic of China, the universities of our country copied the Soviet model and became a subsidiary organ of the government institutions. Although the government's decentralization of power and the realization of university autonomy as the essential demand of University and academic development, more and more attention has been paid to it. At present, the university has basically established the principal responsibility system under the leadership of the Party committee, the legal person status of the University and the construction of the University constitution are also progressively advancing. The problem of University "administration" is still very serious, and the participation of university teachers, as an important participant in university governance, is worrying. Therefore, this paper focuses on the participation of university teachers in university governance, and the participation rights of university teachers in the text of China's policies and regulations, the Constitution of S University and so on. The content, the way and so on carries on the text analysis and the questionnaire survey on the present situation of the S University Teachers' participation in the school management, to explore the problems existing in the S University Teachers' participation in the university governance. At the national policy and legal level, although there is a definite guarantee for the rights of the university teachers to participate in the rights, in general, the university has not established the University. Teachers' participation in the core subject of university governance is small, few and lack of detailed rules and measures to ensure the implementation of university governance. In the constitution of S University, the majority of the country's existing policy and legal texts are copied, the practical measures for deepening and refining are few, and the effective participation of university teachers is short. The mechanism and organization of policy and supervision can not effectively guarantee the implementation of the rights of college teachers. In the questionnaire survey on the participation of S teachers in school governance, it is found that the S university teachers have the inherent demand to participate in the university governance. However, because of the system, the way, the consciousness and ability of their own participation, the teachers of the University of S have not been effectively involved in the University. The S university teachers are not satisfied with the present situation of participation. In view of the problems found in the text analysis of the legal policy and the problems found in the questionnaire survey, this paper puts forward the corresponding suggestions and countermeasures. On the one hand, the government needs to further improve the legal policy system and give the university teachers more and more explicit in the outside of the university governance. The relationship between the government and the university should be rationally constructed, the government has the right to decentralization and decentralization, and the independent legal person status and the full autonomy of the university should be realized. The external macro policy law and the political school relationship are the external environment of the University Teachers' participation in the University Governance. Deepening, refining the text of the legal system, constructing the participation mechanism and organization, ensuring the practical feasibility of the participation of the university teachers. Second, the internal governance of the university needs to be further "administrative", to enhance the "academic right" and "teacher rights", to achieve the right to govern the internal rights of the internal bodies of Li Junheng, multi interaction and win-win cooperation; in addition, the university needs also. Strengthen the propaganda of teachers' participation in university governance and form good teachers to participate in the cultural atmosphere. Finally, from the perspective of the university teachers themselves, it is urgent to improve the awareness of participation in university governance and enhance their participation ability.
