茶葉銷(xiāo)售合同糾紛解決機(jī)制研究

【摘要】:隨著我國(guó)對(duì)外開(kāi)放水平的不斷提升,越來(lái)越多的茶企開(kāi)始搶占國(guó)際市場(chǎng),通過(guò)簽訂銷(xiāo)售合同的形式,走茶國(guó)際市場(chǎng)營(yíng)銷(xiāo)路線(xiàn)。在實(shí)際操作中,國(guó)際貿(mào)易中的茶葉銷(xiāo)售合同糾紛造成的后果遠(yuǎn)遠(yuǎn)高于國(guó)內(nèi)貿(mào)易。本文對(duì)茶葉企業(yè)國(guó)際貿(mào)易銷(xiāo)售合同在商務(wù)洽談、合同簽訂、合同履行中可能遇到的法律糾紛風(fēng)險(xiǎn)進(jìn)行分析,并提出了茶葉企業(yè)國(guó)際貿(mào)易銷(xiāo)售合同糾紛解決機(jī)制,即制定銷(xiāo)售合同各環(huán)節(jié)的差異化管理機(jī)制,實(shí)行銷(xiāo)售合同全過(guò)程管理,建立統(tǒng)一歸口管理與各業(yè)務(wù)部門(mén)分口管理模式。
[Abstract]:With the development of our country's opening to the outside world, more and more tea enterprises begin to seize the international market and take the international marketing route by signing the sales contract. In practice, the consequences of tea sales contract disputes in international trade are much higher than domestic trade. This paper analyzes the risks of legal disputes that may be encountered in the negotiation, signing and execution of international trade sales contracts for tea enterprises, and puts forward a dispute resolution mechanism for international trade sales contracts of tea enterprises. That is, to establish the differential management mechanism of each link of the sales contract, implement the whole process management of the sales contract, and establish the unified centralized management model and the separate management mode of the various business departments.
