依法治國視域中高校“思政課”的法制教育研究

【摘要】:改革開放以來,黨和國家的領(lǐng)導(dǎo)人始終高度重視青年學(xué)生的法制教育。與此同時,我國法治化進(jìn)程不斷加快,高校的法制教育也取得了前所未有的成績。然而,全面推進(jìn)依法治國的時代要求,又賦予了高校以思想政治理論課(下文簡稱“思政課”)為主渠道、主陣地的法制教育以新的使命。習(xí)近平總書記在2014年中國共產(chǎn)黨第十八次全國代表大會第四次會議上提出,要全面推進(jìn)依法治國,建設(shè)社會主義法治國家。這使高!八颊n”進(jìn)一步完善和加強(qiáng)法制教育成為十分緊迫的任務(wù)。一般而言,法制教育即以法律制度、法律法規(guī)為主要內(nèi)容的教育教學(xué)活動。全面依法治國則要求高校法制教育不僅要重視法律、法規(guī)的知識性教育,更要重視對大學(xué)生的法理教育和法制意識、法治精神、法制行為的培育。因此,如何將全面推進(jìn)“依法治國”的新精神、新要求貫徹到教學(xué)中,嚴(yán)格按照“進(jìn)教材,進(jìn)課堂,進(jìn)頭腦”的“三進(jìn)”要求進(jìn)一步完善和加強(qiáng)法制教育,提升“思政課”法制教育的實(shí)效性,成為深化“思政課”教學(xué)改革、提升“思政課”內(nèi)涵質(zhì)量建設(shè)的重要課題。對此,本文主要研究了以下四方面內(nèi)容:一是依法治國的概念及主要理論,闡明依法治國在高校人才培養(yǎng)中的地位和作用。二是從當(dāng)前“思政課”法制教育的現(xiàn)實(shí)出發(fā),提出了當(dāng)前“思政課”法制教育完善的必要性和緊迫性,分析存在的主要問題:法制教育的主體性問題;法制教育方法的改進(jìn)問題;法制教育內(nèi)容適度調(diào)整等。這些問題的成因是多方面的,在主觀上,既與師生對待依法治國、法制教育的主觀態(tài)度有關(guān),又與學(xué)生對依法治國、法制教育的價值認(rèn)同內(nèi)在相聯(lián)。在客觀上,法制教育的課程滲透不夠,師資隊(duì)伍專業(yè)化程度不高是主要原因。三是就高!八颊n”的法制教育的多角關(guān)系進(jìn)一步分析法制教育多方面滲透的途徑,重點(diǎn)探討了法制教育與道德教育、法制教育與思想教育等關(guān)系,提出了拓展高校法制教育的思路。四是提出并論證完善“思政課”法制教育體系幾點(diǎn)建議,如加強(qiáng)法制教育的頂層設(shè)計,加強(qiáng)課程體系、教學(xué)體系、考核體系的一體化建設(shè)等。本文充分肯定了改革開放以來高校法制化教育所取得的重要成果,根據(jù)依法治國的新要求,對高!八颊n”的法制教育進(jìn)行了重要分析,在肯定成效的基礎(chǔ)上指出了有待完善的幾方面內(nèi)容,提出了以頂層設(shè)計理論指導(dǎo)“思政課”法制教學(xué)體系完善和促進(jìn)師生觀念轉(zhuǎn)變,加強(qiáng)多課程相互滲透,創(chuàng)新綜合考核體系等建議。在全面推進(jìn)依法治國的視域中,為“思政課”法制教育更好地服務(wù)于現(xiàn)代法治國家的人才培養(yǎng)提供理論參考。
[Abstract]:Since the reform and opening up, the party and state leaders have always attached great importance to the legal education of young students. At the same time, the process of rule of law in China is accelerating, legal education in Colleges and universities has hitherto unknown results. However, comprehensively promote the rule of law and the requirements of times, given to college ideological and Political Theory Course (hereinafter referred to as "thinking the political class") as the main channel, the main position in the new legal education mission. The three is the University Ideological and political course of the legal education of the multi angle relation further analysis of legal education on the osmotic way, focusing on legal education and the relationship between legal education and moral education, ideological education, puts forward the development of university legal education ideas. The four is proposed and demonstrated to improve the ideological and political course system of legal education suggestions, such as strengthening the legal education of the top Layer design, strengthen the curriculum system, teaching system, appraisal system integration. This paper fully affirmed the important achievements of university legal education since the reform and opening up, according to the new requirements of the rule of law, the ideological and political course in university legal education are important in the analysis, based on the effectiveness of the said the contents of several aspects to be perfect, put forward to guide the top-level design theory of Ideological and political course teaching system and improve the legal system to promote teacher-student concept, strengthen the course of mutual penetration, innovation of comprehensive evaluation system and so on. In advancing the rule of law in the perspective of culture, and provide a theoretical reference for the ideological and political course of legal education to better serve the modern country under the rule of law talents.
