【摘要】：隨著經(jīng)濟(jì)技術(shù)創(chuàng)新的加快,作為新興產(chǎn)業(yè)的網(wǎng)絡(luò)經(jīng)濟(jì)也展現(xiàn)出了蓬勃生機(jī)。網(wǎng)絡(luò)經(jīng)濟(jì)的新特點(diǎn)促使原有的社會(huì)經(jīng)濟(jì)運(yùn)作結(jié)構(gòu)發(fā)生新變化,更對(duì)人們的價(jià)值觀念、生產(chǎn)方式及競(jìng)爭(zhēng)形式產(chǎn)生重大影響。雖然網(wǎng)絡(luò)經(jīng)濟(jì)是新興產(chǎn)業(yè),但其重要性足以影響著市場(chǎng)經(jīng)濟(jì)的發(fā)展進(jìn)程。隨著我國(guó)科學(xué)技術(shù)的不斷進(jìn)步和對(duì)外開(kāi)放的基本國(guó)策,中國(guó)特色的市場(chǎng)經(jīng)濟(jì)蓬勃發(fā)展,繁榮的背后帶來(lái)競(jìng)爭(zhēng)的激勵(lì)的同時(shí),伴隨著網(wǎng)絡(luò)技術(shù)發(fā)展起來(lái)的網(wǎng)絡(luò)經(jīng)濟(jì)帶來(lái)的新型的壟斷行為層出不窮,尤其在界定相關(guān)市場(chǎng)方面給傳統(tǒng)反壟斷法的規(guī)制帶來(lái)眾多挑戰(zhàn),同時(shí)成為當(dāng)前法學(xué)研究和執(zhí)法實(shí)踐的重點(diǎn)領(lǐng)域。 網(wǎng)絡(luò)經(jīng)濟(jì)中對(duì)于反壟斷法中相關(guān)市場(chǎng)的界定與傳統(tǒng)工業(yè)經(jīng)濟(jì)條件下相比具有很多特殊性,除了網(wǎng)絡(luò)這一新的載體的影響外,歸根結(jié)底還是網(wǎng)絡(luò)效應(yīng)的影響。然而,當(dāng)前我國(guó)法學(xué)界還沒(méi)有認(rèn)識(shí)到這一重要性,對(duì)相關(guān)市場(chǎng)界定的研究主要局限在傳統(tǒng)經(jīng)濟(jì)領(lǐng)域,忽略了網(wǎng)絡(luò)經(jīng)濟(jì)條件下壟斷問(wèn)題的嚴(yán)重性。因此本文解決的主要問(wèn)題就是相關(guān)市場(chǎng)的界定在網(wǎng)絡(luò)效應(yīng)的影響下有什么新變化以及如何完善。本文擬從當(dāng)前涉及到網(wǎng)絡(luò)領(lǐng)域壟斷的典型案件出發(fā),分析研究網(wǎng)絡(luò)經(jīng)濟(jì)的特殊性及將會(huì)給傳統(tǒng)的相關(guān)市場(chǎng)界定造成的困境與挑戰(zhàn),并結(jié)合我國(guó)當(dāng)前法律相關(guān)規(guī)定進(jìn)行分析,為構(gòu)建我國(guó)反壟斷領(lǐng)域中相關(guān)市場(chǎng)界定的完整框架以及維護(hù)網(wǎng)絡(luò)經(jīng)濟(jì)市場(chǎng)的公平有序競(jìng)爭(zhēng)提出完善建議。 目前,在網(wǎng)絡(luò)經(jīng)濟(jì)逐漸成為經(jīng)濟(jì)發(fā)展主流的背景下,完善現(xiàn)有的反壟斷法使之符合市場(chǎng)需求和我國(guó)國(guó)情,營(yíng)造一個(gè)公平有序的市場(chǎng)競(jìng)爭(zhēng)環(huán)境,已經(jīng)成為我國(guó)經(jīng)濟(jì)法制研究的重要任務(wù),也符合依法治國(guó)的基本國(guó)策。但從目前的立法現(xiàn)狀來(lái)看,網(wǎng)絡(luò)經(jīng)濟(jì)中的相關(guān)市場(chǎng)界定問(wèn)題雖有所提及但可操作性不強(qiáng),這勢(shì)必會(huì)阻礙我國(guó)網(wǎng)絡(luò)經(jīng)濟(jì)的進(jìn)一步發(fā)展進(jìn)而影響國(guó)民經(jīng)濟(jì)的健康發(fā)展。本文研究的目的就是對(duì)當(dāng)今我國(guó)網(wǎng)絡(luò)經(jīng)濟(jì)條件下的相關(guān)市場(chǎng)界定問(wèn)題進(jìn)行深入研究,從中探求反壟斷法在這一新經(jīng)濟(jì)條件時(shí)代下的制度規(guī)范以及規(guī)制模式的新規(guī)律,從而為網(wǎng)絡(luò)時(shí)代相關(guān)市場(chǎng)界定的困境與變革及我國(guó)反壟斷立法與執(zhí)法的完善提供一定的借鑒和啟示。
[Abstract]:With the acceleration of economic and technological innovation, the network economy, as a new industry, is also showing great vitality. The new characteristics of the network economy promote new changes in the original social and economic operation structure and the values of people. The mode of production and the form of competition have great influence. Although the network economy is a new industry, its importance is enough to influence the development of market economy. With the development of science and technology in China and the basic national policy of opening to the outside world, With the vigorous development of market economy with Chinese characteristics and the encouragement of competition behind the prosperity, with the development of network technology, the new type of monopoly behavior brought by the network economy emerges endlessly. Especially in defining the relevant market, it brings many challenges to the regulation of traditional anti-monopoly law, and becomes the key area of current law research and law enforcement practice. In the network economy, the definition of the relevant market in the anti-monopoly law has many particularities compared with the traditional industrial economy. Besides the influence of the network as a new carrier, the influence of the network effect in the final analysis is still the influence of the network effect. At present, the legal circles in our country have not realized this importance, and the research on the definition of relevant markets is mainly confined to the traditional economic field. It ignores the seriousness of monopoly problem under the condition of network economy. Therefore, the main problem solved in this paper is what new changes and how to perfect the definition of relevant market under the influence of network effect. Typical cases of monopoly in the field of network, This paper analyzes the particularity of the network economy and the difficulties and challenges that will result from the traditional definition of the relevant markets, and analyzes the relevant provisions of the current laws and regulations of our country. In order to construct the complete frame of defining the relevant market in the field of antitrust in our country and to maintain the fair and orderly competition of the network economy market, some suggestions are put forward. At present, under the background that the network economy is gradually becoming the mainstream of economic development, we should perfect the existing anti-monopoly law to meet the market demand and the national conditions of our country, and create a fair and orderly market competition environment. It has become an important task in the study of economic legal system in our country, and it is also in line with the basic state policy of governing the country according to law. However, judging from the current legislative situation, although the relevant market definition problems in the network economy are mentioned, they are not operable. This is bound to hinder the further development of China's network economy and thus affect the healthy development of the national economy. The purpose of this paper is to conduct a thorough study on the relevant market definition issues under the current conditions of our country's network economy. This paper explores the system norms and new rules of the regulation mode of anti-monopoly law under the new economic conditions. Thus, it can provide some reference and inspiration for the dilemma and reform of relevant market definition and the perfection of anti-monopoly legislation and law enforcement in China.
