【摘要】：比特幣自誕生以來備受爭議,金融監(jiān)管部門和理論界往往以比特幣潛在的金融風險和涉及比特幣的互聯(lián)網(wǎng)犯罪為理由否定其貨幣屬性。然而,從當前貨幣法理論的發(fā)展和比特幣的功能出發(fā),比特幣的貨幣屬性應被肯定的,同時比特幣引起的對現(xiàn)有法律制度和貨幣政策的沖擊也可以得到妥善的解決。
[Abstract]:Bitcoin has been controversial since its birth. Financial regulators and theorists often deny its currency attributes on the grounds of its potential financial risks and Internet crimes involving Bitcoin. Based on the development of the current monetary law theory and the function of Bitcoin, the monetary property of Bitcoin should be affirmed, and the impact of Bitcoin on the existing legal system and monetary policy can also be properly solved.
