【摘要】：隨著21世紀經(jīng)濟水平、生活水平的提高和大眾消費意識的轉(zhuǎn)變,旅游業(yè)隨之蓬勃發(fā)展,人們對旅游活動提出了更大的需求和更高的要求。與此同時,隨著旅游業(yè)日新月異的發(fā)展,一種將旅游與醫(yī)療相結(jié)合的新興旅游模式——醫(yī)療旅游也在悄然興起�？梢哉f,醫(yī)療旅游是旅游業(yè)發(fā)展過程中產(chǎn)生的新興旅游模式,也是世界經(jīng)濟發(fā)展到一定階段的新型化旅游模式。在全球經(jīng)濟發(fā)展一體化的影響下,交通、通訊便利化的環(huán)境下,醫(yī)療旅游必然成為一種重要的旅游模式。然而,醫(yī)療旅游內(nèi)在所具有的醫(yī)療行為結(jié)果的差異性、某種程度的不可預(yù)見性和旅游行為矛盾的多發(fā)性導(dǎo)致醫(yī)療旅游糾紛發(fā)生的必然性和不可避免性。有了糾紛就必須及時應(yīng)對采取措施,有效地予以化解,才能實現(xiàn)秩序的良性回歸。對一個國家而言,糾紛解決是法制構(gòu)建的重要一環(huán)。它必須建立一套完善的糾紛解決體制,引導(dǎo)社會生活主體按需選擇適當?shù)募m紛解決方式。對當事人而言,應(yīng)當積極了解并熟悉各種糾紛解決的路徑和方式,同時需要注意如何高效地解決糾紛,實現(xiàn)自身利益的最大化。近年來,在韓流的浪潮影響下、韓國整形美容類醫(yī)療旅游的多樣化營銷下,赴韓整容已成為海外游客,尤其是中國消費者赴韓醫(yī)療旅游的主要目的之一。但整容手術(shù)失敗、整容糾紛置之不理不予解決、赴韓醫(yī)療旅游消費者權(quán)益受侵犯卻維權(quán)困難等諸多問題,使我國赴韓醫(yī)療旅游消費者成為了一幕幕醫(yī)療糾紛中出鏡率最高的受害者。中國整形美容協(xié)會在赴韓整形維權(quán)失敗案例通報會顯示,目前我國消費者赴韓整容事故和糾紛的發(fā)生率,以每年10%至15%的比例在增加。糾紛發(fā)生后,若處理不當,對當事人而言,消耗大量的財力和精力,個案公平難以實現(xiàn);對國家而言,不僅影響國家旅游業(yè)的發(fā)展,更影響國家社會秩序的良性發(fā)展。因此,研究赴韓醫(yī)療旅游糾紛解決機制有著至關(guān)重要的意義。本文主要針對中國消費者赴韓醫(yī)療旅游糾紛的現(xiàn)狀,以全面了解和剖析韓國醫(yī)療旅游及醫(yī)療旅游糾紛解決的法律規(guī)制為中心,最終以求探索我國醫(yī)療旅游糾紛解決的法律機制(還包括建立醫(yī)療旅游糾紛解決的國際合作機制)。主要包括以下內(nèi)容:首先,對醫(yī)療旅游的基本理論進行梳理,對醫(yī)療旅游糾紛的基本概念、醫(yī)療旅游糾紛的概況進行分析,對醫(yī)療旅游糾紛解決機制進行類型歸納,為研究提供基本理論基礎(chǔ)。其次,對韓國醫(yī)療旅游法律制度進行全面的介紹與評析。對韓國醫(yī)療旅游、醫(yī)療旅游糾紛的立法現(xiàn)狀進行全面的分析,為研究提供基本法理基礎(chǔ)。再次,對韓國醫(yī)療旅游糾紛解決制度進行歸類與剖析。對韓國醫(yī)療旅游糾紛解決機制特別是醫(yī)療旅游糾紛的非訴訟解決機制進行詳細的介紹及評析,分析制度的發(fā)展及完善,為我國醫(yī)療旅游糾紛多元化解決機制的建立及完善提供可吸取性的經(jīng)驗。最后,在上述研究的基礎(chǔ)上提出如何建立我國醫(yī)療旅游糾紛解決機制,完善相關(guān)法制,同時研究中韓雙邊及多變環(huán)境下赴韓醫(yī)療旅游的國際合作解決機制,應(yīng)對赴韓及各類涉外醫(yī)療旅游糾紛,建立有效可行的醫(yī)療旅游糾紛解決機制。
[Abstract]:With the twenty-first Century economic level, the improvement of living standards and changing consumer awareness, tourism booming, people put forward the demand for higher and higher requirements for tourism activities. At the same time, along with the development of the tourism industry will change rapidly, a combination of medical tourism and new tourism mode in medical tourism quietly. It can be said that medical tourism is a new tourism mode in tourism development, but also the development of the world economy to a certain stage of the new mode of travel. The traffic impact of the global economic development, integration, communication facilitation environment, medical tourism will become an important tourism mode. However, the difference of the medical behavior results of the internal medical tourism, a certain degree of unpredictability and travel behavior contradictions led to multiple medical tourism disputes The necessity and inevitability. The dispute must be timely response measures, effectively to resolve, in order to achieve the benign regression order. For a country, the dispute resolution is an important part of the construction of legal system. It is necessary to establish a perfect dispute settlement system, guiding the main social life according to need to choose the appropriate the way to solve the dispute. In terms of the parties, should actively understand and be familiar with all kinds of paths and ways to resolve disputes, also need to pay attention to how to solve the disputes effectively, maximize their own interests. In recent years, in the tide of the Hallyu wave under the diversified marketing of Korean plastic surgery medical tourism, Korea has become a cosmetic overseas tourists, especially the main purpose of China consumers of medical tourism to Korea. But the failure of cosmetic surgery, cosmetic ignore not solve the disputes, Korea Medical Tourism Consumer Rights Yi has infringed rights and other difficult problems, so that consumers of medical tourism to Korea and China has become the highest rate of appearance of a scene of victims of medical disputes. Therefore, there is important significance to study the dispute settlement mechanism of medical tourism to Korea according to the present situation. This paper China consumer disputes of medical tourism to Korea, with a comprehensive understanding and analysis of Korean medical tourism and medical tourism to solve disputes of legal regulation In order to explore the mechanism of heart, the final legal disputes in China to solve the medical tourism (including international cooperation mechanism established medical tourism disputes). Mainly includes the following contents: firstly, the basic theory of medical tourism to sort out the basic concept of medical tourism disputes, disputes of medical tourism were analyzed, the mechanism of medical tourism dispute resolution types, provide basic theoretical foundation for the research. Secondly, to introduce and evaluate the comprehensive of the South Korean medical tourism legal system. On the South Korean medical tourism, medical tourism disputes law situation to conduct a comprehensive analysis, provide the basic legal basis for the research. Thirdly, to solve the Korean medical disputes were classified and the tourism system analysis of the South Korean medical tourism. The dispute settlement mechanism especially the non litigation settlement mechanism of medical tourism disputes were introduced in detail and the evaluation and analysis system The development and improvement for medical tourism disputes in our country establish and perfect the diversified solution can absorb the experience of providing mechanism. Finally, on the basis of the above research on how to set up the medical tourism disputes in our country, improve the relevant legal system, and the study of China and South Korea bilateral and multi resolution mechanism of international cooperation to Korea Medical Tourism to deal with environment, and all kinds of foreign medical tourism disputes, establish effective medical tourism dispute settlement mechanism.
