基于收益分成法的網(wǎng)絡(luò)游戲著作權(quán)價(jià)值評估

【摘要】:當(dāng)前網(wǎng)絡(luò)游戲產(chǎn)業(yè)繁榮發(fā)展,僅經(jīng)過十余年時(shí)間發(fā)展,我國自主研發(fā)游戲的實(shí)際銷售收入已達(dá)到了上億元的規(guī)模。2016年其收入規(guī)模相對于2008年增長了將近10倍,整個網(wǎng)絡(luò)游戲產(chǎn)業(yè)自21世紀(jì)初以來一直保持著快速發(fā)展的趨勢。網(wǎng)絡(luò)游戲市場的繁榮必然帶來網(wǎng)絡(luò)游戲的頻繁交易及相關(guān)的法律訴訟,這就需要對網(wǎng)絡(luò)游戲著作權(quán)價(jià)值進(jìn)行客觀而公正的評估。然而現(xiàn)階段我國在網(wǎng)絡(luò)游戲著作權(quán)價(jià)值評估與確定領(lǐng)域內(nèi)的研究仍有所欠缺,這對于網(wǎng)絡(luò)游戲著作權(quán)的交易、訴訟、保護(hù)等產(chǎn)生了阻礙,制約了整個網(wǎng)絡(luò)游戲產(chǎn)業(yè)的發(fā)展。本文對網(wǎng)絡(luò)游戲著作權(quán)資產(chǎn)價(jià)值的評估展開研究,不僅為網(wǎng)絡(luò)游戲著作權(quán)的交易提供參考和支持,也為網(wǎng)絡(luò)游戲著作權(quán)的訴訟保護(hù)奠定基礎(chǔ),甚至為中小企業(yè)利用網(wǎng)絡(luò)游戲著作權(quán)進(jìn)行質(zhì)押融資等活動提供便利。本文首先在對網(wǎng)絡(luò)游戲行業(yè)的定義及分類、市場發(fā)展?fàn)顩r、產(chǎn)業(yè)鏈、盈利模式、運(yùn)營模式等進(jìn)行詳細(xì)分析的基礎(chǔ)上闡釋了網(wǎng)絡(luò)游戲著作權(quán)的內(nèi)涵,并對網(wǎng)絡(luò)游戲著作權(quán)價(jià)值的影響因素做了詳細(xì)分析。然后本文在對常用的三種評估方法的適用性進(jìn)行分析后,提出了本文運(yùn)用的收益分成率方法,并詳細(xì)介紹了其評估思路。分月預(yù)測網(wǎng)絡(luò)游戲收入流水,并采用了區(qū)間預(yù)測的方法,利用蒙特卡洛模擬得到最終結(jié)果。在運(yùn)用層次分析法與專家打分方法的基礎(chǔ)上,本文構(gòu)建了網(wǎng)絡(luò)游戲著作權(quán)價(jià)值評價(jià)指標(biāo)體系并確定了每個指標(biāo)的權(quán)重,為后文的收益分成率的確定奠定基礎(chǔ)。然后本文介紹了基于集值統(tǒng)計(jì)的著作權(quán)資產(chǎn)收益分成率評價(jià)方法,對專家評價(jià)結(jié)果進(jìn)行數(shù)據(jù)處理,減少專家打分的隨機(jī)誤差。最后選擇了一款移動游戲以實(shí)踐上文所構(gòu)建的評估方法,先介紹了《吞食天下》游戲的概況,再根據(jù)上文建立的評估方法與流程,對《吞食天下》著作權(quán)價(jià)值進(jìn)行評估確定。最后為總結(jié)與展望,簡要回顧了全文形成的主要觀點(diǎn)和結(jié)論,接下來說明由于多方面的原因,研究還有一些不夠完善之處,希望在將來能夠改進(jìn)和深入。
[Abstract]:At present, the online game industry is booming, and after only more than a decade of development, the actual sales revenue of self-developed games in China has reached the scale of hundreds of millions of yuan. In 2016, its revenue scale has increased nearly tenfold compared with 2008. Since the beginning of the 21 st century, the whole online game industry has been keeping the trend of rapid development. The prosperity of the online game market will inevitably lead to frequent transactions and related legal litigation of online games, which requires an objective and fair evaluation of the value of copyright of online games. However, there is still a lack of research in the field of evaluation and determination of the value of online game copyright in our country at the present stage, which hinders the trade, litigation and protection of the copyright of online game, and restricts the development of the whole online game industry. In this paper, the evaluation of the value of online game copyright is studied, which not only provides reference and support for online game copyright transaction, but also lays a foundation for the litigation protection of online game copyright. Even for the use of online game copyright for small and medium-sized enterprises to pledge financing and other activities to facilitate. In this paper, the definition and classification of online game industry, market development, industry chain, profit model, operation mode and so on are analyzed in detail, and the connotation of online game copyright is explained in this paper. And to the network game copyright value influence factor has made the detailed analysis. Then, after analyzing the applicability of the three commonly used evaluation methods, the paper puts forward the method of income sharing rate, and introduces its evaluation idea in detail. The revenue flow of online games is forecasted in different months, and the final results are obtained by Monte Carlo simulation using interval prediction method. Based on the analytic hierarchy process (AHP) and the expert scoring method, this paper constructs the evaluation index system of the copyright value of online games and determines the weight of each index, which lays a foundation for the determination of the income share rate in the following articles. Then, this paper introduces the method of evaluating the rate of proceeds of copyright assets based on set-valued statistics, and processes the result of expert evaluation to reduce the random error of expert scoring. Finally, a mobile game is selected to practice the evaluation method constructed above. The general situation of "devouring the world" game is introduced first, and then the value of copyright is evaluated and determined according to the evaluation method and process established above. Finally, in order to summarize and prospect, the paper briefly reviews the main viewpoints and conclusions formed in the full text, and then explains that due to various reasons, the research is still not perfect enough, hoping to improve and deepen the research in the future.
