【摘要】：德國(guó)大學(xué)自治的公法規(guī)制表現(xiàn)為公法人制度對(duì)大學(xué)自治的維系、恪守與保障,旨在建構(gòu)國(guó)家監(jiān)督與大學(xué)自治的動(dòng)態(tài)平衡與合作伙伴關(guān)系。德國(guó)公立大學(xué)在傳統(tǒng)上被賦予公法社團(tuán)與公營(yíng)造物的雙重法律地位,形成學(xué)術(shù)自治與國(guó)家管制并存的雙重集權(quán)結(jié)構(gòu)。20世紀(jì)90年代以來(lái),受新公共管理運(yùn)動(dòng)的影響,新調(diào)控模式被部分引入德國(guó)高等教育改革中,大學(xué)自治的公法規(guī)制被重新詮釋。形塑?chē)?guó)家規(guī)制、學(xué)術(shù)自治、管理自治、利益相關(guān)者引導(dǎo)與競(jìng)爭(zhēng)機(jī)制五種治理機(jī)制良性互動(dòng)的"治理均衡器",構(gòu)成德國(guó)大學(xué)自治公法規(guī)制的現(xiàn)代內(nèi)涵。
[Abstract]:The public law regulation of university autonomy in Germany is embodied in the maintenance, adherence and guarantee of university autonomy by the public legal person system, which aims to establish a dynamic balance and cooperative partnership between state supervision and university autonomy. German public universities have traditionally been given the dual legal status of public organizations and public creations, forming a dual centralized structure of academic autonomy and state control. Since the 1990s, it has been influenced by the New Public Management Movement. The new regulation mode was partly introduced into the reform of higher education in Germany, and the public law regulation of university autonomy was reinterpreted. The "governance equalizer", which shapes the state regulation, academic autonomy, management autonomy, stakeholder guidance and competition mechanism, constitutes the modern connotation of German university autonomous public law regulation.
