【摘要】：農(nóng)民工是由于我國(guó)戶籍制度的建立，且伴隨著我國(guó)城鎮(zhèn)化及現(xiàn)代化的快速推進(jìn)而形成的一個(gè)特殊的社會(huì)群體，他們身份是農(nóng)民，但工作和生活重心逐步向城市和非農(nóng)產(chǎn)業(yè)轉(zhuǎn)變，已經(jīng)成為加快我國(guó)現(xiàn)代化進(jìn)程的中堅(jiān)力量。而進(jìn)入21世紀(jì)后，受我國(guó)城鄉(xiāng)二元結(jié)構(gòu)、相關(guān)體制還未健全完善，以及農(nóng)民工群體自身特點(diǎn)等各方面因素影響，農(nóng)民工外出務(wù)工時(shí)其就業(yè)權(quán)益很難得到有效保障，同時(shí)，在農(nóng)民工的就業(yè)權(quán)益受到侵害以后，他們?nèi)鄙僬５那纴?lái)維護(hù)自己的合法權(quán)益。如何有效保障農(nóng)民工就業(yè)權(quán)益已成為社會(huì)、政府和學(xué)術(shù)界討論的熱點(diǎn)問(wèn)題。近年來(lái)，受到金融危機(jī)的影響，農(nóng)民工“返鄉(xiāng)潮”、“民工荒”現(xiàn)象交替出現(xiàn)，農(nóng)民工流動(dòng)數(shù)量急劇增加，這就給勞務(wù)輸出地和輸入地政府都帶來(lái)了新的管理難題，在強(qiáng)化農(nóng)民工就業(yè)權(quán)益保障上提出了新的要求。就業(yè)是民生之本，對(duì)于外出務(wù)工的農(nóng)民工來(lái)說(shuō)，就業(yè)權(quán)益是其經(jīng)濟(jì)、政治和社會(huì)等各項(xiàng)權(quán)益的基礎(chǔ)，農(nóng)民工的就業(yè)權(quán)益得不到有效保障，將會(huì)影響到大量的農(nóng)村轉(zhuǎn)移勞動(dòng)力日常的生活、生產(chǎn)，進(jìn)而影響整個(gè)社會(huì)的穩(wěn)定和發(fā)展,成為制約我國(guó)城市化進(jìn)程和城鄉(xiāng)統(tǒng)籌發(fā)展的“瓶頸”。 政府的權(quán)力是人民賦予的，，本文認(rèn)為，政府應(yīng)該不斷加強(qiáng)對(duì)公民和社會(huì)的責(zé)任感，尤其是針對(duì)農(nóng)民工這一特殊的龐大的群體，更要積極作為，有效保障他們的就業(yè)權(quán)益。而勞務(wù)輸出地政府作為農(nóng)民工戶籍所在地和歸屬地的責(zé)任主體，更應(yīng)當(dāng)在保障農(nóng)民工權(quán)益上發(fā)揮主體作用。本文站在勞務(wù)輸出地政府的角度，通過(guò)對(duì)目前我國(guó)中央到地方現(xiàn)行的相關(guān)政策，四川省等典型勞務(wù)輸出地對(duì)農(nóng)民工就業(yè)的基本現(xiàn)狀和就業(yè)權(quán)益保障現(xiàn)狀進(jìn)行分析，討論了目前勞務(wù)輸出地農(nóng)民工就業(yè)權(quán)益保障所存在的問(wèn)題和主要原因，從而得出了勞務(wù)輸出地政府保障農(nóng)民工就業(yè)權(quán)益的對(duì)策，即構(gòu)建農(nóng)民工就業(yè)權(quán)益保障機(jī)制：一是建立與輸出地政府之間的合作機(jī)制；二是要建立引導(dǎo)農(nóng)民工有序就業(yè)的服務(wù)機(jī)制，從而進(jìn)一步強(qiáng)化外出務(wù)工的農(nóng)民工就業(yè)權(quán)益保障。
[Abstract]:Migrant workers are a special social group formed by the establishment of household registration system and the rapid development of urbanization and modernization in our country. They are farmers, but the focus of work and life is gradually changing to cities and non-agricultural industries. Since 21th century, it has been affected by the dual structure of China's urban and rural areas, the imperfect system and the characteristics of migrant workers. When migrant workers go out to work, their employment rights and interests are difficult to be effectively protected. At the same time, after the employment rights and interests of migrant workers are infringed, They lack normal channels to protect their legitimate rights and interests. How to effectively protect the employment rights and interests of migrant workers has become a hot issue in society, government and academia. In recent years, they have been affected by the financial crisis. The phenomenon of migrant workers'"returning to their hometowns" and "shortage of migrant workers" alternately appears, and the number of migrant workers' mobility has increased sharply, which has brought new management problems to the governments of both the labor export and the importing countries. New requirements have been put forward to strengthen the protection of migrant workers' employment rights and interests. Employment is the foundation of people's livelihood. For migrant workers, employment rights and interests are the basis of their economic, political and social rights and interests. If the employment rights and interests of migrant workers are not effectively protected, it will affect the daily life and production of a large number of rural migrant workers, thereby affecting the stability and development of the whole society. It has become the bottleneck that restricts the process of urbanization and the overall development of urban and rural areas. The power of the government is conferred by the people. This paper holds that the government should constantly strengthen its sense of responsibility to the citizens and the society, especially for this special large group of migrant workers. The government of the export place of labor service, as the responsible subject of the place where the migrant workers are registered and belonging, should play a main role in protecting the rights and interests of the migrant workers. Through the analysis of the current relevant policies from the central to local governments and the typical labor export places such as Sichuan Province, this paper analyzes the basic status quo of the employment of migrant workers and the present situation of protecting their employment rights and interests. This paper discusses the existing problems and main reasons of the protection of the employment rights and interests of migrant workers in the labor export areas at present, and concludes the countermeasures for the governments of the labor export places to protect the employment rights and interests of the migrant workers. The first is to establish a cooperative mechanism between the government and the exporting government; the other is to establish a service mechanism to guide the orderly employment of migrant workers, so as to further strengthen the protection of migrant workers' employment rights and interests.
