論高等教育法治化的意蘊與挑戰(zhàn)

【摘要】:法治是現(xiàn)代社會治理的基本精神。法治是個體自由權(quán)利的結(jié)果,意味著法律的普遍統(tǒng)治。高等教育法治化作為一個治理命題,是我國高等教育治理現(xiàn)代化的必然選擇。它以實現(xiàn)良好而有序的治理為目的,在內(nèi)容上體現(xiàn)為大學(xué)相關(guān)主體間權(quán)利關(guān)系的明確。確認的權(quán)利關(guān)系只有通過漸進的制度化過程,才會具體而實在。作為"雙重"移植命題,高等教育法治化需要面臨文化差異和法治客觀現(xiàn)實性的挑戰(zhàn);同時,高等教育法治化需要處理法治介入知識生產(chǎn)和大學(xué)特殊法律關(guān)系帶來的困擾。
[Abstract]:The rule of law is the basic spirit of modern social governance. The rule of law is the result of individual free rights, which means the universal rule of law. It is an inevitable choice for the modernization of higher education governance in our country. It aims at achieving good and orderly governance, and embodies in its content a clear relationship of rights among relevant subjects of universities. The confirmed right relationship is only through the gradual institutionalization process. As a "double" transplant proposition, the legalization of higher education needs to face the challenge of cultural differences and the objective reality of the rule of law. The legalization of higher education needs to deal with the problems caused by the involvement of the rule of law in the production of knowledge and the special legal relationship in universities.
